HENTGES, COUNCILMAN "SERVICE IS OUR BUSINESS" ~SOLUTION NO. 76--16 P~EGf~fRDING ~iE SIGN REQUEST OF Cf~-JX SYST~'~ BE IT HEP,~EBY RESOLVED BY T~LE CI~f COIR~CIL OF T~ CITY OF COLIq,~IA IiE!GHTS, that i~{E~EAS, Car-X S~stems has applied for a sign Dermit to e!io~ the inste!].at:ion of a sign to advertise its business at 45th and Central Avenue Northeast, Columbia Heights, and ~=HEREAS~ the said sign is designed to have an ~dvertising surface on each of its two opposing side,s-, each of which side displays ~.~o square feet of adver- tising surface, and ~2HEREAS, the Columbia Heights Planning and Zoning Commission has denied the application for such permit, end ~i~P~EAS~ the City of Co!~m~bia Heights in the past and on one accession ~ith~n six months prior to this date has administratively issued sign permits for a sign of this size to other a?plicants, and ,~ ..... AS, Car-X Systems entered into a contract for the expenditure o~ a~proximate!y $2,200,00 based on its knowledge that another sign ef the mizc requested herein had been installed within the past six m~>ntha in the City pursuant to a sign permit issued by the City, and ~HELEAS, the City Council finds~that Car-X Systems ~zJ.!l in all probability suffer a substantial economic loss because of the change in its economic position taken in reliance that the Car-X Systems would be issued a sign pezmi~ for the size of sign set out herein~ and ~,R{EREAS~ the City Council does not intend to set a policy of allowing variances for sign permits in the future based on economic considerations~ but because of the circumstances set ou~ herein the Ci.ty Council f!nd~ tha~ adherence to the literal provisions of the Co!u~ia Heights sign ordinance would canse undue hardship to ~he property o~er and that in fairness to 'the a~p!ican~ it should ih this ease grant such a veriance~ NOW THEREFORE, BE IT RESOLVED BY THE. CITY COLq~CIL OF THE CITY OF COL%%~tA HEIGHTS that the appeal of Car-X Systems be granted and that it be allowed to install the type and size of sign applied for in its February, 1976 application. Further, the Colu~,bia Heights bui%ding inspector is directed to issue a sign permit to instal], the sign as described within such application.
