AhrDREPEALI..G INCONSISTENT PROVISIOh~S AN ORDINANCE REGULATING THE FIRE DEPARTMENT OF THE CITY OF COL~BIA HEIGHTS: THE CITY OF COLUMBIA HEIGHTS DOES ORDAIN: Section 1. Personnel of Fire Department. The personnel Of the Fire Department of the City of Columbia Heights shall consist of the membership of the Columbia Heights Volunteer Fire Department, and all such other oersons who have been recommended by the fire chief, and who have served their probationary period, and have been accepted by the City ~.~snager. Said personnel shall be under the direction of the Fire Chief who shall be appointed by the City Manager from the membership of the Fire Department. Section 2. Duties of the Fire Chief. The Fire Chief shall have control over all of the fire apparatus and stations and shall be solely responsible for their care and condition. He shall make an annual report to the City ~.nager setting forth the work of the Fire Department during the year preceding the re- oort, the condition of the equipment and the anticipated needs of the depart- ment for the ensuing year. He may submit additional reoorts and recommendations at any time to the City Manager. He shall be resoousible for the proper train- ing s.nd discipline of the members of the department. Section 3. Record of Fires. The Fire Chief shall keep in convenient form s. complete record of all fires. Such record shall include the time of the alarm, location of fire, cause of fire (if known), type of building, name of owner and tenant, purpose for which occupied, value of building and contents, members of department responding to alarm, and such other information as he may deem advisable or as may be reouired from time to time by the City Mans~ger or state insurance department. Section 4. Drills. It shall be the duty of the Fire Chief to hold monthly drills of at least one hour's duration for the Fire Deoartment, and to give the firemen instruction in approved methods of fire fighting and fire pre- vention. Section 5. Fire Narshal. The office of Fire Narshal is hereby established. The Fire ~arshal shall h~ve full authority to inspect all premises to discover fire hazards and to cause their removal, and to enforce all legal fire prevention me~.sures. He shall be appointed by the City Nanager from the membership of the Fire Department. The Fire Narshal shall inspect every public building,~olace of business and factory within the city limits at least twice a year, and hold fire drill in each school building at least twice ~ring the fall term and twice during the spring term of each school year. Any person refusing or neglecting to comply with any lawful re- quest or direction of the Fire Narshal, made pursuant to his duties as such marshal shall be guilty of violating this ordinance. Section 8. Compensation of Firemen. The members of the Fire Department shall receive as compensation for their services the following sums: Two (~2.00) Dollars for each alarm responded to on and between the first day of A0ril and the last day of September of each year, ~d T~ree (~$.00) Dollars for each alarm r~- soonded to on and between the first day of October and the last day of ~arch of the succeeding year. Provided however that the Fire Chief shall receive one ($1.00) Dollar additional for each alarm responded to; and provided further that the ccmpen- sation of the Fire Narshat shall be set annually by Resolution of the Council. Mothing in this ordinance shall prevent the City Council from providing additional compensation when in its discretion the sunm provided for above seem inadeeuate. Section 7. False Alarms. It shall be unlawful for any person to give or cause to be given a false alarm or in any manner to tamper with or interfere with the fire alarm system. Section 8. Traffic. No street c~r, steam engine or other vehicle sh~ll be driven over hose laid out at any fire or at the scene of any~arm of fire, exceot at the direction or comm~nd of a police officer o~ member of the Fire ~epartment. Upon the a0proach of any fire department vehicle giving audible signal by bell, siren or exhaust whistle, the driver of every other vehicle shall i~mediately drive the same to a oosltion as near as possible and parallel to the right hand edge or curb of the street, clear of any intersection, and. shall stop and remain in such position unless otherwise directed by a police office or member of the Fire Depart- ment, until the Fire Department vehicles have oassed. It sh~ll be unlawful for the driver of any vehicle to follow any fire aooaratus traveling in response to a fire alarm closer than five hundred (~00) feet~ or to drive into or park such vehicle within the block which such fire apparatus is ~o~ed in answer to a fire alarm, un- less ~ermitted to do so by ~. police officer or member of the ~ire Department. Section 9. Spectators at Fire. The member of~ the Fire Department in command of any fire shall have authority to establish a zone of dauger within which no person except members of the Fire Department or Police Department shall enter unless direct- ed or ~ermitted to do so by such member in co~m~nd, and no person except the owner, if he be the occupant, or teuant of the premises or member of the household of such owner or tenant, if the property be a residence, or employee of the owner or tenant, if the premises be other than a residence, shall enter upon the premises which is the scene of a fire or alarm of fire, unless directed to do so by the member of the Fire Depart- ment in command of the fire, Section 10. 0rderinM Citizens to Assist Fire Department. The member o'f the Fire Deoartmeut in command of any fire s_hall have authority to comn~nd any citizen to assist in protecting life and property, when in the judgment of such member, an emergency dictates the necessity for such assistance. Section ll. Removal of Property Endangered by Tire. The member of the Fire Department in command at any fire shall have power to cause the removal of any oroo- erty, whenever it shall become necessary for the ~reservation of such property from fire, or to prevent the spreading of fire, or to protect adjoining property, and to that end may enter or order any member of the Fire Department to enter premises in- volved in danger or endangering other property. Section 12. Demolishing of Buildings. The member of the Fire Department in command at any fire shall have authority to demolish any building or structure during a fire or other extreme emergency to orevent a conflagration. Provided however, that no building or structure shall be blown up or otherwise destroyed for the purpose of checking the progress of any fire, except in case of absolute necessity, and then only upon order of the member of the department in command at the fire. Section l~. Obstructing Fire H~drants. It shall be unlawful for any ~e~son to in ~ny way obstruct a fire hydrant. The parking of any vehicle, or permitting it to stznd, whether attended or unattended, within fifteen (18) feet in either direction of a fire hydrant shall be deemed an obstruction of such hydrant within the meaning of thi~ ordinance. Section 14. Burning of Rubbish. It shall be unlawful for any oerson to burn paper or other waste material generally known of as rubbish within two hundred (200) feet of any building or structure, unless the same be burned in a container. It shall be unlawful to burn rubbish or waste material of any kind in any city street or on the boulevards aoourtenant thereto. ~ S.ection 15. Ftzmigation - Notice to be Given Fire Chief and Chief of Police. No oremises within the City of Columbia Heights shall be fumigated with any deadly or poisonous gas, or other dangerous or deadly material, unless the owner or occuoant of such oremises shall have, at least twenty-four hours before such fumigating is to com- mence, delivered to the Fire Chief and Chief of Police, a written notice that such fumigating is to be done. Such notice shall contain the street address of the premises to be furmigated, the time when such fumigating is to con-hence, and the time when it shall again be safe to enter such premises. The Fire Chief shall post such notice uoon the alarm board before the time indicated in such notice as the time at which the fumigating shall commence. The Chief of Police shall post the notice in a con- spicuous place in the police station, before s~ch fumigating is to commence. Section 16. Police Powers Granted Members of Fire Deoartment. At all times when the Fire Department is traveling to a fire or the scene of an alarm of fire, present at a fire or the scene of an alarm of fire, all members of the Fire Depart- ment shall be vested with oolice cowers to enforce the orovisions of this ordinance, and to make arrests for the violation thereof. Section l?. Penalties. Any oerson violating any of the provisions of this ordinance shall be guilty of a misdemeanor and uoon conviction shall be ounished by a fine of not less than Ten ($10.00) Dollars or more than One Hundred ($100.00) Dollars, or tmorisonment of not less than ten (10) days or more th~n ninety (90) or both days, plus in either case the costs of the prosecution. Section 18. Time of Taking Effect. This ordinance shall take effect and be in force thirty (30) days after its passage. NARY ED;YARDS, Secy to Comucil.
