PREA~fELE TO ORDINANCE
WHALREAS: A recreational center hag been established in this
city, which has been under the direction of an unofficial Park
Baord pending the amending of the statute authorizing the estab-
lishment of a P~rk Board; and,
;'~qEREAS: It is necessary and desirable that an official Park
Board be immediately established in order that legal authority and
responsibility may be vested in those charged with the duty of dir-
ecting the operation of said recreational center, and other park
activities of this city; and,
WHERFAS: A further delay of more than thirty days will greatly
ha~per the Park Board in carrying out its program of improvement and
recreational activities in the city;
THIS COUNCIL HEREBY, and under this preamble declares that an
emergency exists for the immediate preservation of public peace and
safety, and that in order to pr. omptly meet such emergency, it is
necessary to pass Ordinance No. / as-an Emergency Ordinance.

AN ORDINANCE CREATING A PARK BOARD OF THE CITY 0F"
COL~,'~BIA HEIGHTS AND PROVIDING FOR THE ADMINISTRA~
TION 0F PARKS IN THE CITY OF COLDT~BIA HEIGHTS BY
SUCH PARK BOARD
THE CITY OF COLU~IBIA HEIGHTS DOES ORDAIN:
Section 1. Park Board Created. Pursuant' to the provisions
of ],gason,s }ginnesota Statutes, 19~7, ~Sections 1731 et seq. as amen-
ded, there is hereby established for the City of Columbia Heights
a park board to be known as "Columbia Heights Park Board"~
Section 2. Appoint~nent and Personnel. The said Coltlmbia
Heights Park Board shall c~nsist of five members, to be chosen by
the City Council for terms of one, two, t~ee, four and five years
r~spsctively~ all of whom shall be~ freeholders and residents of the
City of Co!u~ubia Heights and shall serve without compensation. Vac-
ancies created by termination of office, removal from the city,
resi~ation or otherwise shall also b~ filled by the City Council. ~
Section S. Park Board ]~ay Acquire and Hold Property. Said
Park Board shall be authorized ~nd empowered, for and on behalf~ of
and in the name of the City ~ Columbia Heights, to acquire by gift,
purchase, devise, condemnation or lease, as provided in the sections
held. and

exclusive control and supervision of all lands acquired by the City
for park p~poses, or for purposes of a golf course, and the exclusive
control and management of all recreational facilities now plac~d on lands
dedicated to park purposes, and of all recreational facilities which it
may hereafter place and establish on lands under its jurisdiction. Said
Park Board shall also provide for the improvement of all lands h$!d for
park purposes, or for purposes of a golf course, when in its dicretion
such improvements and necessary and desirable, by the planting and
preservation of t~ees, s~ubs and flowers, by enclosing, ornamenting
and protecting the same, and in s~ch other ways as may be
necessary to make such lands suitable for the use of a p~blic
park or golf course. It shall have power to buy', all materials
and supplies necessary to carry out 'the ~provisions of this or-
dinance, and to make m~ch reasonable rules and regulations for
the government and administraticn of the parks and golf courses
under its supervision and control as may be deemed necessary and
proper; provided however that no single expenditure of an amount
over Five Hundred ($800.00) Dollars shall be made unless author-
ized by a four-fifths (4/5) vote of the members of s~id board.
The said park board shall have exclusive power to employ such
help in and about such parks and golf conrses as may be deemed
necessary and proper, and to fix the compensation o£ any and~all
persons employed by it; to audit and allow all just claims for
labor, services, materials or supplies furnished by order of said
board, and endorse its approval of such claims when allowed, pro-
vided however that said Park Board shall not in any fiscal year
obligate ~he city for claims for labor, services, materials of
supplies f~rnished by order of said board in an amount greater
than the current income from recreactional activi'ties plus the
appropriation made for said fiscal year by the City Council For
park purposes nnless authorized by a resolution of the City
Council passed by a four-fifths (4/5) vote of said Council so to
do.
Section 5..R~eceipts to be Turned Over to City Treasurer.
All monies received by the Park Board or its employees in its admin-
istration of any of the properties under its jurisdiction shall by
turned over to the City Treasurer at intervals of not greater than
once each ~ek, and shall be placed b~:".~ai'd City Treasurer in the
Park Fund, and no monies placed i~ ~h~ Park Fund shall ;
be trhms-
fered to any other fund by the city Council. ~
Section 8. Annual Audit and Budget. The Park Board shall
keep such books and records of account as are necessary for a
proper recording of its financial activities. At the end of
each fiscal year it shall cause an audit of its account~ and
records to be made, which audit shall be submitted to the City
Council not later than its first regular meeting in February
following the fiscal year for which such audit is made. D~ring
the month of July of each year ~aid Park Board shall submit to
the City Council at a regular meeting thereof a proposed budget
showing its estimated financial requirements for the ensuing fiscal
year.
Section V. Pa~n,uent of Claims. Ail claims and all bills
incurred by the said Par. k Board when audited, allowed and endor-
sed as hereinbefore previded shall be presented to the City
Council for payment and paid in the same manner as other claims
against the City are paid.
Section 8. TTme of Taking Effect. This ordinance being
necessary for the immediate preservation of the public peace,
health and safety, is hereby declered to be an emer~_~iency or-
dinance and shall take effect immediately upon its passage.
