HomeMy WebLinkAboutOrdinance 727ORDINANCE NO o 727 BEING AN ORDINANCE FOR THE PURPOSE OF PROMOTING HEALTH, SAFETY, ORDER, CONVENZENCE AND GENERAL WELFARE BY PROVIDING FOR THE ESTABLISHMENT OF FIRE LANES. THE CITY OF COLUMBIA HEIGHTS DOES ORDAIN: Section 1. The Chief of the Bureau of Fire Prevention is hereby empowered to establish fire lanes in accordance v~th the terms of this Ordinance. No such fire lanes shall be established unless the Fire Prevention Chief deems it necessary to prevent interference with travel of fire equipment, to provide access to fire hydrants, or to provide acess to buildings in the event of fire. Once such fire lane is established it shall be clearly marked by a sign or signs bearing the words "NO PARKING -- FIltE LANE"~ or words of a similar meaning° The Fire Prevention Chief shall establish such fire lanes by a written order directed to the City Manager describing the location to be so designated, stating the reasons therefor and setting forth the of signs required. When such lane is established on any public property, the City of Columbia Heights shall provide the necessary signs° Section 2o The Fire Prevention Chief may ateo establish such fire lanes on private property either upon the request or with the consent of the land owner° Such consent or request shall be in writing, shall contain an acknowledgement that the land owner shall bear the expense for the necessary signs, and shall be submitted tot he City Manager together with the aforementioned written order of the Fire Prevention Chief° Section 3. Section 4. The City Manager shall cause the necessary signs to be installed within 50 days after receipt of the order° Once an area has been designate8 as a fire lane by the required signs, no person shall park a vehicle or otherwise occupy or obstruct such area. Section 5. Should any section~ subdivision, clause or other provision of this ordinance be declared by a Court of Competent Jurisdiction to be invalid, such decision shall not effect the validity of the ordinance as a whole nor any part thereof other than the part so declared to be invalid. Section 6. Any person violating this ordinance sha!], be guilty of a misdemeanor and upon conviction shall be punished by a fine not to exceed $300.00 or by imprisonment for a period not to exceed 90 days, or both. Section 7. This ordinance shall take effect and be in full £orce from and after thirty (30) days after its passage.
