ORDINANCE NO. 759
AN ORDINANCE REGULATING THE USE OF THE PARKS liND
PARKWAYS OF THE PARK BOARD OF COLUHBIA HEIGHTS
AND TO SECURE THE QUIET, ORDERLY AND SUITABLE
USE AND ENJOYHENT OF SUCH PARKS, PARKWAYS, AND
PORTIONS OF THE ADJACENT LAKES, STREAHS AND PONDS
BY THE PEOPLE AND PRESCRIBING PENALTIES FOR ITS
VIOLATION.
THE CiTY OF COLUHBIA HEIGHTS DOES ORDAIN:
Section l.
The words "Board" and ~he Board~' as used in this
ordinance are here~y defined to mean the '~Park Board
of the City of Columbia Heights,~ and the term
"Park or Parks" means park, parks, parkways, playground,
recreation fields and buildings, lakes, streams,
ponds and beaches therein, and all public service
facilities conducted on grounds, building% and
structures in the City of Columbia Heights which are
under the control of the Board.
Section 2.
No person shall park, be or remain in, or leave any
vehicle in any park, parkway or drive between the
hours of eleven o~clock P.M. and six o'clock A.M.,
but this section shall not apply to those vehicles
which are authorized to remain in a park.
Section 3.
No person shall in any way injure or deface any building,
facility or any other feature of property upon or
within any parks.
Sect ion 4.
No person not an employee of the Board shall cut,
break, or in any way injure or deface any tree.,:,
shrub or plant within the limits of any park.
Section 5.
No person shall go on foot or otherwise upon the grass
or turf of any park where any sign is posted prohibiting
such conduct.
Section 6.
No person shall throw, deposit or leave in any park
any paper, rubbish = waste, or refuse of any kind,
whether or not the same is offensive to the senses or
is injurious to health, except in the receptacles
therein provided for such paper, rubbish, waste and
refuse.
Section 7.
No person shall post, paste, fasten, paint or affix
any placard, bill, notice or sign upon any structure,
tree, stone, fence, thing or enclosu~ealong, or
within any park without the written authorization of
the Board.
Section 8.
Any person, firm, group or organization who shall
distribute or display any circulars, cards, announce-
ments or other items, either printed or otherwise, shall
cause the same to be distributed in an orderly manner.
Further, that any such of the aforesaid items shall
not be allowed to litter any of the park property.
Any person, firm, group or organization who so distributes
any of the aforesaid items shall be responsible to
clean the park property of such distributions.
Sect ion 9 ·
No person shall at any time, set, lay, prepare, or
have in possession any trap, snare, artifical light,
net, bird line, or any:~¢ontrivance whatever, for the
purpose of catching, taking, injuring or killing any
bird or wild animal in any park, except unless the
park superintendent authorizes the same.
Section 10. No person shall play golf, tennis or other ball games
upon or within any park, or parkway, except upon
ball, tennis or appropriate athletic grounds or golf
links established by the Board. This section shall not
prohibit persons from playing catch with a ball or other
object customarily used for that purpose so long as
that activity does not unreasonably interfere with
the use of the park by other persons.
Section 11. No person shall move benches, seats and tables from
their places in any park or parkway. Tables and
benches placed in picnic areas for picnics may be
shifted in the picnic area within any single
park for use.
Section 12. No male, except for Board personnel in connection
with their duties of Park maintenance, shall enter a
toilet room set apart for females; no female, except
for Board personnel in connection with their duties
of Park maintenance, shall enter a toilet room set
apart for males.
Section 13. No person shall sell or offer for sate any article
or thing whatsoever in any park or parkway, but this
prohibition shall not apply to sales of refreshments
and other articles by the Board or under its direction.
Section l~. No person shall be permitted to take any pet into
any park unless it is led by a suitable leash, and
in no case shall any person allow or bring any dog
owned or attended by him upon any bathing beach or
into any park waters, or upon any skating rink, or in
any park building whether the dog is leashed or
otherwise, unless so authorized in writing by the
Park ~perintendent.
Section 15. No person or persons shall do, or engage in any of
the following acts within skating rinks on ice in the
parks or parkways, except in the course of winter
sports organized events held under the supervision
of the bard or its Recreation Department, viz:
Racing, playing of any games which interfere with the
general use of the skating rink and the use of sle~,
tobaggons, hockey sticks and pucks and loitering on the
ice or in waiting rooms. This section shall not be
construed to prohibit the use of hockey sticks and
pucks upon rinks designated or constructed as hockey
rinks by the Board or its Recreation Department.
Section 16. No entertainment or exhibitions shall be given in
any park or parkway excepting the entertainments given
under the direction or by authority of the Board.
Section 17. No public meeting of any kind shall be held in any
park or parkway, playground or athletic field, nor
shall there be any public speaking therein, without
a written permit granted therefor by the Board.
SeCtion 18. No person shall start any fire in any park or upon
any park property, except that small fires may be made
by picnic parties in the park designated by the Board,
but only in the places in said parks provided for
the purpose by the Superintendent of Parks. Every
person who starts any such fire and every person using
such fire is ~hereby charged with the duty of
completely extinguishing such fires or fire before
leaving such park. Nothing herein shall be construed
to limit or restrict the enforcement of Columbia
Heights Ordinance #723 or any amending ordinances
regulating air pollution control and setting ambient
air quality standards.
Section 19. Any person who in a park persist~tly interferes with
the orderly conduct of games or play by the participants
therein~ shall be guilty of disorderly conduct and
upon conviction shall be punished as for that offense.

Section 20. No person shall fish in any lake other than those
authorized to be open for fishing by th~ Board and
approved by the State Department of Natural Resources.
Section 21. No person shall cut any hole in the ic~ of the city
lakes larger than ten inches in diameter.
Section 22. It shall be unlawful to have any fires on the ice of
any lake under the jurisdiction of the Board provided~.
however, that manufactured heaters burning liquid
fuel may be used i~ a written permit for such
use is granted by the Superintendent of Parks.
Section 23. Traffic Regulations Within Parks:
(a) Definitions. The following words and terms,
wherever they occur in this ordinance are defined
as follows:
(1) (A) The word "vehicle" includes every device
in, upon or by which any person or property is or
may be transported or drawn upon a highway except
devices moved by human power or used exclusively
upon stationery rails or tracks. Further,
"vehicle" means any go carts, mini-bikes, snow-
mobiles, recreational vehicle or self-propelled
instrument which carries or may carry an occupant
or occupants upon land or water.
(1) (B) No vehicle is permitted on any footwalk,
lawn, or any other grounds on parks or parkways
not designated for traffic or parking purposes.
(2) The word "driver" includes every person who
drives or is in actual physical control of a
vehicle.
(3) The words "Parkway" or "drive" includes every
way or place under jurisdiction of the Board which
is open to the use of the public for purposes of
vehicular t~ffic.
(b) Pedestrians when using a parkway shall not carelessly
or mali. ci. ously interfere with pass~ge of vehicles.
(c) No driver of any vehicle shall tow or push any
tobaggon, sled, ice skater, bicycle or any other
sli. ding or coasting device, nor permit any person
to board or alight from nor hang onto said veh~[cle
when said vehicle is in motion.
(d) No vehicle of any kind shall be permitted to
drive across or on park lands except on roadways,
except such vehicles and machines asoperated by
the Park Board of Columbia Heights. Nothing
herein shall be construed to prohibit the use of
snowmobiles in any area of a park so designated
by resolution or ordinance by the Columbia
Heights City Council .
(e) No vehicle of any kind shall be permitted on the
ice of City lakes or flooded skating or hockey
rinks, except such vehicles and machines operated
by the Board for the purpose of maintaining
skating rinks and performing necessary work on
said ice, and provided that the City Council of
Columbia Heights may, by resolution or ordinance,
authorize the use of a certain portion of any
such lake for ice racing or snowmobiling.
(f) No person shall wash, grease, or repair any
vehicle on any park, boulevard, or parkway,
except perform such repairs as are necessary by art
emergency.
(g) No person shall ride or propel any bicycle upon
any sidewalk in such a manner as to interfere with
any pedestrian thereon.
(h) Any unoccupied vehicle~ found in violation of the
provisions of this ordinance may be immediately
removed and impounded by any police- officer or
duIy authorized person in accordance with the
ordinances of the City of Columbia Heights.
Section 24. Boats and boating within parks.
(a) No person shall be or remain in boats or otherwise
upon the lakes or any other water controlled by
the Board between the hours of ten o'clock p.,m.
and six-thirty a.m.
(b) No person shal! navigate, direct or handle any
boat in such manner as to annoy, unnecessarily
frighten, or endanger the occupants of other
boats.
Section 25. Swimming and bathing beaches within parks.
(a) No person shall bathe in or enter the water of
any park or parkway except at bathing places
designated by the Board. No person shall ride,
drive, or send any animal into the waters of any
park or parkway without written authorization
by the Board.

(b) No person sh'all expose himself or herself to
public view in any park or parkway or on any
lake unless~ properly clothed. Swimming attire
constitutes proper clothing wi. thin the meaning
of this ordinance.
Section 26. The Park Board of Columbia Heights shalt have the
authority to revoke for good cause, any permit issued
either by the Board or the Superintendent, but
(except upon conv~ction by Court) the person whose
permit is subject to be revoked, stzall have at
least five day's notice thereof in writing and an
opportunity to appear before the Park Board
or a committee thereof, to show cause why thi, s permit
should not be revoked.
Section 27. The provisions of this ordinance shall not prevent
the agents, servants and employees of the Board from
doing those things which are necessary to the
performance of their duties.
Section 28. The Board may authorize the issuance of permits
which may permit the holders thereof~to ia) remain
in the parks or on the parkways, lake~ or waterways
during otherwise prohibited hours; (b) post notices;
lc) park vehicle~ in otherwise unauthorized areas;
(d) aquaplane or water ski in otherwise prohibited
areas; (e) di, stri. bute circulars or card~ pursuant to
section eight (8) herein; (f) sell refreshments or
articles pursuant to section thirteen (13) herein;
[g) bring a dog i:nto the park notwithstanding the
provisions of secti~ons fourteen [14) and t,~enty-five
(25) herein for th.e purpose of conducting dog shows,
exhibitions or the like held under the direction of
the Board; ih) conduct shows of entertainment or
exhibition~ pursuant to section sixteen [16) herein;
(:~) conduct public meetings or public speeches
pursuant to section seventeen (17) herein upon a
showing to the Board that the health and safety of
those in attendance will be properly safe guarded; (j)
have fibres on the ice of any lake under the
jurisdiction of the Board notwithstanding the
provisions, of section twenty-two [22) herein upon
showi~ng of compl lance with regulations establ i. shed
by the Board for the safety of said heaters.
Section 29. If any provision or provisions of th~s ordinance are
declared unconstitutional by a competent court, the
said decision shall not affect any other part or
portion of this ordinance.

Section 30. Violation and Penalties. Every person who violates
any of the prov~si, ons of this ordinance is guilty of
a m~sdemeanor and shall be punished by a fine of not
more than Three Hundred Dollars [$300.00) or by
imprisonment for not more than Ninety (90) days, or
both.
Section 31. Effective Date. This ordinance shall take effect and
be in force from and after thirty [30) days after its
passage and publication.
