To promote and conserve public safety, health, peace~
convenience and welfare by regulating the operation of veh-
icles and th~ use of the streets of this City, prescribing
penalties for the violation thereof.
The City Council of the City of Columbia Heights do
ordain as follows:
DEFINITION OF TE~IS
SECTION %. The following words and phrases when used in this
ordinance shall, for the purpose of this ordinance, have the
meanings respectively ascribed to them in this section, ex-
cept in those instances where the context clearly ingicates
a different meaning.
Terms not herein defined shall be construed as defined
in 'the "Uniform Highway Traffic Act".
(a) "Parking". The standing of a vehicle upon a street,
whether accompanied cz' unaccompanied by the operator thereof.
(b) "Double Parking". The standing o£ a vehicle upon
a street alongside of and parallel to another vehicle which is
parked at the curb~ except where Diagonal Parking is speci£ied.
(c) "Crosswalk". That part of the roadway connecting
sidewalks at street intersections and at other designated
places~ the width to be that of the sidewalk from the curb
line to the boilding line of the intersecting street.
(d) "Congested Zone". All that portion of the City of
Columbia Heights 1Bing within and bounded by the following
described line, to-wit; Fortieth Avenue from Central west
to University Avenue~ Central .&venue from Thirty-seventh to
Forty-fifth Avenue; Forty-~first Avenue from Central to Qurrey
Street.
(e) "'Oriver". AnM person who is in iactual physical
control of a vehicle or streetcar.
(f) "Curb" The lateral boundaries of a roadway, whether
or not marked by curbing.
(g) "Vehicle". Every device in, upon or by which any
person or thing is or may be transported or drawn upon a public
highway, excepting devices moved by human power or used ex-
clusively upon stationary r~ils or traoks~, provided, that in
as far as is applicable, for the purpose of Sections E to 12~
inclusive, and Section la, 18 and 19 o~ this ordinance, a
bicycle or ridden animal shall be deemed a vehicle, and pro-
visaed further that this ordinance shall not apply to street
c~rs, except where specifically so sts, ted.
(h) "person". Every natursl person, firm, co-partner-
ship, association or corporation.
(i) "Owner". Owner means any person, firm, association
or corporation owning or renting ~ motor vehicle or h~ving the
exclusive use thereof, under lease, or otherwise, for a period
greater than 50 days. The use of a motor vehicle in violation
of the provisions of this ordinance shall be prima facie
evicienoe that said motor vehicle w~s ~t the time oi' such
violation controlled, operated and used by the registered
owner thereof.
(~) "H!~hway" or "Street". ~Every way or place of what-
ever nature open to the use of the public, as a matter of right
for the ~purposes of travel.
(k) "Private Road" or "Driveway". Every road or drive-
way not open to the use of the public for purposes of vehicu-
lar travel.
(1) "Intersection". The area embraced within the pro-
longation of the lateral cu~rb lines, or, if none, then the
lateral boundary lines of two or more highways which join one
another at an angle whether or not such highway crosses the
o the r.
(m) "Right of Way". The privilege of the immediate use
of 'the highway.
(n) "Truck". Any motor vehicle designed or used prin-
cipally for carrying things other than passengers and includes
a motor vehicle to which has been added a cabinet box, plat-
form~ rack or other equipment for the purposes of carrying
things other than the personal effects of the passenger or

(o) "Uniform Highway Traffic Act". The Uniform Highway
Traffic Act as referred to by the provisions of this ordinance
is the Uniform Highway Traffic Act of Minnesota (Chapter 41S,-
S.E. No. B88, Session Laws of 19~7)
OPERATION OF VEHICLES
SECTION II. WHO MAY NOT DRIVE A HOTOR VEHICLE.
(a) Age Limits. No person shall operate or drive a
motor vehicle on any highway in this City who is under 15
years of age unless such person is accompcnied at the time by
a duly licensei chauffeur, or by the owner, or by a competent
person over 15 years of age &uthorized by the owner of the
motor vehicle being operated, provided that such owner must
be 15 years of age or over.
(b) Intoxicated Persons and Drug ~ddicts. No person~
whether licensed or not, who is an habitual user of narcotics
or who is under the influence of intoxicating liquors or
narcotics shall drive any vehicle or streetcar upon any high-
way.

(c) Owner's Res,oonsibi!ity. No owm, er of any motor
vehicle or any person having such vehicle'
in charge or in
control, shall authorize or knowingly allow the same to be
driven., or operated by any person prohibited from driving
or operating such vehicle under this section.
(d) . Driver's License. No person under fifteen years
of age or over shall operate any motor vehicle upon the
public highways of the City of Columbia Heights~ unless such
person, shall have secured a driver's license from the Com-
missioner of Highways of the State of Minnesota, in the
manner provided by the statutes of said State, and. unless
the operator has such license ou his person or in such veh-
icle while driving said vehicle.
SECTION II!. CARELESS DRIVING,
~ No oerson shall opera, re or ha~t any vehicle or
streetcar upon ~ highway carelessly or heedlessly in dis-
regard o±' the rights or safety of others or in a manner so
as to endanger or be likely to endanger any person or property.
(b) It shall be unlawful for any person driving ~n auto-
mobile to leave the same parked with the motor stopped and
with the ignition switch on and the transmission in gear~ or
leave the vehicle unattended with the motor running.
SECTION IV. SPEED REGULATIONS.
Generat Rule. Any person driving a vehicle on a
highway shall drive ~he same at a speed not greater than is
reasona.b!8 and proper, having due regard to the traffic, the
safety of Pedestrians, the surface and width of the highw&y,
and of ~ny other conditions then existing.
(b) Prima Facie Evidence o£ Violation. Driving a motor
vehicle at speeds exceeding those hereinafter specified shall
be prima facie evidence 'that the operato~ of said vehicle is
driving the same at a speed greater than is reasonable and
proper as defined in subdivision (a) of this section.'
(1) Railroad Grade Crossings. Fifteen miles
an hour when approaching within fifty feet of a grade cross-
ing of any steam, electric, or street railway when ~the driver's
view is obstructed. 3% driver's view shall be deemed to be
obstructed when at any time during the last two hundred feet
of his approach to such crossing he does not have a clear and
uninterrupted view o~ such railway crossing and of any traf£i6
on such railway for a distance of four hur~ired feet in each
direction from such crossing.
(2) Schools. Fifteen miles an hour when
passing a school during school recess or while children are
going to or leaving school during opening or closing hours.
(3) Blind Intersections. Fifteen miles an
hour when approaching within fifty feet an~ in crossing an
intersection of highways when the driver'~s view is obstructed.
The driver's view shall be deemed to be obstructed when at
any time during the last fifty feet of his approach to such
intersections, he does not have a clear and unobstructed
view of such intersection and of the trafZ'ic upon all of the
highways entering such intersection for a distance of two
hundred feet from such intersection.
(4) Curves and Grades. Fifteen ~.uiles an
hour in going around curves or along a grade upon a highway
when the driver's view is.. obstructed within a distance oi' one
hun~ired feet along such highway in the direction in which he
is proceeding.

(5) .~Built-up Controlled Hi~hwavs. Twenty miles
an hour on any highway where the same passes through the close-
ly built-up portions of this City or wheFe the traffic is
congested, when traffic on such highway is controlled at inter-
sections by police officers or traffic control devices.
(8) Built-up Uncontrolled Highways. Fifteen
miles an hour on all highways where the same passes through the
o,losely built-up portions of this City where the traffic is
(7) Residence Streets. Twenty miles an hour
on any highway where the same passes through the residence
portion of this City.
(8) .HiRhways Under Repair or Construction.
Fifteen miles an hour on any street un, der repair or construc-
tion or where any warning light is placed.
( o ) Exemptions.
(1) Public Emergency Vehicles. The provisions
of this ordinance shall not apply to vehicles when operated
with due regard for safety under the direction of peace oi'fioers
in the chase or apprehension of violators of the law or of
persons charged with or ~uspected of any such violation~ nor to
fire departments or fire patrol vehicles when traveling in
response to a fire alarm~ nor to public a~0ul~nces when travel-
ing in emergencies. This exemption sh~ll not~ however, protect
'the driver of any such vehicle from the consequences of a
reckless disregard of the safety of others.
(E) physicians ~nd Private An~bulances. I£ a
licensed physician or private ambulance driver~ ~bile driving
a motor vehicle in response to an emergency call~ be stopped
by & police officer for driving s~id vehicle at e~ speed greater

than is reasonable and proper, he shall, upon giving his name
and 'address and the regis'br~tion number of his vehicle, be
served with a written notice of the violation of 'this ordi~-
a.nce and shall then be permitted to proceed in the vehicle to
his destination, but thereafter shall be subject to the'
proceedings required by section 22.of this o~dinance.
SECTION V. R~ILROAD GRADE CROSSINGS.
(a) Controlled, CrossinEs. Whenever any person driving
a vehicle or street car approaches an interurban or steam
rail-way grade crossing and a clearly visible and positive
signal gives ~.~arning of the immediate approach of a railway
train or car, it shall be unlawful for the driver of the
vehicle or street car to fail to bring the vehicle or street
car to a complete stop before traversing such grade crossing,
or to traverse such crossing during the time such signal in-
dicates such warning.
(b) Certain Vehicles to Stop at Any Crossing. Whenever
any vehicle carrying school children, explosives or inflammable
liquids, or passengers for hire, or any vehicle of the tractor
or caterpillar type, approaches any steam railway grade cross-
ing, it shall be the duty of the driver thereof to bring the
same to a complete stop before crossing said track and not to
traverse such crossing until su. ch movement can be made in
safety.
(c) Stop Crossings. Whenever any person ariving a
vehicle or sbreet car approaches a steam railway grade cross-
ing, where railroad crossing "stop" signs ~re place and
maintained, as provided for by law, it shall be unlawful for
the driver to fail to bring his vehicle or street car to a

complete stop, or after having so stopped his vehicle or
street car to traverse such crossing until such movement
can be made in safety
(d) Train Blockin~ Highways. It shall be unlawful for
any railroad company to permit any train or car to be so
stopped or operated on any track or tracks owned or control-
led by s~.~id company as to prevent the use of any street for
purposes o£ tr&vel for a period of time longer than five
minutes.
SECTION VI. LICENSE PLATES.
(a) Current License to Be Displayed. No person shall
bperate or drive a motor vehicle on any highway unless such
vehicle shall have been registered in accordance with the
laws of this State and shall have the number plates assigned
to it by the Registrar of Motor Vehicles for the current
year only, conspicuously displayed thereon in such manner
that the view thereof shall not be obstructed.
(b) Number and Fastening of Plates. If the vehicle be a
motorcycle, motorcycle side car~ trailer or semi-trailer: one
such plate shall be displayed on the rear thereof; if it be
any other kind of motor vehicle, one such plate shall be dis-
played on the front and one on the rear thereof, securely
fastened in a horizontal position at least sixteen inches
above the ground so as to prevent the same from swinging.
(c) Plates to Be Kept Clean. It shall be the duty of the
person driving the motor vehicle to keep said plates legible,
undefaced, and unobstructed and free from steam, grease, dust
or other blurring material so that the lettering thereon shall
be plainly visible at all times.

SECTION VII. RULES OF THE HIGHWAY.
(a) Keep to the Right. Upon all highways of sufficient
width, except upon one-way streets, the d~iver of a vehicle
shall !rlve the same upon the right half of the traveled por-
tion of the highway and shall drive a slow moving vehicle as
closely as possible to 'the right hand earle or curb of such
highway~ unless it is impracticable to travel on such side of
the highway and except when overtaking an,2 passing another
vehicle.
(b) Crossing Intersections. In crossing an intersection
of highwavs or the intersection of a highway by a railroad right
of way~ the driver of a vehicle shall at all times cause such
vehicle to travel on the ri~jht half of the highway unless such
right half is obstructed or impassable.
(c) Passing. Drivers of vehicles proceeding in opposite
directions shall pass each other to the right, each giving to
the other at least one-half of the main traveled portion of
the roadway as nearly as possible.
(d) Overtaking. The driver of any vehicle overtaking
another vehicle proceeding in the same direction shall pass
at a safe distance to the left thereof except when overtaking
street oars as provided in paragraph (k) herein, and shall not
again drive to the right side of the highway until s-~ufely clear
of such overtaken vehicle.
(e) Use of the Left Side of a Highway. The driver of a
vehicle shall no't drive to the lez't side of the center line of
a highway in overtaking an~[ passing another vehicle proceeding
in the same direction unless such left side is clearly visible
and is free of oncoming traffic for a sufficient distance ahead
to permit such overtaking and passing to be made in safety.
(f) Passing on Curves or Grade Crests. The driver of a
vehicle shall not overtake and pass another vehicle proceeding
in the same direction upon the crest of a grade ~r upon a curve
in the highway where the driver's view along the highway is
obstructed within a distance off five hundred feet.
(g) Passinw. at Intersections and Crossings. The driver
of a vehicle shall not overtake and pass any other vehicle pro-
oeeding in the same direction at any steam or electrical rail-
way grade crossing nor at any intersection of highways except
when such intersection is controlled by a traffic of£icer or
automatic signal devioe~ provided that when the driver of any
motor vehicle has signalled a left hand. turn and has properly
approached the intersection~ such vehicle may be passed on its
right side.
(h) Overtaken Vehicle. The driver of a vehicle on a
highway about to be overtaken and passed by a~'~other vehicle
approaching from the rear shall give way to the right in favor
of the overtaking vhhicle on suitable and audible signal being
given by tbfe driver of the cvertaking vhhicle.
~ Following Another Vehicle. The driver of a motor
vehicle or street car shall not follow ~nother vehicle more
closely than is reasonable and prudent, having due regard to
the speed of such vehicles and the traffic upon and coniition
of the highway and the condition of his vehicle.
( j ) Turning.
(!) .Right Turn. Except as otherwise provided
in this aection~ the driver of a vehicle intending to turn to
the right at an intersection sh< approach such intersection
in the lane of traffic nearest to the right h~nd side o£ the
highway and in turning shall keep as closely as practicable

to the right hand curb or edge of.the highway. No driver of
any vehicle shall make a ri~ht hand turn at any inZerseoti'c~n
when another vShicle traveling in the sauna direction is on his
ri ght.
(2) Left Turn~ The driver o£ any vehicle
intending to turn to the left shall approach such intersection
in the lane for traffic to the right of and nearest to the center
line of the highway s, nd in turning shall keep as near 'to the
center of the intersection as practicable "and shall at all times
leave space to allow safe pkssage to any vehicle seeking To make
a right hand turn from the diredtion in which he is turning on
the same intersection at the same time. ~to driver of any
vehicle shall make ~ left turn at any in'~ersection when another
vehicle traveling in the same direction is on his left.
($) Turning .Around_. No vehicle shall be turned
around by making a "U" turn upon any highway in the City unless
~uch vehicle shall first proceed to an intersection street.
Provided, however, that a "U" turn ~t any intersection on any
hi?hwsy in this City where a police officer is stationed, or
where a stop and go or illuminated "slow" signal is located in
the center of the intersection~ is hereby prohibited.
(~) Controlled Intersections'. Where traffic
c~ontrol devices or marking have been installed within an inter-
section~ vehicles shall be driven to the right thereof, unless
such device or marking indicates that driving to the left is
permitted or unless otherwise directed by e police officer.
(k) Overtaking Street Cars.
(1) ~[oving Street C~rs. The driver of a
vehicle shall not overtake and pass upon the lef~ any street
car proceeding in the same direction when actually in motion or
temporarily at rest.

(2) Stop-oed Street Cars. The driver of a
vehicle overtaking any street oar stopped or about 'to stop for
the purpose of receiving or discharging eJn~ passenger~ shall
bring such vehicle 'to a full stop at least ten feet in the rear
of such car and remain stationary until such passenger has
boarded such car or reached a place of safety, and the street
car gates have been closed.
(!) Traffic Lanes. Wherever traffic lanes have been
established by the Council on any highway o~' thi~ City and
adequately marked by the Superintendent~ of Police in order to
ati~n and direct traffic, it shall be unlawful for any driver
to fail or refuse to keep his Vehicle within the boundaries of
such lane or' lanes, except when overtaking and passing another
vehicle in accordance with this ordinance.
(m) Driving on Gravies.
(i) F~li Control. The driver of a motor
vehicle upon steep grades shall hold such motor vehicle under
control and as near ~he right hand side of the highway as
reasonably possible.
(S) Coasting. The driver of a motor vehicle
when traveling upon a down grade upon any highway shall not
allow the vehicle to coast with ~he gears of such vehicle in
neutral.
(n) Jumoing.. Rides.
(!) General Rule. No person shall ride in or
jump into or upon '~ny v~hicle without the consent of the driver
~nd no person shail~ when Xiding, allow any part of the body to
project beyond the limits of any motor vehicle, except when
signalling as hereinafter required~ nor shall any person board
or a!i~t from, nor h~n~ on to any motor vehicle or street car~
when such motor vehicle or street car is in motion.
(~) Exceotion. This provision shall not
apply to any person whos~ e~mpl.~yment makes it necessary to
ride in or upon a v~hicle otherwise than herein provided, when
engaged in the .necessary duties of such employment.
(o) Hitching. It sb~zll be unlawful for any person
traveling upon any bicycls~ toboggan, hand sled, or sick, ilar
vehicle to cling to or attach such bicyCle~ toboggan, hand sled,
or simi].ar vhhicle to say other moving vehicle or street car
upon any~ street in the City of 0~lumbia Heights~ aud' no person
shall i~ermit any bicycle, toboggan, hantt sled or si'mils~r vehicle
to be attached to or drawn by any other movin~ vehicle or street
car in this City.
(p) Injurious !~Jaterials on Hiahwavs. No person shall
throw or place in any street any glass, nails, or o'ther material
likely to puncture, or injure rubber tires of any vehicle~ ami
any 7~oerson involved in any a~ccident in which any such injurious
materials are cus~sed to be thro?n or ple, c~d'in smy street shgll
immediately remove such injurious materials or cause the same to
be removed.
(q) Stopping on Walks. No vehicle or street car shall
stop on any crosswalk so as ~o interfere with the passage of
pedestrians, nor shall any vehicle be driven along any sidewalk.
(r) Crowded Driver's Seat. Operating a vehicle under any
of the following conditions shall be deemed ~ori~'~a facie evidence
of a violation of Section III of this ordinance prohibiting care-
less operation of vehicles:
(1) W?~.en there are n~ore than two other persons
in the driver's seat in addition to the driver.
(B) I~Fnen the driver has in his lap an~ other
person, adult or minor~ or when the driver ism seated in the
lap of any person ~fnile the vehicle is in motion.
(3) When the driver has either arm around
another person or when another person hag either arm around
the driver while the vehicle is in motion.
The enumeration of conditions which shall constitute
prima £acie evidence off a violation o£ Section III of this
ordinance shall not be deemed to exclude other conditions
not enumerated herein. '
Obedience to Signs and Si~.nals. The driver of
every vehicle shall obey 'the directions give~.~ by signs,
signals and markings placed and maintained on or within any
hi~'hway by authority of the City Council for the purpose of
guiding, informing, 'warning or controlling tra£fic.
(t) Obstruotin~. Traffz'ic. It shall be unlawful for any
person to so drive and operate an automobile upon the streets
in the City of Columbia Heights as to needlessly, unnecessarily
and unwarrantedly block, obstruct or interfere with the orderly
flow of traffic on said streets. Proof that such tra£fio was
blocked, obstructed or inter£ered with shall be prima facie
evidence that such blocking;, obstructing an,~ interference was
needless, unnecessary and unwarranted, except where such vehicle
is mechanically at fault.
SECTION VIII. PEDESTRI AI~iS.
(a) So!icitinM Rides. i~o person shall stand in the
traveled portion of a roadway for the purpose of or while
soliciting a ride from the driver of any vehicle other than a
common carrier.
(b) Obedience to Si~n~!s. .Pedestria~ns sbai! observe and
conform to all signals ar,,/ directions off police officers and
si~'ns and automatic si..~nats at any intersection.
(c) Crossin~ the Hie'hwalz. Pedestrians desirin~ to cross
from one side of a highway to the other in the congested zone
shall cross only at crosswalks or other designated and ma~ke,~
places, and shall not carelessly or maliciously interfere with
the movement' of v~hicles or street cars.
(d) Crowding[ Sidewalks. No person or group of persons
shall assemble or cause others to assemble on any sidewalk so
as to obstruct the free passage off pedestrians thereon or
interfere with the us~..~thereof.
(e) Right off Way at Crosswaik,~. The driver of any vehicle
or street car upon any highway ~. this City shall yield the ri. ght
of way to a pedestrian crossing such highway on any crosswalk
.except ~t intersections where the movement of traf£io is being
regulated by police offficers or traffic control devices. Every
pedestrian crossing any highway at any point other than a p'ede-
strian crossing~ crosswalk or intersec'~ion shall yield the right
of way to vehicles upon the highway.
SECTION IX. RIGHT OF WAY.
(a) Vehicles on the Right. ~hen two vehicles or a
vehicle and a street car aapproach or enter an intersection at
approximately the same time~ the driver of 'the vehicle or street
car on the left shall y~elld the right of way to the vehicle or
street car on the right except as otherwise provided herein.
(b) Forfeiture of Right of WaX. The driver o-? any vehicle
or street car traveling at an unlawful speed shall forfeit any
ri~'ht of way ,~/l~ich he might otherwise have hereunder.
(c:~ Aooroachin~ Vehic]e_~. The driver off a vehicle or
street oar ap'oroachin~ but not havin,~ entered an in~- ' ~

shall ~rield the ri~'ht of way-to a vehicle within such intersection.

first mentioned vehicle or street oar provided the driver of
the vehicle turning to the left has given a plainly visible
signal of intention to turn.
(d) Vehicles from Atlevs. The driver of ~ny vehicle
entering any street or highway from an alley, private road or
driveway shall yield the right of way to all vehicles imme-
diately &pproaching on such street or highway and sh< stop
and sound his horn or other warning de'vice before crossin~
any sidew&lk or p~n ~. along such street or highway, or,
where there is no such sidewalk or 2atb~vs~v, before entering
any such street or highway and shall not proceed unless his
entering the street or highway will not interfere with traffic
thereon. ~
(e) Obey Officers. No driver of a motor vehicle or
street car a~ intersections controlled by police offi~cers
shall fail -to obey si~na].s by such officers. No ariver of any
vehicle or street car shall fail to stop his vehicle or street
oar when the word "stop" or a red light is displayed at an
intersection by ~n automatic tra~ffic control device against
the line of traffic in which such vehicle or street car is
moving, and no driwer of any 'vehicle or street car may again
place such vehicle 'or street car into motion or cross such
intersection until such device displays the word "go" or a
green light. No driver of any v~hicle or street c&r shall
enter such intersection during any portion of the interval
when such device displays ~ warning of traz'fic Airection
chan~e, from "Stop" 'to "Go".
(f) Emer~'encv Vehicle. 'The 5. river ol' a vehicle or
street car upon a hig~hw,~y shan!~, yie!~i the rio'h+.~_~ c~' way to
ambulances and to police and fire department vehicles when
the drivers thereof soun~ an au~ib!e sign~!. This provision
shall no~ operate to relieve the driver of an ambuia~nce or a
police or fire department vehiote from the duty to drive with
due regard for the safety of all persons using the highway.
(g) Emerge~cy Vehicle A'oproachins.~ Upon the approach of
any ambulance or police or fire departmen't vehicle giving
audible ei~nal by bell~ siren, or exhaust whistle the driver of
every other v. ehicle shall immediately drive the same to a
position as near as possible and parallel to the right ha, nd
edge or curb of the highway~ clear of any intersection of
highways and shall stop and remain in such position unless
otherwise directed by a police or traffic officer until the
ambulance or police or fire department vehicle shall have
passed.
(h) Followln~ Fire A~paratus. It shall be unlawful flor
the driver of any vehicle to follow any fire apparatus travel-
in~ in response to a ~'ire alarm closer than £ive hundred feet
or to drive into or park such vehicle within the block where
the fire apparatus ,has stopped to answer a fire alarm unless
permittei to do so by a Police or fire department officer.
(1) Driving Through Processions. No driver of any
vehicle or street car shall drive the same through any funeral
procession except when permitted to do so by a police officer~
except as provided in paragraph (f) of this sec tion~ provided~
that vehicles in such procession shkll establish their identity
by lighted head lamps.
(j) Pulling Away from Ct%th,, The driver of any vehicle
parked at the curb on any highway in this City and about .to
start shall yield the right of way to all vehicles immediately
approaching on such highway~ and before starting~ shall warn
other drivers of such movement by extending the arm ho ri ~.~onZally,

(k), Thr~uMh Highways.
'~(1) "Thru Highways" Hi~w~ys ~nd par~s of
,highways m~y be design~ted by the Council ~s "th~ highways"
or "thru traffic streets" ~ the necessary signs sh&ti be
p~ced and maintained on the approaches thereto, except as
otherwise provided.
(2) Th~ H.i~'hw~y Sto'p. The driver of
every vehicle or street car'on ~n¥ highway intersecting
"thru highway" or "th~ traffic ~treet", shall bring such
vehicle or street oar to ~ complete stop before crossing or
entering upon such "thru highway" or "thru traffic street",
except when an automatic siCnat device or ~ police officer
~ives the sisal to proceed.
(~) Status of Stopped Vehicle. ~en
vehicle or street car has stopped st the ~pproach to any "th~
highway", such vehicle or street car shall have the same rigbt
to enter such th~ highway as it would h~ve to enter ~ny other
h i ghw~y.
(1) .Stop Intersections. The driver of every vehicle or
street oar on any highway in this City shall bring such vehicle
or street car to a complete stop before crossing or entering
upon an intersecting highway, where ~n,:l when there is in place
on the approach.es to or within such intersecting highway ~ny
light, sign, stend&rd, or m~rking upon which appears the word
"Stop" or the words "Stop-School".
SECTION X. SIGNALS OF THE DRIVER.

direct line, shall first see that such movement o~n be made in

safety and if any pedestrian or cyclist may be affected by sudh
movement shall give a clearly audible signal by ~un,~ing the

~ Warnin~ Other Drivers. ~enever the operation of any
other vehicle may be affected by such movement such. driver shall
give a siena! either by extending the arm horizont~l!y from
and beyond the left side of the vehicle or 'by an ~equate
mech~ica! or electrical signal dtvice, plainly visible to the
driver of such other vehicle of ~be intention to make such
movement at least fifty feet before a stop or turn is to be
made, except that the requirement of signal by wa~in~ device
shall apply to motor vehicles only.
(c) Backin?. No person in control of any vehicle sha!l
back said vehicle %~thout ample warning, and while backi~,
care must be exercised not to injure persons or property, ~nd
in no case shall any vehicle be backed around a corner at or
into an intersection of highways.
SECTION XI. PARKING
(a) How to Park. No person shall park or leave standing
any vehicle whether attended or unattended upon any highway
unless a clear and unobstructed width of not less than fifteen
lest upon the main travelled portion of said highway opposite
such staniing vehicle shall be left for free passage of other
vehicles thereon, nor unless a clear view of such vehlc!a may
be obtained, from a distance of two hundred feet in each
direction upon such highway, ~nd such vehicle shall, except
as hereinafter provided, be parked parallel with, to the left
of and within one foot from the right hand curb: and not
closer than four feet 'to any other vehicle parked at the curb.
(b) Disabled Vehicles. The provisions of this section
shall not app!¥ to the driver of any vehicle which is disabled
while on the paved or improved or main travetec~ portion of a
highway in such manner and to such extent that it is impossible
to avoid stoppin~ and temporarily leaving~such vehicle in such
position.
(c) Parkin~ on Left Side. No vehicle may be brought to
a stop on the left side of a highway.
(d) Cars for Sale. No parson shall place any vehicle
on a highway to display the same for sale or exchange. A
vehicle shall be deemed to be displayed in violation of this
section when found standing upon a street, and bearing a
sign indicating that it is for sale or exchange.
(e) Where Not to Park. No person shall park a vebicl.?
or permit it to st~ni~ whether att=haled or unatt, ended, upon a
highway in front of ~ private drivew~¥ or within fifteen
feet in either direction of ~ fire hydrant or the entrance to
a fire station; nor within twenty-five feet from the inter-
section of curb linss or, if none, then within fifteen feet
of the inters~,tion of property lines at an intersection of
highways; nor within thirty feet of any "th~ street stop" or
"thru. hi?~hway stop" or "stop" er any other authorized tro, ffic
warning sign, placed on the side of any roadway on the approach-
ing side; nor within twenty feet of a point op?osite the nearest
end of any saf~ety zone; nor within five feet of the intersection
of any public alley %%.~th any highway or ~round any corner.
(f) No ParkinE Zones. No person shall park a vehicle or
permit it to ste~nd~ except as otherwise provided or unless
permitted so to do by a police officer, on any highway where
the City Council has established anm marked ~ "No Parkin~ Zone"
and when and to the extent so marked.
(M) Tamperin~ With Vehicles. No person shall molest any
vehicle standing on any highway without the consent of the
owner or driver of such vehicle, nor shall any such person set
such vehicle in motion or otherwise damage or interfere with
the same.
Provided, however, that whenever the City Engineer, or
any Street Commissioner, or any of hia assistants shall find
it necessary, for purposes of faci].itating street maintenance
operations, such as the removal of snow, ice or street wastes,
to move any vehicle standing on any highway in this City, aaid
City Engineer, Street Comnissioner or assistants are hereby
authorized to move such vehicle to the extent necessary for
such purposes.
(h) .S..~.an~i_i2n.~ With Brakes Set. No person having control
or charge off a motor vehicle shall allow such vehicle to stand
on any highway unattended without first effectively setting
the brakes thereon, and when standing upon any gr~ie without
turning the front wheels oz' such vehicle to the curb or side
o£ the highway.
([) Dia~ona! Parkin~.
(!) Notwithstanding the provisions o£
Paragraph "a" of this section, the Police Department may,
in specific instances by direction and authorization of the
Council makk on the roa~dways and curbs in the highways of
this City spaces and methods of parking or standing vehicles
other than parallel with and alongside of 'the curb.
(B) Wherever and whenever such spaces are
so marked the driver or person in charge of any vehicle shall
not park or stand his vehicle in any other manner than that
indicated by such markings.
(j) Places of Public Assembly.
(1) No person or driver in charge of any
vehicle shall leave the same standing or parked on any highway
in this City in front of the entrance to or exit from any
theater, dance hall, church, hospital, or school for the full
width o£ such entrance or exit during the hours that such
bz~itdings are in use by 'the public.
(2) The owner o£ any buit~ing used for said
purposes shall cause to be placed at such entrance or exit
one hour before such building is opened to public use~ proper,
adequate and visible signs,., sub~ect~,~ to the ~pprovai of tbe.~
Chief of ?olic~v ~a'iving z~otice to the ,mubl~c_ of the ~no~,rs~ of
use o£ such building. Such signs shall be ren~oved YYnen such
use of the building c~ases.
(k) Public A!le~,~s. Vehicles other than trucks sh~lt not
be ps~rked in public alleys, and tr~.cks shall not be so parked
for a longer period o!' time than is necessary to loa~[ or unload
commodities.
(1-) Double Parking. Double parking on any his~nway in
this City is hereby prohibited.
(m) Six Hour ?arkinE. No person in charge of any
vehicle shall park or permit such vehicle to stand upon any
highway In this City for more than six consecutive hours.
(~) Locked Vehicles. i% person shall at any time leave
any motor vehio!e standing upon any highw&y in this City with
the wheels chained, !ocked~ or fastened in such a manner that
such ~otor vehicle cannot be easily moved in case oi~ emergency.
Locking of a motor vehicle so as to permit the vehicle being
moved by hand shall be allowed.
SECTiOt~Y XiI. STP~EET CARS.
(a) StandinM at Terminals. At duly authorized street
car line terminals or wyes on any highway, no .~treet oar shall
stand parallel with and alongside of each other on adjoining
tracks except when !os~ting or unloading but shall so stand,as
to permit the passages o±' emergency vehicles between them~ ii'
necessary.
(;~ (b) Stoppin~. No street car shall stop for the purpose
of loading or unloading except at a duly designated street
car stop.
(c) Gates to 'Be Kept Closed. The gates off every street
car upon a highway shall be kept closed at all times except
when reoeivi.ng or discharging passengers.
(d) Obedience to Sic:hats. The operator cz~ every street
car shall obey the directions given by sigms, signals,
marblings placed and maintained on the highways of this City
by authority of the City Council for the purpose oi~ gmiding~
informin~o~ warning or controlling traffic~ except as otherwise
provided for.
SECTION XIII. TRUCKS.
(a) Trucks Followin~· E~ch Other. The driver of any
truck or truck tractor when traveling upon a highway outside
of the congested zone shall not follow another truck or truck
tractor within one hundred -~'~et~ but this shall not be construed
to prevent one tm.~ck or truck tractor overtaking and passing
~:~nother.
(b) ~sximum Spe.ed.s. Any person driving a truck~ ii' the
weigh~ of such truck including load exceeds !8~000 pounds~
shall drive the same at a speed not greater than fifteen miles
per hour if such tz~ck is equipped with solid tires or at &
speed not greater than eig_hteen miles per hour~ii~ such truck
is equipped with pneumatic tires.
(c) Overloading. Every motor vehicle shall be so main-
tain~d~ loaded and operated as to assure proper and adequate
functioning of the braking mechanism in accordance with the
stopping distance requirements of paragraph (e) ~: of Section
17 of this ordinance.
(d) Unnecessary Noise, Every motor v~nz~-' '~!e shall be so

SECTION XIV. SIZE OF VEHICLES.
(a) Excess Size,:~ Vehicles Prohibited, I't shall be

way any vehicle or vehicles of a size exceeding the limits
stated under this section.

(a) Exces~ Weia'hts Prohibited. It shall be unlawful for
any person to drive or mo~r~, or for the o'.,,ner to cause or know2
in~ly permit to be driven or moved on a~y highway any vehicle
or vehicles or a weig'ht exceeding the li~,,i't~tions stated i~z
this section.
(b) Flag or Li?ht on Load Extending 'to the Rear. Vfhen-
ever the loml on an~ vehicle shall exten~S more than four feet
beyoni the rear of the bed or bof~y thereof~ 'there shall be .~lis-

clearly visible at all times from the rear of such load a red

(d) Checkin~ Loads. Any police officer or othsr duly
authorized person having reason to b~.lieve that the weight of
a vehicle and load is unlawful is authorized to weigh the same
and may require that such vehicle be driven to the nearest
scales in the event such scales are within two miles. The
driver may then be required by such officer or authorized
person to' unlo~ immediately such portion of the load as may
be necessary to decrease the gross weight of such vehicle to
the maximum specified in this ordinance.
(e) .,S,,p, ecial Permits. The City Engineer m~y upon applica-
ticn in writing and good cause being shown therefor, issue a
special permit in writing authorizing the applicant to operate
or move a vehicle or combination of vehicles of a size or
wei~ht exceeding the maximum specified in this or,iinance~ upon
any highway. Every such permit shall desia_.~_ate the route to
be traveled and contain any other restriction and conditions
deemed necessary by the Council.
(f) Permit 'to Be Carried i~ Vehicle, Eve, ry such permit
shall be carried in 'the vehicle to which it refers ar, d shall
be open to inspection by any peace officer.
(g) DroMpin~: ~ateria!s, No person shall operate any
vehicle which is so constructed or loaded as to permit the
contents or load thereof to be dropped or strewn upon the
street.
~EC, i0,~,,~ ~I. EOU!P}{E],!T OF I~,~HICLES.
(a) Vehicle to Be EQuipped or Constructed as Realuir_~d_. It
shall be unlawful Tot any person to drive or move or for the
owner to cause or knowingly permit to b~ driven or moved on
any highw~.y any vehicle or vehicles which are not constructed
or equipped as required in this section.
· (b) Thickness of Solid Tires. Every solid rubber tire
on a vehicle moved on any highway shall have rubber on its
entire traction surface at least one and one-half inches thick
above the edge of the flange of the entire periphery.
(c) Projections on Tires.
(1) No tire on a vehicle moved on a highway
shall have on its periphery any block, stud, flange, cleat, or
spike, or any other protuberance of any material other than
rubber which project beyond the tre~i of the traction surface
of the tire except that it shall be permissible to use farm
machinery with tires having protuberances wEich~wil~I~?n~t~! ~.~
materially injure the highway and except also, that it sh~ll~be
permissible to use tire chains of reasonable proportions upon
any vehicle when required for safety because of snow, ice or
other conditions tending to cause a vehicle to slide or skid.
(~) Provided that the operation upon a
highway of traction engines or tractors have movable tracks
with transverse corrugations upon the periphery of such movable
tracks or farm tractors or other farm machinery may be per-
mitted subject to the requirements ~nd regulations of p~r~-
graphs (e) and (f), Section 16, relating to special permits.
(d) Trailers.
(1) No motor vehicle shall be driven upon
any highway drawing or having attached thereto more th~n two
other vehicles except that a motor vehicle with semi-trailer
may draw in addition thereto two other vehicles.
(E) The drawb~r or other connection be-
tween any two vehicles, one of which is towing or drawing
the other on a highway Shall not exceed~ fifteen feet in
length from one vehicle to the other. Whenever such con-
nection consists of a chain~ rope or cable, there shall be
displayed upon such connection a red flag or other signal or
cloth not less then twelve inches both' in length and width.
($) Trailers shall be attached to the pre-
ceding vehicle by means of a coupling and in addition thereto
by means of two chains, one on each side of ~the coupling,
attached to the same part of the chassis~s is the coupling.
Each chain must be of sufficient strength to pull the trailer
or trailers attached to it when such trailer or trailers are
loaded to their m~ximum capacity.
(e) Brakes.
(1) Number and Construction. Every motor
vehicle when operated on m highway shall be equipp~ed with
brakes adequate to control the movement and to stop and to
hold such vehicle, including two separate means o£ applying
the brakes, each of which means shall be effective to apply
the brakes to at least two wheels and so constructed that no
part which is liable to failure shall be common to the two
except that a motorcycle need be equipped with only one brake.
(2) Stoppin~ Distauce. All such brakes
shall be maintained in good order and shall be capable at all
times of stopping such vehicle in dry weather on a level sur-
face within a distance of forty feet from the spot where such
brakes are first applied when suc~ vehicle is traveling at a
speed of twenty miles per hour.

(3) Police to Stop Vehicles. For the purpose
of enforcing the provisians of this sub-paragraph, any police
officer is hereby authorized, in his disSretion, to stop any
vehicle, on any highway in this City, ~ud to require the
driver of said vehicle to demonstrate the ~dequacy of the
brakes on said vehicle, with regard to the maximum stopping
distance specified herein.
(f) Warnin~ Device.
(1) Audible Distance. Every motor vehicle
when operated upon a highway shall be equipped with a warning
device in good working order capable of emitting sound audible
under normal conditions from a distance of not less than two
hundred feet.
(2) Types Prohibited. It shall be unlawful
except as otherwise provided in this section for any vehicle
to be equipped with or for any person to use upon a vehicle
any siren, comp=ession or spark plug whistle or gong.
(3) Unnecessary Noise. It shall be unlawTul
fo~ any person at any time to use a warning device otherwise
than as a reasona~ble warning or to make any unnecessary or
Unreasonably loud or harsh sound by means of such warning
device.
(g) Emergency Vehicle Warning Device. Every police and
fire department and fire patrol vehicle and every ambulance
used for emergency c~lls shall be equipped with a bell~ siren
or exhaust whistle.
(h) Obstruction to View.
(t) Loads or Vehicle Construction. No
person shall drive a' motor vehicle on a highway which motor
~ehicle is so constructed or loaded ~s to prevent the driver
from obtaining a view of the highway to the rear by looking
backward from the driver's position, un~ess such vehicle is
equipped with a mirror so located as to reflect to the
driver a view of the highway for a distance of at least two
hundred feet to'the rear of such vehicle.
(E) Posters on Windshield or Windows. It
shall be unlawful for any person to drive any vehicle upon a
highway with any sign, poster or other non-transparent
material upon the front windshield, side wings, front side
windows or rear windows of such motor vehicle other than a
certificate or other paper required to be so displayed by law.
(3) Windshield Wipers Required. Every
windshield on a motor vehicle shall be equipped with a device
for cleaning rain, snow or other moisture from the windshield
in the driver's line of vision, which device shall be' so
constructed as to be controlled 'or operated by the driver of
the vehicle.
(i) Muffler Required.
(1) Constant Operation. No person shall
drive a motor vehicle on a highway unless such motor vehicle
is equipped with a muffler in good working order and in
constant operation to prevent excessive or unusual noise.
(E) Muffler Cut-out Prohibited. It shall
be unlawful to use a muffler cut-out on any motor vehicle upon
a highway.
(3) Excessive Smoke Prohibited. No .v~hi~le
shall be so operated as to emit excessive smoke or products
of combustion.

( J ) Lighting Equipment.
(1) When ReGuired. Every motor vehicle upon
a highway in this City during the period from a half hour after
sunset to a half hour before sunrise and at any other time when
there is not sufficient light to render clearly discernible any
person on the highway at a distsnce of two hundred feet ahead,
shall be equipped with lighted front and rear lamps as required
in this section.
(2) Head Lamps. Every motor vehicle other
than a motorcycle, rossi roller, road machine, or farm tractor
shall be equipped with two head lamps, no more or less, at
the front of and on opposite sides of the motor vehicle, which
head lamps shall comply with the requirements, regulations,
and limitations set forth in the Uniform Highway Traffic Act.
(3) Motorcycle Lamps. Every motorcycle
shall be equipped with at least one and not more than two
head lamps which shall comply with the requirements and
limitations hereinafter set forth and except as to acetylene
head la~nps shall be of a type which has been approved by the
Commissioners of Highways of the State of k~innesota.
(4) Tail Li~,hts. Every motor vehicle and
every trailer or semi-trailer which is being drawn at the end
of a train of vehicles shall during the time specified in
sub-paragraph (1) herein carry at the rear a lamp which
exhibits a yellow or red light plainly visible under normal
atmospheric conditions from a distance of five hundred feet
to the rear of such vehicle and which is so constructed and
placed that the number plate carried on the rear of such
vehicle shall under like conditions be so illuminated by a
white light as to be res~i from a distance of fifty feet to the
rear o~ such vehicle.

Every horse drawn vehicle driven upon the streets of
this City during the times specified in sub-paragraph (1)
herein shall carry at the rear of such vehicle a yellow or
red reflector plainly visible under normal atmospheric
condition~ at least two hundred feet from the. rear of such
vehicle.
(8) Clearance Lamuos. Every motor vehicle~
other than a road roller, ro~i machine, or farm tractor,
having a width at any part in excess of eighty inches shall
carry two clearance lamps or other suitable illuminating or
reflecting devices on the left side of such vehicle, one
located at the front and displaying a white light visible
under normal atmospheric conditions from a distance of five
hundred feet to the front of the vehi61e, and the other
located at the rear of the vehicl$ displaying a yellow or
red light visible under like conditions from a distaace of
five hundred feet to the rear of the vehicle.
(8) ,Bicycle Lights. Every bicycle during
the time specified in paragraph (1) of this section shall
be equipped with a lighted lamp on the front thereo£ visible
under normal atmospheric conditions from a distance of at
least three hundred feet in front of such bicycle, and shall
also be equipped with a reflex mirror o= lamp on the rear
displaying a yellow or red light visible under like conditions
from a distance of at least two hundred feet to the rear of
such bicycle.
(7) .Spot Lamps. Any motor vehicle may be
equipped with not to exceed two spot lamps except that a
mo~torcycle shall not be equipped with more than one Spot
lamp, and every lighted spot lmmp shall be so aimed and used
upon approaching another vehicle that no part of the beam
will be directed to the left of the center of the highway,
not more than one hundred feet ahe~i of t~e motor vehicle
upon which such lamp or la~s are mounted.
(8) Auxiliary Drivin~ Lamps. Any motor
vehicle may be equipped with not to exceed two auxiliary
driving lamps and one automatically controlled driving lamp
placed below the level of the stationary head lamps mounted
on the front at a height not less than twenty-four inches
above the level surface on which the vehicle stands.
(9) Signal Dam. ps. Whenever a ~motor vehicle
is equipped with a signal lamp to comply with the provisions
of paragraph (b) of Section X of this ordinance, the signal
lamp shall be so constructed and located on the vehicle as
to give a signal yellow or red in color, which shall be
plainly visible in normal sunlight from a distance of~ one
hundred feet to the rear of the vehicle but shall not project
a glaring or dazzlingm light.
(lC) .~equirement on Other Lamos. Any
device, other than head lamps~ spot lamps or auxiliary driving
lamps which projects a beam of light of an intensity greater
than twenty-five candlepower shall be so directed that no
part of the beam will strike the level of the surface on
which the vehicle stands at a distance of more than fifty
feet from the vehicle.
(ll) Heazi Lamp Glare. The head lamps of
motor vehicles shall be so constructed~ arranged~ and adjusted
that, except as herein provided~ they will at all times under
normal atmospheric conditions and on a level road produce a
driving light sufficient to render clearly discernible a
person two hundred feet ahead, but no head lamp or auxiliary
driving lamp shall pro~ect a glaring or dazzling light to
persons in front of such lamp.
Head lamps and auxiliary driving lamps shall be deemed
to comply with the provision herein prohibiting the projection
of glaring or dazzling lights if none of the main b~i ght
portion of the lamp beam rises above a horizontal plane
passing through the lsm~p centers, parallel to the level road
upon which the loaded vehicle stands and in no case higher
than forty-two inches, seventy-five feet ahead of the vehicle.
(lB) Dimmln~ Head Lamps. Whenever a motor
vehicle is being operated upon a highway, or a portion thereof,
which is sufficiently lighted to reveal a person on the high-~
way at a distance of two hundred feet ahead of the vehicle,
it shall be permissible to dim the head lamps or to tilt the
beams downward or to substitute therefor the light from an
auxiliary driving lamp or pair of such lamps subject to
restrictions as to tilted beams and auxiliary driving lamps
set forth in sub-paragraph (13) below.
(1J) Tiltin~ Head Lamos_ Whenever a motor
vehicle meets another vehicle on.any highway it shall be
permissible to tilt the beams of the he~l lamps downward or
to substitute therefor the light from ~ ~uxiliary driving
lamp or pair of such lamps subject to the requirement that
the tilted head lamps or auxiliary lamp or lamps shall give
sufficient illumination under normal atmospheric conditions
and on a level road to render clearly discernible a person
seventy-five feet ahead, but shall not project a glaring or
dazzling light to persons in front of the vehicle.
(14) Not Less Than Two Lamps on 'Opposite
Sides in Front. At least two lights shall be displayed on
the front of and on opposite sides of every motor vehicle
other than a motorcycle, roa~i roller~ road machine or farm
tractor, during the times specified in s~b-paragraph (1)
herein.
(15) Acetylene Head La~ps. ~otor vehicles
may be equipped with two acetylene head lamps or approximately
equal candlepower when equipped with clear plane glass fro~nt,
bright six-inch spherical mirrors and standard acetylene
five-eighths foot burner~ not more and not less and which do
not pro~ect a glaring or dazzling light into the eyes of
aPproaching drivers.
(16) Testing Vehicle Lights. The driver of
any motor vehicle equipped with approved hea~ lamps, auxiliary
driVing lamps, rear lamps or signal lamps, who is arrested
upon a charge that such lamps are improperly adjusted or are
equipped with bulbs of a candlepower not approved for use
therewith, shall be allowed forty-eight hours within which to
bring such lamps into conformance with the requirements of
this act. It shall be a defense to any such charge that the
person arrested produce in court or submit to the prosecuting
attorney a certificate from an ~ijusting station officially
designated by the Commissioner of Highways in ~ccord~nce with
the Uniform Highway Traffic Act, showing that within forty-
eight hours after such arrest such lamps have been made to
conform with the requirements of this act.
(17) Parking Lights. Whenever a motor
vehicle or street car is parked or stopped upon a highway
whether attended or unattended during the times mentioned in
paragraph (j), sub-paragraph (1) of this section, there shall
be displayed upon such motor vehicle or street car one or more

lamps projecting a white light visible under normal atmos-
pheric conditions from-a distance of five~ hundred feet to
the front of such motor vehicle or street car and projecting
a yellow or red light visible under like conditions from a
distance of five hundred feet to the rear.
(18) No Red or Green Lights in Front of
Vehicle. It shall be unlawful for any person to drive or
move any vehicle upon a highway with any red or green light
thereon visible from directly in front thereof. This section
shall not apply to any police or fire department or fire
patrol vehicle.
SECTION XVII. STOPPING AFTER AN ACCIDENT.
(a) Stop ReGuired and Information to Be Furnished.
The driver of any motor vehicle or street c~r involved in an
accident resulting in injury or death to any person or
damage to property shall immediately stop such vehicle or
street car at the scene of such accident and give his name,
address and, if a driver of a motor vehicle, the registration
number of his motor vehicle, and if a chauffeur, exhibit his
chauffeur's license to the person struck or the driver or
occupants of any vehicle or street car collided with.
(b) When Re'oort to the Police Is ReQuired. If such
person sustaining injury or damage is incapable of receiving
such information, then such driver shall forthwith communicate
such information to any police or peace officer or to the
Chief of Police and thereupon such driver shall request of
and receive from such police or pe~ce officer or Chief of
Police the name and address of such police or peace officer
to whom such information was communicated.

(c) Aid to the In~ured. Such driver sh~ll render to
any person injured in such accident reasonable assistance
aud, if a motor vehicle driver, shall carry such person to
a physician or surgeon for medical or surgical treatment if
it is apparent that such treatment is necessary or is request-
ed by the injured person.
SECTION XVIII. REPORTING DAMAGED VEHICLES.
(a) GaraEemen To Report Damaged Vehicles. The person
in charge of any garage or repair shop in this City to which
is brought any motor vehicle which shows evidence of having
been involved in a serious accident or struck by any bullet
shall report to the nearest police station forthwith and to
the Registrar of Motr Vehicles within twenty-four hours
after such motor vehicle is received, giving the engine
number, registration number, and the name and address of the
owner or operator of such vehicle.
SECTION XIX. ENFORCE~ENT.
(a) Duty of Police Department. It shall be the duty
of the Chief of Police, except as otherwise provided, to
enforce all the regulations and requirements of this ordinance.
(b) School Police. The ~ayor may appoint special
policemen who shall be designated as school police and shall
serve without compensation. The Said school police shall be
appointed from the student bodies of public and private schools
of this .City. Said school police shall be equipped with
badges marked "School Police" and are hereby authorized to
regulate traffic of all kinds upon the streets of this City
between the hours of 8:30 a.m. and 4 p.m. on school days.
The appointment of each of said school police shall designate
the streets~ upon which he shall have power to regulate
traffi~ and school police shall be subordinate to and
shall obey ~ll the orders of any regular police officer of
this City.
The drivers of ~ll vehicles or street cars sh~ll comply
with the directions or orders of s~id school police.
(c) Emergency Police Oz~iers. Any police officer in
this City in case of necessity or emergency~ or of congestion
of traffic, may make such special order to pedestrians or to
drivers of vehicles as in his judgment may be necessary to
meet the emergency or to relieve the congestion.
(d) ~ovin~ Violating. Vehicles. Whenever any police or
peace officer shall find a vehicle standing or parked upon a
highway in violation of the provisions of this ordinance~ he
is hereby ~uthorized to move such vehicle to a position
permitted under the section of this ordinance relating to
parked vehicles.
(e) Unauthorized Traffic Re~l~tion. No unauthorized
person shall regulate or attempt to regulate traffic upon the
highways of this City.
(f) Unofficial Signs. No person shall erect or maintain
upon any highway any warning or direction sign~ marker, signal
or light, except ~s authorized by the ~ity Council.
(g) Defacing Signs. No person shall deface, injure,
knock down, or remove any sign, marker, signal or light
placed or posted as provided in this ordinance.
(h) Traffic Lights. The use 'of red, green, or amber
lights on the highways for ~ivertising or for signaling
purposes, except as provided in this ordinance, is prohibited.

SECTION XX. VIOLATION AND PENALTIES.
(a) Violation in General. Every person violating any
of the provisions of this ordinance shall be deemed guilty
of a misdemeanor, and shall be punished by a fine of not more
than one hundred ($100.00) dollars ar~i the costs of prosecution
or by imprisonment in the city workhouse or jail for not
more than ninety days and in default.of payment of such fine
and costs by imprisonment in such jail or workhouse until
such fine and costs are satisfied as provided by law.
SECTION XXI. ENFORCE,%~ENT PROCEDURE.
(a) Immediate Hearing. In case any person shall be
taken into custody because of any violation of the pro-
visions of this ordinance he shall forthwith be taken before
the Municipal Court. If he be so taken before a magistrate
during usual business hours, he shall be entitled to an
immediate hearing, and if such hearing cannot reasonably be
had, or if he shall not desire it, he shall he released upon
giving a recognizance with sufficient sureties, or upon
depositing cash bail, in such amount as the magistrate shall
determine, to appear and answer for such violation at such
time and place as shall be fixed by the magistrate.
(b) Notification Slips_
(1) Served in Lieu of Arrest. In lieu of
taking any person into custody for a violation of the pro-
visions of this ordinance, a police offficer may serve a
written notice upon such person to appear before the Municipal
Court at a time and place fixed in said notice. Provided,
however, that in any case of a violation of the provisions of
paragraph (b), Section II, of this ordinance, relating to

intoxicated persons ~nd drug s~idicts~ or Section III, relmting
to c~reless driving, or of Section XVII, ~relmting to stopping
after ~ccidents, such officer shall not serve said written
notice in lieu of ~n ~rrest.
Provided, further, that no person upon whom a written
notice has been served in the manner provided for in this
section for ~ violation of the provisions of this ordinance
sh~ll· f~il to ~ppe~r before the ~unicip~l Court ~t the time
~nd place fixed in s~id notice.
(E) Form ~nd Information on T~s. Such
notice sh~ll be m~ie out on ~ triplicate form, ~nd sh~ll
indicate in addition to the information c~lled for in sub-
paragraph (1) of this p~ragr~ph, the time, d~te~ ~nd n~ture
of violation~ ~nd in the c~se of ~ motor vehicle, the motor
vehicle license number.
(~) Disposition ~nd AuditinE of Notification
Slips. The police officer serving the written notice provided
for in this section sh~ll deliver one copy of such notice to
the person violmting any of the provisions of this ordinance,
or ~ffix the s~id copy in ~ prominent place on or within the
vehicle, one copy of such notice to the Chief of Police, ~nd
one copy to the Judge of the ~unicip~l Court.
SECTION XXII. VALIDITY.
If ~ny p&rt or p~rts of this ordinance sh~ll be held in-
valid, such invalidity shmll not ~f£ect the v~lidity of the
remaining p~rts. The City Council hereby ~ecl~res that it
would h~ve p~ssed the remaining p~rts of this ordinance if
i~t hs~i known that such p~rt or p~rts thereof would be declared
invmlid.
SECTION XXIII. P3PEAL.
All ordinances ani parts of oriinance inconsistent
with the provisions of this ordinance are hereby repealed.
SECTION XXIV. WHEAT EFFECTIVE.
This ordinance shall take effeot and be in foroe
immediately upon its passage.
SECTION XXV. ORDINANCE TO BE POSTED.
The City Clerk is hereby authorized and directed to
cause typewritten copies of this ordinance to be posted
upon ten bulletin boards located in the most public places
of the City for a period of two weeks.
