Councilman ~~ thereupon offered the following preamble
to Ordinance No. /gJ~ . declaring an emergency and moved its adoption:
PREAMBLE TO ORDINANCE NO./~/
Whereas, an emergency exists for the prompt adoption of ~he assess-
ment rolls for Local Improvements Nos. 42, 44, 61, 62, 63, 64, 65, 66, 67,
68, 69, 70, and 71.
This Council hereby and under this preamble declares that an emer-
gency exists for the immediate preservation of the public peace and
safety and that Ordinance NS. /~l shall be enacted as an emergency
ordinance.
Adopted by the Council June 27th, 1939.

The motion to adopt said preamble was seconded by Councilman

This
being
the time and place set when and whe~e~gll persons in-
terested may appear and be heard by the Council with respect to benefits
and to the proportion of the cost of making the following Local Improve-
ments Nos. 42, 44, 6!, 62, 63, 64, 65, 66, 67~ 68, 69, 70 and 71, a notice
of such hearing having ~een heretofore duly published as required by law,
the City ~anagerts estimate of the' cost of such improvement together
with a llst of the several lots and parcels of land fronting upon and
ad. Jacent to such proposed improvements as deemed benefited thereby and
the names of the owners of the several parcels as nearly as'coul~ be
ascertained was laid before the Council and an opportunity was given
all persons interested to be heard with respect to benefits and the
proportion of the cost of the improvements to be assessed against their'
property. The Council thereupon procee6ed to carefully consider said
improvements, considered the benefits to the several lots or parcels
of land and the benefits accruina to each such lot or parcel of land from
the making of said improvements and the proportion of the cost thereof
to be assessed to each such lot or parcel of tan~,estimated and fixed
the cost of said improvements and levied such proportion of amount of
such cost upon benefited property in proportion as it deemed the same
benefited and prepared an assessment roll for each of said Improvements
which said assessment rolls are designated hereafter known bY their
respective numbers and described as "Assessment Roll for Local Improve-

ORDINANCE NO. ~!
An Ordinance adopting assessment rolls for Local
Improvements Nos. 42, 44, 6!, 62, 63, 64, 65, 66,
67, 68, 69, 70 and 71, determining to make said
improvements and ratifying and confirmin~ the
contracts for such work and ali other proceeding's
heretofore had.
Whereas, this City has heretofore let contracts for the construction
and making of Local Improvements No~. ~2, 44, 61, 62, 63, 64, 65,
67, 68, 69., 70 and 71, and the .City~Jis~.p'roc'e~dlng with'.sUC.hwork
a W. P. A. Project, and
Whereas, this Council has heretofore estimated and fixed the cost
of such local improvements and has prepared an assessment roll for each
of said improvement s.
The City of Columbia Heights does ordain:
Section t. That this Council does hereby adopt the~ aforesaid assess-
ment. rolls, known smd described as "AsseSsment Roll for Local Improve-
ment No. _ "as to each of said improvements.
Section 2. That this Council hereby finds and determines that each
of the lots or parcels of land enumerated in said assessment rolls was
and is specially benefited by such improvements in an amount not less
than the amount set opposite the description of each such lot or parcel
of land respectively in each of said assessment rolls in the column
headed "Amount of Assessment". And this Council further finds and de-
termines that the proper proportion of the cost of such 'improvements to
be specially assessed against each such lot or parcel of land is the
amount set oDposite the description of each such lot or parcel of land
respectively in each of said assessment rolls in said column headed
"Amount of Assessment".
Section 3. That said assessment ~otls be and the same are hereby
adopted as the assessment rolls for Local Improvements Nos. 42, 4~, ~1,
62, 63, 64, 65, 66, 67, 68, 69,70 and 71, and ttmt said assessment rolls:
shall be hereafter known and designated, as to each Improvement, as
"Assessment Roll for Local Improvement No. "
Section 4. That said assessments shall be payable in annual in-
stallments for a period of five years on the first day of June. in~ each
of the years from 1940 to 1944, inclusive, with interest and penalties
as provided by law.
Section 5. That this Council does hereby determine and redetermine
to proceed with said improvement, does ratify and confirm the contracts
let for the making of said improvements and all other proceedings here-
tofore had in that regard, and said improvements shall be hereafter
known and numbered as "Local Improvement No. __" as pertains to the
aforementioned numbers.

Section 8. This Ordinance shall take effect immediately upon its
passage.
