ORDINANCE NO. 769
GRANTING AN EASEMENT FOR RAILROAD SPUR PURPOSES
EAST FROM JEFFERSON STREET NORTH OF AND ADJOINING
THE NORTH LOT LINE OF LOTS 1 THROUGH 16, BLOCK 1, OF
THE 2ND SUBDIVISION OF BLOCK F, COLUMBIA HEIGHTS ANNEX
TO MINNEAPOLIS, ANOKA COUNTY.
THE CITY OF COLUMBIA HEIGHTS DOES ORDAIN:
Section 1.
In accordance with an agreement propose'd between
Sep-Ko Chemicals, Inc., Soo Line Railroad, and the
City of Columbia Heights which agreement sets forth
a cost sharing on a storm drain installation adjoining
the railroad spur line on the easement described herein
and the need for an easement of record to be granted
to the Soo Line Railroad, and
Section 2.. Sep-Ko Chemicals, Inc. has submitted the full payment
of Six Thousand Dollars ($6,000.00)~ as the railroad
and Sep-Ko share of the storm drain installed parallel
to the spur line, and
Section 3.
The City of Columbia He~gl~ts has completed the storm
drain eas~' of Jefferson Street N.E. north of and parallel
to the railroad spur line the assessable share of which
is Six Thousand Dollars (~6,000.00.)., and
Section 4.
In recognition of the completion of the storm sewer
installation and payment thereof by Sep-Ko Chemicals, Inc.
the Mayor and City Manager a~e hereby authorized and
directed to submit to the Soo Line Railroad an, easement
for railroad purposed across the following parcel of land:
An easement for the purpose of a railroad spur Ii, ne
serving the lots facing 39th Avenue Northeast over
and across a strip of land twenty (20). feet in width,
the Southerly line of said strip being described as
follows: Beginnl. ng at the Northeast corner of Lot One (l),
Block Two (~) of the Second Subdivision of Block F,
Columbia Heights Annex to Minneapolis, Anoka County,
Minnesota; Thence Easterly to the Northwest corner of
Lot Sixteen (16), Block One (1), of said 2nd Subdivision
of Block F; Thence Easterly along the North line of said
Block One (l) to the Northeast corner of Lot Thirteen
(13); Thence Easterly along the North line of
said Block One (1) to the West line of Block Sixty-five
(65), Columbia Heights Annex to Minneapolis, Anoka
County and there terminating.
Section 5.
This Ordinance shall take effect and be in force from
and after thirty (30) days after its passage.
