BE~IO A~ ORDINANCE LICENSING TRAILE.~R A~O TRUCK RENTALS
THE CITY OF COLUMBIA HEIGHTS DOES ORDAIn:
Section 1.
That no person, firm, or corporation shall engage in the business of
leasing or renting trailers or trucks without first obtaining a license
to engage in such business as provided in this ordinance.
Section 2. A trailer is herein defined as: One attached to or to~ed by an
automobile.
A truck is herein defined as: A single unit vehicle with no more
than two ~xles.
Section 3.
Application for a license to operate a trailer rental and a truck
rental or any combLuation of trailer and truck rentals shall be made
upon the form provided by the City Clerk.
Section 4.
With the application, the applicant shall submit a plot plan showing
the location of the rental area and further identify where the trailers
and/or trucks shall be placed upon the property.
Section 5.
The plot plan shall designate the number, size, and types of trucks
and trailers to be par~ed on the propert~r, and shall be ~oproved by
the City Council prior to the issuance of any license.
Section 6.
That screening shall be required whenever a trailer and/or truck
rental operation is adjacent to any~elling unit. The City Council
may require screening in business districts.
Section 7. That the storage of all accessories to a truck rental and/or trailer
rental shall be indicated in the plot plan submitted to the City Council.
~$ection 8.
That all sorface areas that will store trailers and/or trucks shall
be a hard surface; either bituminous or a cement surface; exceDt
that any existing opera,om shall be deemed to meet the requirement
hereunder.
Section 9.
All license requests must first be presented to the Planning and Zoning
Commission with the plot plan and such other information as the
Planning and Zoning Commission may require for its recommendation
tothe City Council. Within thirty (30) days, the favorable or
unfavorable recommendation of the Plauning and Zoning Commission
shall be presented to the City Council for action by the City Council.
Section 10. If the Planning and Zoning Commission determines that a public hearing
shall be required, the Planning and Zoning Commission may require such public
hearing.
Section ll. That the~ea designated for parking of trucks and trailers should be
in addition to that space needed for the regular operations of the
business conducted upon the property.
Section 12. The fee for such license as issued for a trailer and/or truckr ental
shall beat by resolution by the City Council inthe City of
Columbia Heights annually.
Section 13. That when the City Council determines that the health ~ud welfare of
the City of Columbia Heights will not be adversely affected, the City
Council mWff waive any section of this ordinance.
Section l~. Should any section, subdivision~ clause, or other provision of this
ordinanc~ be declared bya Court of competent jurisdiction to be
invalid, such decision shall not affect the validity of the ordinance
as a whole nor any part thereof other than the part so declared to be
invalid.
Section l~. Any p ers~n, firm, or corporation violating this ordinance shall be
guilty of a misdemeanor and upon conviction shall be punished by a
fine not to e~eed $300.00 or by imprisonment for a period not to
exceed ninet~ (90) days, or both.
Section 16. This ordinance shall take effect and be in full force from and after
thirty (~0) days after its passage.
