HomeMy WebLinkAboutOrdinance 146O R D i N A N C E N O. 146 AN ORDINANCE TO Ai[END ORDINA~CE NO. 143, BEING AN ORDINA!%~E; ~ ~ - LICENSING ~ND REGULATING THE SALE AT RETAIL OF NON-INTOXI- CATING MALT LIQUORS A~ND PROVIDING A PENALTY FOR THE VIOLATION THEREOF THE CITY OF COLUMBIA HEIGHTS DOES ORDAIN: Section '1. That that part of Section 6 of Ordinance No. 143 which reads as follows: "No license shall be granted for sale on any premises where a licensee has been convicted of the violation of this ordinance or where any license hereunder has been revoked for ca~e for at least ninety days after the said conviction or revocation, be and the same hereby is repealed. Section 2. That in the place and in the stead of that portion of Section 6 of Ordinance No. 143 repealed by Section 1 hereof the following provision shall be inserted in said section: No license shall be granted for sale on any premises where a licensee has been convicted of the violation of this ordinance or where any license hereunder has been revoked for cause for at least ~ days after the said conviction or revocation. Section 3. That Section 7 of Ordinance No. 143 which reads as follows: "Right to Search .~d Seize. Any peace officer shall have the unqualified right to enter, inspect and search the premises of a licensee heremader, during business hours, with- out a search and seizure warrant, and seize all intoxicating liquors found on the premises of such licensee, unless such licensee has an n~oxzcatzng liquor license issued under the provisions of Chapter 46, Extra Session Laws of 1933-34, and acts amendatory thereof; provided however, that this section shall not apply to into~:icating liquor found in possession of patrons of a licensee if said liquor is in the original package or container in which it was purchased and the revenue seals thereon have not been broken or the said original package or container in any way opened" be and the same hereby is repealed. Section ~. Section 5. Time of Taking Effect. This ordinance shall take effect and be in force from and after thirty (SO) days after its passage.
