ORDER, CONVENIENCE AND GENERAL WELFARE BY REGULATING THE USE OF LAND, THE LOCATION AND THE USE OF BUILDINGS AND THE, ARRANGEMENT OF BUILDING LOTS, AND THE DENSITY OF POPULATION iN THE CITY OF COLUMBIA HEIGHTS. THE CITY OF CO I.LNBIA HEIGHTS DOES ORDAIN: Section 1. Ordinance No. 462 is hereby amended as follows: Creation of R-5 zone. An R-5 zone is herein created to allow the Planned Unit Development of Town Houses in the City of Columbia Heights. Section 2. Town Houses shall be subject to the following: A townhouse is a single family building which may be one of up to eight buildings comprising a single structure not over 2 stories. b. A townhouse shall have three to eight units. The structure containing townhouses shall conform to all yard requirements. A townhouse structure having an overall length greater than 80 feet shall have an off-set of eight feet or more or an angle of 22.5 degrees or more. A development project containing more than one structure shall require a conditional use permit. Section 3. Application Review Procedure shall consist of the following: Concept Plan~ Th~ applicant may request a concept review of the proposed development by the Planning Commission to gain information and thoughts relevant to the City Plan and his development, provided the following data is made available to the City in 6 copies. (1) Base Map showing applicant's 'land, plus lot and use pattern for all the land within four hundred (400) feet or more if necessary to show relationship. Statement as to the type of use and architecture as to height' and bulk. (3) Statement on population as to density, number, age distribution, occupancy, etc. (4) Physical feature map showing topography, tree location, drainage pattern and availability of utilities. (5) Concept Plan in sufficient detail to understand density, use relationship access, parking, open space and buil~i'ng mass. Preliminary Plan: The applicant shall file, with the application or within six [6) months after Concept Plan review, a preliminary plan and supporting data. Within sixty (60) days after verification by the staff that the required plan and supporting data is adequate, the Planning Commission shall hold a public hearing. The staff report shall be made avai1able at least 10 days prior to the public hear~ng~ After the hearing, the Planning Commission shall forward to the City Council their recommendation in writing. The City Council shall disapprove, approve or approve with modification and notify the applicant within sixty [60) days after receipt of recommendation unless the applicant agrees to a continuance. Final Plan: Upon approval of the Preliminary Plan by the Council, the applicant may file a request for approval of Final Plan for the entire PUD or for one or more of the development stages as made a part of the supporting data. The Preliminary Plan approval shall become void within one year unless a request is rlade for a Final Plan approval. The P]annin9 Commission shall place a request for Final Plan approval on the next regular Plannin9 Commission agenda after ten (10) days from date of filing. The findings and recommendations of the Plannin9 Commission shall be forwarded to the Council for consideration. Section 4. Should any section, subdivision, clause or other provision of this ordinance be declared by a court of competent jurisdiction to be invalid, such decision shall not effect the validity of the ordinance as a whole nor any part thereof other than the part so declared to be invalid. Section 5. Any person violating this ordinance shall be guilty of a misdemeanor and upon cony[ce[on shall be punished by a fine not to exceed Three hundred dollars ($300.00) or by imprisonment for a period not to exceed ninety (90) days, or both. Section 6. This ordinance shall take effect and be in full force from and after thirty (30) days after its passa9e.
