HomeMy WebLinkAboutOrdinance 463ORDINANCE NO. 263- BEING AN 0RDIN~NCE REGULATING THE USE OF HIG~U~¥AYS WITHIN THE CITY OF COLU~BIA HEIGHTS, INCORPOR~TING THE PROVISIONS OF THE STATE HIGHWAY REGUL~TION ACT BY HEFERENCE, AND IMPOSING A PEN- ALTY FOR THE VIOLATION THEREOF. THE CITY COUNCIL 0F THE CITY 0F COLLR~IA HEIGHTS DOES ORDAIN: Section 1.. Highway Traffic Regulation Act Incorporated by Reference. The Regulatory. provisions of the State of Minnesota Statutes of 1953, Chapter 169 as amended by the Laws of 1955, 1957 and 1959, are hereby adopted as a Traffic Ordinance regulating the use of Highways, streets and alleys within the City of Columbia Heights are hereby incorporated in and made a part of this Ordinance as completely as if Set out here in full. Section 2. Through Streets. The City Council may upon advice of the Chief of Police and City Engineer designate any street as a through street in any intersection as a stop intersection where it is necessary to preserve the free flow of traffic to prevent accidents. They shall have the duty to post appropriate signs at the entrance to such streets or intersections; but no trunk highway shall be designated as a through street and no intersection on a Trunk Highway shall be designated as a stop intersection unless the con- sent of the Commissioner of Highway to such designation is first msecured. Every driver of a vehicle shall bring his vehicle to a full stop before entering any stop street or any intersection propeuly designated and posted as such by the Commissioner of Highways or the City Council as hereinbefore set forth. Section 3-. One. Way. Street. The City Council may upon recommendation of the Chief of Police and City Engineer designate any street or thoroughfare within the said City as a one-way street where such a designation is ~ecessary 'to preserve the free flow of traffic and to prevent accidents; and the said Council shall have the duty to pos~ appropriate signs at the entrance of such streets or intersections; but no trunk highway shall be designated as ~one-way street unless consent of the Commissioner of Highways to such designation is first secured, Section ~. Truck Routes. The City Council may upon recommemdation of the Chief of Police and City Engineer designate certain streets and throughfa~'es in the City of Columbia Heights as Truck routes and shall have the duty to post appropriate signs designating such streets and thoroughfares as such.dSuCh~d&~i~- nation shall be made only when it is necessary to preserve free flow o~ traffic and to prevent accidents, Section ~.. Penmlt~, A~y violation of the Statute adopted by~eference in Section 1 is a violation of this Ordinance when it occurs within the City of Columbia Heights. Any person thus violating any provision of this Ordinance shall be ~uilty cf a misdemeanor and Shall be punished by a fine not to exceed $100.00 or by imp~isomment in the City jail for a period of not to exceed 90 days; but if a minimum fine or imprisonment is prescribed by the State Highway Traffic Act for an offense such penalty shall be applied to'the person afflicted of the s~me offense of this ordinance.
