HomeMy WebLinkAboutResolution 80-57 RESOLUTION 80- 57 BEING A RESOLUTION REGARDING AN ADDENDUM TO THE MASTER CONTRACT FOR MEMBERS OF LOCAL 49 BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights that: WHEREAS, negotiations have proceeded between the International Union of Operating Engineers, Local 49, representing the City's Public Works employees, and members of the City negotiating team, and said negotia- tions have resulted in a mutually acceptable addendum to the master con- tract for the period ending December 31, 1981, NOW, THEREFORE, BE IT RESOLVED that the addendum to the master contract as negotiated be and is hereby established as part of the wage and fringe benefit program for the period ending December 31, 1981, for eligibl~e em- ployees of the Columbia Heights' Public Works' Department. BE IT FURTHER RESOLVED that the Mayor and City Manager be authorized to execute this addendum agreement. Passed this 22nd day of September , 1980. Offered by: Heintz Seconded by: Hentges Roll Call: All Ayes Mayor retary /~ounc ikl Sec ~' APPENDIX B LOCAL ADDENDUM This supplementary agreement is entered into between the City of Columbia Heights and the International Union of Operating Engineers, Local No. AFL-CIO, for the period beginning January l, ]980 and ending December 31, 1981. Nothing in this supplementary agreement may be in c~nflict with any pro- vision of the RASTER AGREEHENT between HAJ~A, the City of Columbia Heights and I.U.O.E., Local No. hg, AFL-CIO. In the event of conflict, the NASTER AGREEHENT will prevail. APPENDIX B Wage Schedule The following wage schedule for 1980, exclusive of all supplemental pay, is hereby established for all job classifications and their respective working job titles herein listed for the duration of the contract. Foreman ' Maintenance Worker II (H.E.O.) -Heavy Equipment Operator -Sr. Sewer & Water Maintenance Worker -Sr. Parkkeeper -Mechanic -Body & Sign Worker Maintenance Worker I (L.E.O.) -Light Equipment Operator -Sewer $ Water Maintenance Worker -Parkkeeper Laborers & Part-time Helpers -Meter Reader · $9.06 per hour $8.57 per hour $8.12 per hour $3.36-$6.97 per hour In the absence of a department superintendent when a member of the department is instructed by the Pub]lc Works Director to assume the responsibi]ities for said department head, the employee assigned to these duties will be paid $.30 per hour over heavy equipment operator scale. bo The City will pay $.O5 and $.10 per hour respectively for the working job titles of Parkkeeper, and Sewer & Water Maintenance Worker in the Maintenance Worker I (L.E.O.) job classification. Such payments will apply only to those employees hired in the above working job titles prior to January ], 1980. Employees hired in the working job title of Parkkeeper and Sewer & Water Maintenance Worker after January 1, 1980, will be compensated at the Maintenance Worker I (L.E.O.) classification rate. The $.05 and $.10 per hour increment pay for the above working job titles will be effective the first pay- roll period of 1980; however, such payments shall not apply to working out-of-classification pay. The $.O5 and $.10 per hour increment pay respectively shall not apply to the working job tit]es of Parkkeeper and Sewer & Water Maintenance Worker when employees with such working job titles are assigned out of their respective departments of Park and Sewer & Water. do Minnesota State Certifications (1.) City Sewer and Water Maintenance Worker shall be granted a $.05 per hour pay. supplement for regular working hours for qualifying for, and submitting to the City, a Certification for Sewer or Water Works Operators as required by the State Department of Health. Parkkeeper and Street Department employees shall be granted a $.05 per hour pay supplement for regular working hours for qual|fying for, and submitting to the City, a Certification for Tree Inspector as required by the Department of Agriculture division of plant industry. Payment for same to be made by voucher twice annually in June and December. Page 1 (2.) Taking of Certification examinations shall be allowed for up to two Sewer and Water Department men per year at the annual Sewer and Water Works School at the Minnesota Health Oepartment and up to two Parkkeeper and/or Street Department men per year at the Department of Agriculture. Certification supplement allotment shall be allowed for employeeswlth the working job tltle of Sewer and Water Maintenance Worker only. Tree Inspector certifi- cation supplement shall be allowed for employees with the working job titles of Parkkeeper and/or Light Equipment Operator. o Working-Out-of-Classification a. Employees required by the employer and who are ajudged by the ~ employer to be qualified to operate the following items of equip- ment will be paid the Heavy Equipment Operator (Maintenance Worker II) rate of pay for those hours assigned to the unit: Front End Loaders Street Sweepers Backhoes Graders Oil Distributor Operator Employees required by the employer and who are ajudged by the employer to be qualified by the employer to operate the following items of equipment will be paid $.20 over the Light Equipment Operator (Main- tenance Worker I) rate of pay for those hours assigned to the unit: Boom Operator Wayne Brush Chipper c. Any payments for working out-of-classification pay will be effective with the signing of the Local Addendum Agreement. Uniforms The employer will supply those uniforms and equipment items which the City requires employees to wear and/or use. Employees will be responsi- ble for the maintenance and cleaning of their City-supplied uniforms. Rest Periods During the normal work day, two rest periods (one in the morning and one in the afternoon) will be provided under the following conditions: a. Rest periods will be taken at times approved by the employer. b. Rest period shall not exceed fifteen (15) minutes. c. Employees shall remain at their work sites during approved rest periods. d. Rest periods shall not interfere with or prevent City services or operations. Page 2 Vacations a. Each permanent and probationary employee shall accrue vacation time on the following basis: 10 days per year after completion of 1 to ~ years 11 days per year after completion of 6 years 12 days per year after completion of 7 years 13 days per year after completion of 8 years 14 days per year after completion of ~ years !~ days per year after completion of 10 years 16 days per year after completion of 11 years 17 days per year after completion of 12 years 18 days per year after completion of 13 years 19 days per year after completion of 14 years 20 days per year after completion of 15 years and over Any employee leaving the municipal service in good standing after giving proper notice of such termination of employment shall be compensated for vacation leave accrued tq the date of separation. Co Vacation leave is intended as a period of rest and relaxation and may not be waived by an employee for the purpose of receiving double pay. Sick Leave a. Sick leave pay shall be granted to all probationary and permanent employees at the rate of one working day for each calendar month of fu]l time service or major fraction thereof, except that sick leave granted probationary employees shall not be available for use until satisfactory completion of the initial probationary period. Promo- tiona] probationary emp]oyees may make use of sick leave; however, if the sick leave exceeds a total of five (~) working days, the probationary period shall automatically be extended a like period of time. bo Sick leave may be accumulated to a maximum of 120 days. One-half of the sick leave in excess of 120 days shall be granted as additlonal annual vacation leave the calendar year after such surplus is earned. Co Sick leave may be granted only for absence from duty because of per- sonal illness or disability, legal quarantine, or death, or serious illness in the immediate family. The immediate family is defined as the following kin of either the employee or the employee's spouse: children, mother, father, sister, brother or grandparents. d. Severance pay equivalent to 1/3 of accumulated sick leave will be paid upon termination of service. 7. Funeral Leave ae Employees are allowed funeral leave of up to three days for death in the immediate family including spouse, mother, father, or children. That time is not chargeable against any accrued vacation or sick leave. Funeral leave for brothers, sisters, and in-laws (spousets family) is granted up to three days, deductable from sick leave or vacation as the employee may choose. Page 3 o 10. Leave of Absence Without Pay Upon request of an officer or employee, leave of absence without pay may be granted by the City Manager, taking into consideration good conduct, length of service, and efficiency of the employee and the general good of the municipal service. Such leave of absence shall not exceed a period of ninety (90} days; provided that the same may be ex- tended beyond such period if the leave of absence is for continued disability or other good and sufficient reasons, but in no case to exceed one ()) year, except when the employee is detailed for military service or is disabled for disability incurred while in the service of the City. No vacation, sick leave, holiday or other benefits shall be accrued during a period of leave of absence without pay. Holidays a. The following legal holidays shall be ob[erved as paid holidays for City employees, except as noted in Section b: New Year's Day President's Day Good Friday Memorial Day Independence Day Floating Holiday (as designated by the employer) Labor Day Columbus Day Veteran's Day Thanksgiving Day Christmas Day bo When New Year's Day, Independence Day, or Christmas Day fall on Sunday, the following Monday shall be observed as a holiday. When they fall on Saturday, the preceding Friday shall be observed as a holiday. Employees absent from work on the day following or the day preceding such a three-day holiday weekend without the express authorization of the City Manager, shall forfeit their rights to holiday pay for that holiday. Separation a. Resignation--Any emp)oyee wishing to leave the munic|pal service in good standing shall file with his department head, at least fourteen (lq) days before leaving, a written resignation stating the effective date of the resignation and the reason for leaving. Unauthorized absence from work for a period of three working days may be considered by the City Manager as a resignation without benefits. Retirement--Except as otherwise provided by law, it is compulsory that employees covered by this ordinance shall be retired when they attain the age of 65 years. The age of any employee shall be the age attained on his/her last birthday and shall be subject to verifi- cation. 11. Life Insurance Life insurance of $5,000 shall be granted to each employee by the City. Employees may, at their own expense, purchase additional life insurance for themselves or their dependents. Weekend Out~ The weekend duty schedule for standby shall be continued with the duty man to receive two hours overtime pay for each day he is assigned duty. injury-On-Duty Injury-on-duty shall qualify a man for workman's compensation pay in accordance with the state laws governing same. A man may turn in his workman's compensation check and buy back, on a dollar for dollar basis, sick leave time charged for his absence. Education Tuition and book expense for job-related schooling will continue to be paid provided prior approval for the course work is granted and a grade of "C" or its equivalent is received in the course.
