HomeMy WebLinkAboutOrdinance 744ORDINANCE NO, 7~ BEING AN ORDINANCE PROHIBITING TItE SALE OF CERTAIN NON-RETURNABLE OR DISPOSAL BEVERAGE CONTAINERS. THE CITY COUNCIL OF THE CITY OF coLuMBIA HEIGHTS DOES ORDAIN: Section~l. Within the City of Columbia Heights no beverage shall be sold or offered for sale in non-returnable or disposable containers. S'ectlon 2. For the purposes of this ordinance, the following terms, phrases and words, and their derivations shall have the meanings given herein: "Beverage" shall mean: Non-alcoholic beverage; any mineral waters, soda waters or any other carbonated or uncarbonated beverage not containing alcohol that is commonly known as a soft drink[ "~ Alcoholic beverage; any beer, ale, or other malt beverage containing½ of 1 per centum or more of alcohol by volume. (c) "Container" shall mean any device or material used for the purpose of holding or containing beve.r'ages as defined herein. "Non-returnable'~or disposable beverage container" shall mean any container the title to which the seller intencI~ to pass with the sale of the contents, or which iS not suitab]e or is not intended for reuse. "Sale" shall mean a commercial transaction by any person, firm, individual, cgrporatlon, partnership or other vendor whereby, beverages are exchanged for a consideration. Section 3. Any firm, individual, corporation, partnership, or other vendor selling beverages within the City of Coiumbla Heights found guilty of violating any provision of this ordinance sha]! punished by a fine not to exceed $300.00 or by imprisonment for a period not to exceed nlnety days, or,both. Each days violation of the provisions of this ordinance shall constitute a separate offense. Section /t.. This ordinance shall become effective January I, 1972. Section Should any section, subdivision, clause, or other provision of this ordinance be declared by a Court of competent jurisdiction to be invalid, such decision shall not effect the validity of the ordinance as a whole nor any part thereof other than the part so declare~i to be inval id.
