AN ORDINANCE REGULATING EXCAVATIONS IN ANY STREET
OR ALLEY IN THE CITY OF COLUNBIA HEIGHTS, NI~ESOTA,
PROVIDING FOR PEP~ITS AND FEES FOR THE S~E AND PRO-
VIDING PENALTIES FOR THE VIOLATION THEREOF.
THE CITY OF COLd, IA HEIGHTS DOES ORDAIN AS FOLLOW'S:
Section 1. No person, firm or corporation shall make an excavation within
auy street or alley in the City of Columbia Heights for the purpose of installing
water, sewer~ steam, or gas pipes, or electric or telephone conduits, or for any
other purpose, without first obtaining a permit for such excavation from the
Clerk of the City of Col~mbia Heights~ however, such permit shall not be re-
quired for any such excavation which is made under a contract awarded by the
City of Columbia Heights, or made by workmen wor~ug for the City of Columbia
Heights.
Section 2. Application for permits shall be made in ~riting on forms
provided for that purpose by the Clerk. Said form shall set forth the per-
tinent regulations applicable to said permit, as prepared from time to time
by the Engineer of said City of Columbia Heights, ~ud so modified~b.y said
Engineer with respect to the particular work covered by the permit. Said
Engineer shall prepare such regulations with respect to excavations within
any street or alley, and shall modify them with respect to particular work,
as shall be necessary or advisable to protect the public from injury, to
prevent d~mage to public or private property, and to minimize interference
with the public use of the streets.
Section 3. Permits for excavations .shall be issued in writing and the
permit shall be kept on the site of the work while it is in progress in the
custody of the individual in charge, and shall be e~d~ibited upon. request
made by any Ci.ty of Columbia Heights official or police officer.
Section 2. Before a p .e~mit is issued, the applicant requesting the
permit shall pay a fee of $2.00 to the City Clerk of the City of Columbia
Heights for each location covered by the permit. Each transverse water
and/Or sew~er connection~ other transverse excavations and each 300 feet or
portion thereof of longitudinal excavation shall be deemed a location,
Section 5. V~ork shall progress in an expeditious .manner until completion,~
in order to avoid unnecessary inconvenience to traffic. In the event that the
work shall not be performed in accordance with the applicable regulations or shall
cease or be abandoned without due cause, the City of Columbia Heights may, after
six hours notice in writing to the holder of said permit of intent to do so, correct
said work or fill the excavation, and repair the street or ~lley, and in any event
the entire cost to the City of Columbia Heights of such work shall be a liability
of and, shall be paid by the person~ firm or corporation to whom the permit was
issued.
Section 6. A Performance bond in the amount of Two Thousand Dollars
($2,000°00) shall be required from each person, firm or corporation requesting
a permit except a duly licensed and bonded plumber~ or a recognized public
utility corporation regularily serving the City of Columbia Heights; said
bond to be conditioned that the holder will perform said work in accordance with the
applicable regulations, will indemnify and save harmless the City of Columbia
Heights from all damage caused in the execution of such work or costs in
connection with the repair of the streets or alleys 'excavated, and that the
holder will pay any and all damages that w~l be suffered by the City of
Columbia Heights by reason of the failure of the person, firm or corporation
securing the permit to observe the terms of this ordinance or by reason of
negligence in th® execution of the work.
Section 7. The provisions of this ordinance are not in lieu ~of, but
in addition to .all utility' connection permits that may be required by ordinance,
or by the rules, and regulations of the City of Columbia Heights.
Section 8. Any person~ firm or corporation violating the provisions of the
ordinance shall be deemed guilty of.a misdemeanor and punished by a fine of not
more than One Hundred Dollars ($100.00) or by imprisonment for not more than
ninety (90) days.
Section 9. This ordinance sh~ll take effect and be in force from ~ud
after thirty (30) days after its passage.
