ORDINANCE NO. 763
AN ORDINANCE ESTABLISHING PROCEDURES FOR
THE MAINTENANCE OF SANITARY RUBBISH ACCUMULATION
AT COMMERCIAL AND INDUSTRIAL PROPERTY.
THE CITY OF COLUMBIA HEIGHTS DOES ORDAIN:
Section 1.
No person, firm or corporation shall place any
refuse and/or garbage in any street, alley or
other public place or upon any private property
whether or not owned by such person within
the City except if the same are placed in proper
containers for collection or under express
approval granted by the City Manager of the City
of Columbia Heights.
Section 2. Any unauthorized accumulation of rubbish or
garbage upon any premises is hereby declared to
be a nuisance and is prohibited. Failure to
remove any existing accumulation of refuse and/or
garbage within ten days after the effective
date of this ordinance shall be a violation of
this ordinance.

No person shall cast, place, sweep or deposit
anywhere within the City any refuse in such a
manner that hall be carried or deposited by
the elements upon any street, alley, sidewalk,
sewer, parkway or other public place or into any
occupied premises with the City.
Refuse and/or garbage for commercial and industrial
properties shall be located to the rear of the
rear property line of the building. Said
containers shall be located immediately adjacent
to the ~ilding which the containers serve. The
location of the containers shall be in such
proximity to the property so that their appearance
will not be evident from the street. Where
practical said containers shall be screened by

appropriate fencing and/or shrubbery. Where it is
physically impossible to place the containers
behind the rear line of the main building the
containers shall be placed as inconspicuously as
possible along the side or in front of the b~lding
with appropriate screening.
All refuse and/or garbage shall be placed in sealed
tight containers. No accumulation of refuse and/or
garbage shall be allowed outside of sealed tight
containers upon any commercial or industrial property.
Any person, firm or corporation violating any
provision of this ordinance shall be guilty of a
misdemeanor and upon conviction shall be punished by
a fine of not more than $300.00 or by iraprisonment for
Ninety (90) days, or both.
Section 7.
Should any section, subdivision, clause or other
provision of this Ordinance be declared by a Court
of competent jurisdiction to be invalid, such
decision shall not effect the validity of the Ordinance
as a whole nor any part thereof other than the part
so declared to be invalid.
Section 8.
This Ordinance shall take effect and be in force
from and after thirty (30) days after its passage.
Section 9.
All Ordinances or Sections of Ordinances inconsistent
herewith are hereby repealed.
