'~ecretary to the Council ORDINANCE NO.~ AN ORDINANCE PROVIDIS~ FOR THE ISSUANCE OF $200,000 OF BONDS FOR CREATING AND NAIR~fAINING THE CITY'S PERB~A~ENT II~PROVENEI~ REVOLVING FUND THE COUNCIL OF COLUNBIA HEIGHTS DOES ORDAIN: Section 1. It is necessary and expedient for the City of Columbia Heights to borrow the sum of $200,000 by issuing and selling its negotiable coupon general obligation bonds in that amount and using the proceeds thereof to create and maintain the City's Permanent Improvement Revolv- ing Fund, and thereby to provide funds for improvements of a lasting character, including installation of paving~ curbs, gutters~ storm sewers, and water-line and sewer-line extensions~ and, subject to the referendum powers of the people~ said bonds shall be issued~ sold, and delivered as soon as may be after this ordinance takes effect, such bonds to bear date of issue, dates of serial mattu~ities~ and be in such form and details, as shall be prescribed by resolution of the City Council~ and shall bear in- terest at the lowest rate or average rate obtainable upon a public sale thereof. Section 2. Said bonds shall be the general obligations of the City and secured by a pledge of the full faith and credit and unlimited taxing powers of the City, but the City shall annually eliminate or reduce the tax levies needed for such purpose by the imposition~ collection~ and appropriation of special assessments on properties benefited by the im- provements made with such moneys, as hereafter to be ordered and prescribed. Section 3. This ordinance shall take effect thirty days after its passage. Cal,~_~i~ ~eights, Ninne~ta Extract of Minutes of Meeting o£ City Council Columbia Heights, Minnesota Jul~ 28 1953 Pursuant to due call and notice thereof~ a regular meeting of the City Council of Columbia Heights, Minnesota, was duly held at the City offices in said City on Tuesday, July 28, 1953, at 8:00 o'clock The foll~ing members were present: Knutson and Stopka Holm, Hosch, Deeble, and the following were absent: The City Manager reported that Ordinance No. 311 had been signed by the Mayor and filed with the Secretary of the Council within two days thereafter~ and recorded and preserved, and h~d been published in the June 18 issue of the official newspaper, and that said ordinance was now in full force and effect. Councilman Deeble introduced the following resolution and moved its adoption, which resolution w~s thereupon read in full in words and figures as follows: RESOLD~ION PROVIDING FOR PUBLIC SALE OF PERMAENT IMPROVEMENT REVOLVINGFUNDBONDS BE IT RESOLVED by the City Council of the City of Columbia Heights, Minnesota~ as follows: 1. This Council sh~ll meet at the time and place and for the purpose specified in the form of notice of bond sale herei~fter set forth, and to take such further action in respectto the bonds therein described as shall then be found desirable or expedient. 2. The City Manager is hereby authorized and directed to give notice of the time, place~ and purpose of said meeting by causing notice thereof to be published in one issue of the Columbia Heights Record and in one issue of Commercial West~ a financial peridical published at Minneapolis~ Minne- sota~ each of such publications to be at least ten days prior to the date of said meeting~ and which notice shall be substantially as follows: -1- NOTICE OF S~.w. OF $200,000 PERMANENT IMPROVEMENT REVOLVING FUND BONDS CITY OF COLUMB~ HEIGHTS, MINNESOTA NOTICE IS HEREBY GIVEN that the City Council of the City of Colum- bia Heights, Minnesota, will meet at the City offices, at 530 Northeast Mill Street, in said City, on _Th.ur. sday , the ~ day of August, 1953, at 8:00 o'clock P. M., to receive, open, a~d consider bids f~r the purchase of $200,000 general obligation Permanent Improvement Revolving Fund Bonds of the City to be issued to provide funds for improvements of a lasting cb8~racter, including installation of P~wement, curbs, gutters, storm sewers, and water line and sewer line extensions. The bonds will be dated as of August l, 1953, and in denomination of $1000 each, and will bear interest, at a rate or rates specified by the successful bidder, payable February l, 1954, and semiannually thereafter on each February i and August 1. Principal and interest will be made payable at anv suitable banking institution in the United States designated by the successful bidder,the City agreeing to pay the reasonable and customary charges of such institution for the receipt and disbursement of the princi- pal and interest moneys. Said bonds will be numbered serially fr~m i to 200, inclusive, and will mature serially, in the amount of $20,000 on August i in each of the years 1955 through 1964, all without option of prior payment. The City will furnish, witRout cost to the purchaser, the printed and executed bonds and the unqualified approving legal opinion of Dorsey, Co/man, Barker, Scott & Barber, Minneapolis, Minnesota, together with the cust~ no-litigation certificate, and delivery thereof will be made within forty days after ac- ceptance of bid. Such delivery will be made in Minneapolis or St. Paul, Minnes~ota, or Chicago, Illinois, without cost to the purchaser; delivery elsewhere to be at the purchaser's expense. Each bid must be unconditional except as to the bonds being issued and delivered with said opinion and certificate in con- formity with this notice, and'each bid must be accompanied by a certified check or cashier~'s check payable to the order of "The City T~easurer of Co_lumbia Heig..hts, Minnesota", drawn on a responsible bank , in the amount or at least ~4000, to be forfeited as liquidated damages in case the bid is acce~ted and the bidder shall fail to comply therewith. Bidders must specify the desired interest rate, or not to exceed three rates, each in an integral multiple of 1/4 or 1/10 of one per cent per annum, the rate to be uniform for all bonds of a common maturity. The bid offering the lowest net interest cost (total interest to maturity, less an~ premium offered) will be deemed the most favorable. No oral bids or any bid of less than par and accrued interest from August 1, 1953, to the date of delivery will be considered.
