T?~NSPORT, SELL, AND DISTRIBUTE GAS FOR HEATING, ILLUMINATING MND OTHER PURPOSE$ IN THE CITY OF COLUMBIA HEIGHTS, AND TO USE TT-~ STREETS, AVENUES, AND ALLEYS ~REOF ~DR THAT PURPOSE. T~ CITY OF COLU~BIA HEIGHTS DOES ORDAIN: SECTION 1. That Section ~ of the ordinance entitle~: "AN ORDINANCE GRANTING TO MINNEAPOLIS GAS LIGHT COMPANY, ITS SUCCESSORS A~ ASSIGNS, T~fE RIGHT TO ~ANU~CTURE, I~PORT, TRANSPORT, SELL, AND DISTRIBUTE GAS ~OR F~ATING, ILLU- MINATING AND OTHEE PURPOSES IN THE CITY OF COLUMBIA HEIGHTS, AND TO USE THE STY~ETS, AVENUES ~,~D A~EYS TH..E~E~OF FOR TH&T PURPOSE," being an ordinance adopted May 27, 19~7, is hereby amended to read as follows: "Section ~. STANDARDS OF SERVICE. The Company shall at all times provide and furnish an adequate, safe and continuous supply of gas to ~e city and its inhabitants, subject, however, to the further provisions of this section. The Company sells and distri- butes straight natural gas throughout its entire gas distribution system, v~ich is located in the City of ~inneapolis, Minnesota, and in a number of suburban communities and in the territory adjacent to and near the said city. The natural gas distributed by the Company is furnished by the pipe line system o~med and operated by Northern Natural Gas Company, a "natural gas company" under the Federal Natural Gas Act, which subjects said Northern Natural Gas Company to the jurisdiction of the Federal Power Commission. "The Company shall not be liable to the City or its inhabi- tants, nor shall the City, or any inhabitant vho is a customer of ~he Company, be liable to the Company hereunder by reason of the failure of the Company to deliver, or of the City or a customer to receive, natural gas as a result of acts of God, or the public enemy, inability of pipe line supplier to furnish an adequate supply due to an emergency, an order or decision of a public regulatory body, or ot~r acts beyond the control of the party affected, "~henever any oi' the occurrences named above take place, the Company shall have the right and authority and it shall be its duty to adopt reasonable rules and regulations in connection with limiting, curtailing or allocating extensions of service or supplying of gas to any customer or prospective customer, and withholding the supplying o~' gas to new customers, provided that such rules and regulations shall be uni£'orm as applied to each class of customers, and shall be nondiscriminatory as between c ommun it ie s. "The Company shall have the right to contract £'or the sale o±~ gas for industrial use on an interruptible basis, requiring the customer to have standby eqz~pment for use upon notice by the Company. The Company's r~les, regulations, schedules or contracts for curtailing interruptib!e gas service shall be uni- form as applied to each class of interruptible customers. "If service is temporarily suspended because of any o~' the reasons set forth above, occurring through no fault or negligent act on the part oi' the Company, sucR suspension shall not be made the basis o~' any action or proceeding to terminate this franchise. The qualiltY cz' the gas sold in the City shall be the .same as that sold to the Company's customers in the City of ~inneapolis.,' SECTION 2. This ordinance shall take effect and be in force thirty (30) days after its passage. Passed this lSth day of November 19~1.
