AN ORDINANCE AUTHORIZING THE SALE BY THE CITY OF COLU~2[BiA HEIGHTS OF CERTAIN REAL ESTATE TO THE COLt~BIA HEIGHTS STATE BANK AND FOR THE GIViNG OF AN OPTION AND LEASE. THE CITY OF COLU~iBIA PHEIG~S DOES ORDAIN: Section 1. Authorization of Sale of Real E~tate. That the City of Columbia Heightm sell and conwey to the Columbia Heights State Bank that certain tract of land lying and being in the County of Anoka, State of ~innesota, described as follows, to-wit: Lot Four (4), Block Sixty-two (6~), Columbia Heights Annex to ~inneapolis, according to the plat thereof on file and of record in the office of the Register of Deeds in and for said County and State; together with all the heredit~ments and appurtenances thereunto belonging or in anywise appertaining, reserving, however, to the City of Columbia Heights the right of support and protection from the elements and all other rights whdcb the law may ~mply in party or common wall agreements, in and to that co~on w~tl which separates the building on the premises herein being sold to the Colnmbia Heights State Bank and the building located on Lot Five (8), Block Sixty-two (8~), Col~mbia Heights Annex to Minne- apolis. Section ~. Terms and Conditions of Sale. That the term~ of the sale of said property to the Colombia Heights State Bank shall be as follows: a. Columbia Heights State Bank to pay the City of Columbia Heights Eleven ThouSand (SI1,000.00) Dollars cash for the following described property, to-wit: Lot Four (~.), Block Six~y-two (6~), Col~m~ia Heights Annex to !ginneapolis, more par- tioularly described abovej ~ ~ ~~/~. b. The Columbia Heights State Bank to agree to heat the building located on Lot Five (8), Block Sixty-two (SE) now occupied as a branch United States Post Office during the winter of lgOV-~8 without cost to the City of Columbia Heights. L c. The City of Columbia Heights to execute a lease to the Columbia Heights State Bank for the period of one year from and after the 18th day of October, 193V, for the first floor and so much of the basement as is not now used by other tenants of the building located on Lot Tb:~ee (3), Block Sixty-two (6E), Col- umbia Heights Annex to ~inneapolis, co~r~only known as the Henderson building, for the sum of Fifty ($50.00) Dollars per month, heated, the City of Colu~bia Heights agreeing that under the terns of said lease it will vacate the building on thirty (30) days notice in case the same is sold. d. That the City of Colun~bia Heights give to the Column- bis Heights State Bank an option to p~chase Lot Five (8), Block Sixty-two (6~), Columbia Heights ~Dex to ~inneapolis, together with all he~edita~e~ts ~nd appurtenances thereunto belonging in an~ise ap~rtai~in~ for the sum of Six Thousand Fiv~ ~dred~ ($6,500.00) Dollars, said option to continue until such time as the present lease of the Post Office ~rtment of the building located on said premises is renewed or negotiations for the re- newal of the same definitely fail, but in no event shall such option continue for a ~riod longer th~n eighteen (18) months from the lath day of October, 193V. Section 3. Mayor and City ~anager~ to ~ecute Documents. That the ~{ayor and City lZanager be and the same ~reby are authorized to execute and deliver to the Col~bia Heights State Bank all legal documents necessary for the carrying out of the terms of this ordinance. Section 4. Time of Takin[ ~fec~. This ordinance shall take effect and be ~ force from and after thirty (50) days after its passage.
