PREAMBLE
PREAMBLE TO ORDINANCE NO. 767, BEING AN
ORDINANCE ENTITLED "AN ORDINANCE DIRECTING THE
CITY MANAGER NOT TO ADVERTISE FOR BIDS FOR STORM
SEWER AND SANITARY SEWER REPLACEMENT IN JEFFERSON
STREET N.E. BETWEEN' 39TH AND 4OTH AVENUES.
WHEREAS, it became necessary to properly carry on the
functions of Municipal Government of the City of Colum~a
Heights, to proceed with public improvement; and
WHEREAS, under existing project number 7]07 contracted to the
low bidder, Luxenburg Construction Company, which bid anticipated
the potential addition of these utility replacements, which
replacements have now been shown to be necessary.
THIS CITY COUNCIL HEREBY, and under this Preamble declares that
an emergency exists for the preservation of the public safety
and health and welfare and that in order to promptly meet
said e~ergency, it is necessary to pass Ordinance No. 767 as an
emergency ordinance.
