AN ORDINANCE REGULATING THE PURCHASE, CONSUMPTION,
POSSESSION OF ALCOHOLIC BEVERAGES AND IMPOSING A PENALTY
FOR THE VIOLATION THEREOF.
THE CITY OF COLUMBIA HEIGHTS DOES ORDAIN:
Section 1.
Definitions: For the purposes of this Ordinance,
the following definitions will apply:
l. The term "alcoholic beverage" shall mean and include
ethyl alcohol and any distilled, fermented, spirituous,
and vinous beverages containing in excess of 3.2 per
cent of alcohol by weight as well as any malt
beverages with an alcoholic content of more than
one-half of one pe~ cent by volume.
2. The term "mino~" shall mean and include any
person who has not attained the age of 2l years.
3. The term "licensee" shall mean and include any
'person having a license for the retail sale of
alcoholic beverages and any municipal liquor store.
Section 2.
Violations: It shall be unlawful for any:
1. Licensee or his employee to sell or serve
any alcoholic beverage to a minor or to permit a
minor to consume any at~oho]ic beverage.
2. Person to procure any alcoholic beverage for
a minor.
3. Person to induce a minor to purchase or procure
any alcoholic beverage.
4. Minor to enter any premises licensed for the
retail sale of alcoholic beverage or any municipal
liquor store for the purpose of purchasing or having
served or delivered to him or her any glcoholic
beverage.
5. A minor to misrepresent his age for the purpose
of obtaining any alcoholic beverage.
6. A minor to purchase or attempt to purchase any
alcoholic beverage.
7. A minor to have in his possession any alcoholic
beverage with intent to consume same. Possession
of any alcoholic beverage at a place other than the
household of his parent or gaurdian will be prima
facie evidence of his intent to consume same.
8. A minor to consume any alcoholic beverage.
9. A minor to sell any alcoholic beverage.

Penalty. Any violator of this Ordinance within the
City of Columbia Heights will be guilty of a
misdemeanor and shall be punished by a fine not to
exceed Three Hundred Dollare ($300) or by imprisonment
for a period not to exceed ninety (90) days, or both.
Should any section, subdivision, clause or other
provision of this ordinance be declared by a Court
of competent jurisdiction to be invalid, such
decision shall not effect the validity of the
ordinance as a whole, nor any part thereof other
than the part so declared to be invalid.
Time~.of taking effect. This Ordinance shall take
effect and be in force from and after thirty (30)
days after its passage.
