HENTGES, COUNCILMAN "SERVICE IS OUR BUSINESS" RESOLUTION #76- 48 BE t f!C~ A RESOLUT J ON AUTHOR t Z t NG AN AGREE,~",ENT With THE HOUSING AND REDEVELOPHENT AUTHORITY OF COLUHBiA HEIGHTS, Hi'N~,!ESOTA WHEP, EAS, the City Council in attempting to provide a fire safety system for the Sen[or Citizenls high rise appropriated the sum of $6~,OO0 to the Housing and Redeveiopment Authority of Coiumbia Heights, Hinnesota~ and WHEREAS, the said fire safety system ultimat~:~]y became an e, ligib}c project cost reimburs,~d by the Department of Housing am~ Urban elopment~ and WHEREAS, the Housing and Redevelopment Autt~ori?y and City Council now wis[; to enter into agre. er~nt which would a] ]ocat~ the said monies in the best interests of the taxpayers of the City of Co!umbia Heights, NO\'! THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COL- UHBIA HEIG!!TS, 1. That the Hayor and City ,~,;anager be authorized to enter into the fo]lowing agreement: A. That the Housing and Redevelopment Authority be authorized tm place the said sum of $6~,000 in ~ ?roj~c~ to a Special ..... Fund be lloceted as fo]lows: Downtown Revitalization ........ Community Action Horna Winterization ........ 2,000 West Side Centre! Avenue Rehabilitation ........ 8,000 '~,000 B. That tl,e Downtown Revitalization Fund shall be used for the purchase of the properties at ~037 and 402t Van Buren Street Hortheest ~'~ the CTty of Columbia Heights, commonly known as the Wetdon and Voss ties, that said parcels shal! be used for parking lots to serve the business community in their vicinity. That the ltousin9 and Redevelopment Authority shall make pay- ments to the City of Columbia Heights in lieu of taxes in an amount of at least equal to the taxes currently levied against such parcels. That the Housing ~nd Redev- elopment Authority shall make a good faith effort to ob- tain rental payments from the businesses who are benefited by the parking availability. No funds in the Dewntown Re- vitalization fund may be used for any purposes other than the acquisition and improvement, along with expenses in- cidental thereto, of the aforementioned psrcets. Should the Housing and Redevelopment Authority ~ot have acquired the said parcels on or before Hay 31~ t977, alt monies remaining in the Downtown Revitalizatipn'.fund shall be immediately paid to the City of Columbia Hei~ht~. Should the Housing a~d Redevelopment Authority be unable to enter into lease arrangements such that the continued ownership of the parcel or parcels by the Housing and Redevelopment Auth- ority is not economically feasible, the Housing and Redevel- opment Authority shall convey the parcel or parcels purchased hereunder to the City of Columbia Heights by warranty deed without further payment by the City. The City Council of the City of Columbia Heigl~ts shall have the sole discretion to determine the economic feasibility and shall no~ make its judgements regarding economic feasibility and continued owner- ship by the Housing and Redevelopment Authority prior to Dec- ember 31, 1978. This agreement may not be varied without the express written consent of the City Council or except by mutual agreement of ~he City Council and ~he Housing and Redevelopment Authority. 2. This resolution shall constitute a binding agreement between the City of Columbia Heights and the Housing and Redevelopment Authority upon the Housing and Redevelopment Authority passing a resolution accepting the terms hereof at any time more than thi~rty (30) d~ys after the passage of this resolution. Should the Housing and Redevelopment Authority pass a resolution witlain thirty (30) days of the passage of this resolution, the agreement contained herein shall be in full force and effect from and after thirty '(30) days of the passage of this resolution.
