ORDINANCE NO.16 A~ ~, RELATING TO THE
CUEFEW. SIGNAL, DEFINING THE HOD~%S IT SHALL BE
UNLAWFUL FOR ANY JUVENILE TO BE ON OR PRESENT
IN ANY PUBLIC STREET OR AT.LEY OR ANY PUBLIO
PLACE, AND PROVIDING FOR THE PENALTY FOR T~
VIOLATION THEREOF.'
Ordinance No. 16 and No.16 as amended
SECTION 1. It shall be unlawful for any person under the age of 14
years to be on or present in an~ public street, avenue, alley, or park
or other public place in the City of ~olumbia Heights, between the hours
of 9~30 P.M. and 5=~.A.M. of the following day, official city time, unless
accompanied by his 6r her parent- or guardi~, or person ~aving lawful custody
and control of his ~r her person, or n~less there exists a reasonable nec-
essity therefore. The fact that said child, unaccompanied by parents,
guardian or other person having legal custody is found upon any street, alley,
or public place after 9:30 P~N. or before 5~00 A.M. of the following day,
shall be prima facia evidenCe that said child ~ there ~awf,,~y and that
no r~asonable excuse exists therefore.
SECTION 2. It shall be unlawful for any person under the age of 18
years and over the age of 14 years to loiter, loaf, or idle on or about
any public street, avenue, alley, Park or other place in the City of
Col~bia Heights between the hour's of 9,30 P.M. and 5~00 A.M. of the
following day.
SECTION 3. It shall be unlawful for any parents, guardian, or other
person having the lawful care, custody~ or control of any person under
the age of 18 years to allow or permit such person to violate the provisions
of Section 1 and 2.
SECT/DN 4. It Shall be unlawfu!~ for any person, firm or corporation
in charge of any place of amusement' entertainment, or refreshment, or other
place of business to knowingly and w~y condone or permit any minor
under the age of 18 years to loiter, 10al, or idle in such place during
the hours profibited by this OrdinanCe.
This Ordinance s~all not be construed as permitting the presence at
any time o~ any person under the age of 18 years in any pla~e where his
presence is now prohibited by any eXisting law or Ordinance.
Whenever the owner or person 'in charg~ or in control of any place of
amusement, entertainment, refreshment, or other place of business shall
find persons under the age of 18 years loitering, loafing, or idling in
such place of business, he shall immediately order such persons to leave
and if such person refuses to leave the said place of business, the oDerator
shall i~nediately notify the Police Department and inform them of the
violation.
SECTION 5. Any member of the Pblice Force is authorized to arrest
with or without warrant, any perso~ or persons violating the provisions of
Section 1,2,3, and 4 of this Ordinance, and any child unaccompanied by
parent, guardian, or other .adult person having the lawful care and custody
of said minor cbt~d.
'SECTION 6. Any person violating any of the provisions of this Ordinance
shall, upon conviction, be punished by a fine not exceeding one hundred
dollars or by imprisonment in the workhouse of said County for a period not
exceeding ninety days.
SECTION 7. This Ordinance shall be in force and effect from and
after thirty days after its passage.
