A~ ORDINANCE ESTABLISHING A C0~E~ISSION TO
PLAN FOR TKE PHYSICAL DEVELOP~,,~NT OF TKE CITY
OF COLUMBIA HEIGHTS AS AUTHORI~D BY LAWS OF
19S7, CHAPTER 267, AND TO RECOMI~]IfD A ZOI~ING
PLAN FOR ADOPTION UNDER L~WS OF 1929, CHAPTER
176, AS A~re~krDED.
TEE CITY COUNCIL OF THE CITY OF 00LU~IAHEIGHTS DOES ORDAIN:
Section 1. Establishment..of Qo~m%ssio~. A City Planning Commission for
the City of Columbia Heights is hereby established.
Section 2. ¢omoosition. Such Planning Commission shall consist of seven
members. Four members shall be appointed by the City Council and ma~ be
removed by a four-fifths vote of the Council; the City Engineer and the City
Attorney shall be members ex officio, and the Council shall select one member
of the Co~nission from among its own members..
Of the m&mbers of the Co~mission first appointed, one shall be appointed
for the term of one year, one for the term of two years, one for the term of
three years, and one for the te~n of four years. Their successors shall be
appointed for terms of four years. Both original and successive appointees shall
hold their offices until their successors are appointed and qualified. The terms
of ex officio members shall correspond to their respective official tenures.
Vacancies during the term shall be filled by the Council for the ~expired portion
of the term. Every appointed member shall before entering upon the discharge of
his duties take an oath that he will faithfully discharge the duties of his office.
All members shall serve without compensation.
Section ~. Or~anizat. i0nf. MeetinMs,_ Et~. The officers of the Commission shall
be a chairman, a secrets~y, and such other offices as the Commission n~ky determine.
The chairman shall be an elective member of the Co~mission with the shortest
expiration term of the office. The offices of secretary and any other office
cre~ted bM the Commission shall be filled by the Oon=nission from within or without
its own membership.
The Oonm~ission shall hold at least one regular meeting each month. It
shall adopt rules for the transaction of business and shall keep a record of its
resolutions,transactions, ~ud Findings, which record sluall be a public record.
On or before Jauuary first of each year the Commission sh~ll submit to the City
Council a report of its work during the preceding year. Exoenditures of the
Commission shall be within the amounts appropriated for the purpose by the City
Council.
Section 4. Adoptio~.pf Program of Work. Upon the appointment and organization
of the Commission, it shall proceed with the preparation and adoption by resolution
of a program of work, outlining activities proposed to be undertaken in the e×ercise
of its powers and the' performance of its duties. Such a program will include:
(a) Au outline of data and inform~tlon to be assembled as a basis for the
city plan;
(b) ~u outline of subjects to be covered by the city plan;
(c) Au outline of types of procedure necessary to m~ke the city plan
effective.
The Planning Con~ission m~y, by resolution, revise its program of work from
time to time.
Section ~. ~reoaration of City p!.~. It shall be the function and duty
of the Plsnning Commission to prepare and adopt a comprehensive city plan for
the physical development of the city, including proposed public buildings, street
arrangements and improvements, public utility services, parks, pl~vgrouuds,
and other similar developments, the use of property, the density of population,
and other matters relating to the physical development of the city. Such plan
may be prepared in sections, each of which shall relate to a major subject of
the pl~u, as outline~ in the Commission's program of work.
Section 6. Procedure for Adootion of Plan. Before adopting the city plan
or any section of it or auy substantial amendment thereof, the Commission shall
hold at least one oublic hearing thereon, notice of the time and place of which
shall be given by publication in a newspaper of general circulation at least ten
days before the da~ of the hearing. The adoption of the city plan or of any
section or amendment thereof shall be by resolution of the ConLmission, approved
by the affirmative votes of not less than five-sevenths of its total membership.
The Co~!ssion may from time to time amend or add to the city plan or any section
thereof as herein provided for the adoption of the original plan whenever changed
conditions or further studies by the Commission indicate that such Amendment or
addition is necessary or desirable.
An attested copy of the plan or of any section, amendment, or addition to
the city plan adopted by the Planning Commission shall be certified to the City
Council.
Section 7. ~eans of Executing Plan. Upon the adoption of the city alan
or any section thereof, it shall be the duty of the Planning Cormmission to
recommend to the City Council reasonable and practicable means for putting into
effect such plan or section thereof in order that the same will serve as a
Pattern ~ud guide for the orderly physical development of the city ~nd as a
basis for the efficient exoenditure of the funds therof relating to the subjects
of such city pl~u.
/~ Such means shall consist of zoning plan, the control of sub-division
plats, a plan o£ future streets, coordination of the normal public improvements
of the city, a long term program of capital expenditures and such other matters
as will accomolish the purposes of this section.
Section 8. ZoninM Plan. The Pl~_~ing Commission upon its own motion may
and upon instructions by the City Council shall orepare a proposed zoning plan
for the city. Before recommending such plan to the City Council, the Planning
Commission shall hold at least one public hearing thereon after a notice similsr
to that required by Section 6. The same procedure shall apoly for the preparation
of any plan of preposed rights of way for future streets or highways, or the
future widening of existing streets or highways, or for the reservation of lands
for other public purposes.
Section 9. Official M~P of Street Extensions. The Planning Co~uission, with
the assistance of the City Engineer, n~y and upon instruction by the City Council
shall prepare an offi6ial map of the platted and unplatted portions of the city
and adjoining territory, or portions thereof, indicating upon such ma_o the proposed
future extension or Widening of streets of the city within such existing platted
and developed territory or across such unplatted territory.
After such map has been prepared and a hearing on it has been held as provided
in Section $, it shall be submitted to the Council, which shall thereupon consider
such map and may adopt it or any part of it with such amendments as it deems
advisable. Before such adoption by the Council, public hearing shall be held upon
the oroposal at least ten days after a notice thereof has been published in a
newspaper published in the city. After such map has been adopted by the Council,
whenever any existing street or highway is widened or im'oroved, or whenever ar4v
new street is opened or aceuired by action of the city it shall not be required
in such proceedings to pay for any buildin~ or structure whatsoever constructed
upon such mapped street, or situated outside of any building line that may have
been established upon the existing street or within any ~rea thus reserved by the
map for oublic purposes, if such building, or structtu-e has been placed there after
the ado0tion and oublication of such map.
Section 10. Plats. Every plat of land oroposed within the city or within
two miles of the limits of the city and not within the limits~of a neighboring
~'.~nicioality sh~ll be s~0mitted to the City Council before being filed and no
plat of land shall be filed unless and ttutil the san~e shall first have been
approved by the City Council.
Before acting on such olat the City Council shall submit the same to the
Planning Comn~ission for its reco~uendations.
The Planning Commdssion, within forty days after any such plat has been
referred to it by the City Council, shall act on the same and shall mske its
recommendations with respect thereto. Such recommendations m~ consist of:
(a) reco~mmendation that the City Council a~r~o~rove such plat; or (b) recommendatio~
t~at the City Council disapprove such plat, in which case such recommendation shall
include a statement of the specific reasons for such recormuendation; or (c)
recon~uendation that the City Council approve such plat after specified changes
or revisions are made therein, which~ reconzmendations nu~y include the condition
that a revised plat, containing such ch~uges or revisions, be submitted to the
Planning Conzmission, in which case such revised plat sh~ll be so submitted to the
Planning Commission for its mflLrther consideration and recommendations before action
thereon by the City Council.
Section ll. Procedure for .Ch~nEes. No change shall be made in the zoning
plan, future street ~nd public lands pl~u, or regulations governing the platting
of land after such p~tans or regulations have been adopted by the City Council,
until the proposed change shall ~ve been referred to the Planning Commission
for report thereon ~ud an attested copy of such report shall have been filed with
the Co~zucil; and no ordinance or resolution establishing any of such plans or
regulations shall be adopted by the City Council until such ordinance or resolution
shall have been referred to the Planning Commission for a report thereon and ~n
attested copy of such reoort shall have been filed with the Council. Failure
of the Planning Commission so to report within forty days or such longer period
as m~ be designated by the Council after such reference shall be deemed to be
approval of the proposed change.
Section lB. List of Recommended Public Works. Each officer, department,
board, or co~i~ion of or in the city whose ~unctions include recommending,
preparing plans for, or constructing public works shall, at least three months
before the end of each fiscal year, submit to the Planning Commission a list of the
proposed public works reco~lended by such officer, department, board, or con~nission
for planning, initiation, or construction during the ensuing fiscal year. The
Planning Commission shall request from the local school district a similar list of
its proposed public works. The Planning Commission shall list and classify all
such proposed public works and shall prepare a coordinated program of proposed
public works for the ensuing fiscal year. Such program shall be recommended by the
Commission to the Council and to such other officers, departments, boards, or
public bodies as have jurisdiction over the recommending, planning, or constructing
of such public works. A copy of such recommended, program of oublic works shall be
included in the annual report of the Planning Commission provided for in Section S.'
Section 1S. Time of T~king Effect. This ordinance shall take effect and be
in force from and after thirty (S0) days after its passage.
