HomeMy WebLinkAboutOrdinance 119~hkT 0RDiN~LNCE TO REGULATE TI~E LICENSING AND M~Ti~R OF CONDUCTING D~CES. The City Council of the City of Columbia Heights dees ordain: Section 1. State Law to Govern:-- All dances held in this city hereafter shall be conducted in accordance with the provisions of Chapter 13.9 of the Session Laws of Minnesota for 1923 not specifically incorporated herein, regulating the con- duct of dances as heretofore or hereafter amended. The defini- tion of terms in the first section of said act are hereby adop~ ted except that where the entire proceeds of any dance are to be devoted to benevolent, fraternal, educational or charitable purposes such dance shall be classified as and termed a semi- public dance ~.nd shall be regulated according to the provisions of this ordinance hereinafter set out. Section 2. Permits -- No person shall conduct a public dance in this city unless a permit shall have been procured there- for from the city clerk. The fees for such permits shall be as follows: One. day .......... $ ~ ~°° 0ne week. ....... 4.00 One month....,.. ~.~ One year ....... , 75.00 Provided that the city council'~may grant a permit for a semi- public dance without charge. Section 3. ApplicatiOn -- Andy person desiring a permit to hold or conduct a public dance in this city shall make appli- cation therefor on blanks furnished by the city clerk. The app- lication shall set forth the name and address of the person, persons, committee, or organization which is to conduct the dance; time and place where such dance is to be held; and the area of the dance floor. The application shall also show affirm- atively that each of the applicants is a person of good moral character and reputation in the community ~in which he lives, and that none of the applicants has within five years prior to the making of such application been convicted of a felony, gross misdemeanor, or of violating any of the provisions of Chapter 139 of the Session Laws of Minnesota for 19£5 or any ordinance or law regulating dances anywhere in the United States; also that no one of the applicants is a keeper of any disorderly house of any kind; also that the place where the dance is to be conducted does not haVe any so-called "private apartments" or "private rooms" furnished or used for any purpose other than legitimate business purposes which adjoin such dancing places or whcih may be reached by elevator, stairway or pass- ageway leading from such dancing place; also that the place where the dance is to be given is properly ventilated and 9quipped with necessary toilets, wash rooms and lighting fac- ilities. Such application shall also be accompanied by the affidavit of two freeholders in the city to the effect that they have read the application as signed by the applicant and that all the statements made therein are true to their own personal knowledge. Section 4. Granting of a Permit. Permit to be Posted -- The city clerk shall refer, such application and the accompanying affidavits to the ~ouncil, which in its discretion may grant or refuse to grant the permit applied for. In case the application for permit be granted by the council the city clerk shall issue a permit. The said permit shall be posted in a public place in the dance hall described therein dUring the time the dance is being given, and the person named in the permit shall be responsible unde~ the law for the manner in which such dance is held and conducted. Section 5~ Police Officer to be Present.-- It shall be incumbent upon the person to whom said permit is issued to have a police officer of the City of Columbia Heights present at every public dance to be given or held thereunder during all the time said dance is being held. The officer shall receive for his ser- vices the sum of Three ($3.00) Dollars for each dance so attended and shall not permit such dance to commence until he has been presented with a receipt issued by the city clerk showing that the said sum of Three ($~.00) Dollars has been paid. The officer shall upon ~resentation of said receipt to the city clerk after the said dance for which the said sum has been paid be entitled to receive from the city clerk the said sum of Three ($~.00) Dollars so paid. Section 8. Application for Semi-Public Dance -- person or organization desiring to conduct a semi-public dance, within the meaning of this ordinance, in this city may apply for a permit by a letter addressed to the city council. Such letter shall state the name of the person or organization requesting such permit; the place and time where such dance is proposed to be held and the purpose for which the entire proceeds from such dance are to be applied. Section 7. Grant of Permit for Semi-Public Dance -- As hereinbefore provided the city council may grant a permit for semi-public dance wiEhout charge, e~cept that the provisions of section 5 of this ordinance providing for the presence of a police officer and the payment ~or~his~s~rvices shall apply to semi- public dances. Section 8. Hours.-- Eo public dance or semi-public dance shall continue or be held by anyone on any day between the hours of l~ o'clock p.m. and six otclock a.m. All public dance halls and places for holding public or semi-public dances in the City of Columbia Heights shall be closed at or before the hour of o'clock a.m. Section 9t. Intoxicati~ LiQuors Prohibited -- No person shall at any time during which a public Or~mi_public dance is being held , take upon the p~emises or have in his possession upon the premises where such public or semi-public dance is being held, or dispose o~, sell, or give away, use or drink any intox- icating liquor or beverage upon such premises, during the time when my public or semi-public dance is being held thereon. Provided however that this section shall not apply to cafes, restaurants or hotels holding licenses permitting both the sale of intoxicating liquors for cons~ption on the premises and the conduct of public dances. Section 10..Pass-out Checks Prohibited -- No person in charge of or conducting wy public or semi-public dance shall issue or pormit the issu~ce of pess-out checks, so called, or any pass or checks or doc~ents or tokens, which will entitle the holder thereof to depart from and return to a public dance or semi-p~lic d~ce without again' paying the regular enterance fee. Section ll. Permits Revokable -- my permit to conduct a public or semi public d~ce issued ~der the provisions of this ordinance may be revoked at wy time by the Mayor or City Section lZ. Penalty~ Definitions~ Effective Date -- My person violating any of the provisions of this ordinance shall be guilty of a misdemeanor p~ishable by a fine of not less than /~~-/ Dollars($/o.~) or more than One Hunted Doll,s (~100.00) or impriso~ent for not less th~ ninety (90) days., or both, plus in either case the costs ~ the prosecution. The word "person" as used in this ordinance shall include any firm, partnership, club or association of any kind, and corporations. This ordinance shall t~e effect and be in force from ~d after thirty (50) days after its passage.
