AN ORDINANCE FOR THE E~PL0¥~IENT OF EMPLOYES OF THE
CITY OF COL~R,IB!A HEIGHTS ON 5T~E BASIS OF ~J~iRIT ONLY, AND TO
PROVIDE FOR A PUB~I8 HEARING OF CHARGES A,GAINST A .DISCHARGED
EMPLOYE.

Section 1. Employes ~to .be AppOinted on Merits:- All
effiee~s and employesof this e'i~y, ~xeept whe~e the~e are
cha~ter~ proMisi~ns governing thei.~q~alifieations and terms
office, ?hall he~eafte~ be appointed bY tho ~espeetive appointing
o£fiee~ o~ body upon the basis of.ability and fitness to perform
the services in the ~espeetiVe position to which appointment is
contemplated.
~.Seetion' 2. Te~m of'Appointment:- All officers and
employes of ths city except as otherwise provided by
shall be appointed to thei~pOsitions without definite term, and

~orm the duties of the position, or fo~ other cause deemed
sufficient by the city Esnage~. Provided however, that nothing

Seet,~,o~.3. ~Public Hearing fo~. Discharged ~p!oye.:- In
ease any o£fice~ or employe, whose qualifications, appointment
and teen of office are no~gove~ned by the city eharte~, is dis-
missed or discharged, he may petition the city council for a p~b-
lic hearing, setting o~t in such petition the g~ounds ~pon which
such public hearing is ~equested. The council shall upon the ~eceipt
of any such petition i,~mediately refer the matte~ to the
shall thereupon make provisions for a public hearing to
be held not more than twenty, days after ,such petition is
referred to it, A no'ice of such ~blic hearing shall be
~ the usual manner of p~ting public notices, not less
than ten days prior to the date set for such hearing. The

w~itten and oral.testimony from the city manager, the agg-
rieved employe and~other competent sources. After due con-
sideration of the evidence presented the ~ ~

recommendations to the city 'c~ncil at its next regular meeting.
he council may after consideration of s~ch findings ~d rec-
ommendations by a~vote ~ecommend to the city manager that
such employe be ~einstated.
Section 4. Time of Takinf Effe~t;~ This ordinance
shall take effec~ and be in force thi~y (30) days after its
passage.
