HomeMy WebLinkAboutResolution 76-11 RESOLUTION #76-11 BEING A RESOLUTION ENDORSING A BILL FOR AN ACT RELATING TO PUBLIC SAFETY PERSONNEL IN THE CITY OF COLUMBIA HEIGHTS BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLUMBIA HEIGHTS, that WHEREAS, the City of Columbia Heights would be benefitted by a more flexible system of direction of its public safety functions, and WHEREAS, the policy goals of the voters of the City of Columbia Heights can best be served by making certain public safety personnel more directly responsible to the public officials elected by the voters, and WHEREAS, the elected governing body of the City of Columbia Heights can best direct and implement its policies through personnel over which it has control, NOW, THEREFORE, BE IT RESOLVED that the exhibit attached hereto and made a part hereof, the reading of which is waived, entitled "A Bill For An Act Relating to Public Safety Personnel in the City of Columbia Heights", be enacted into law by the Minnesota State Legislature, and BE IT FURTHER RESOLVED, that the Mayor and City Manager be and herein are authorized to work with our local senators and representatives to effect passage of the said Bill. Nawrocki, Mayor Secreta ~/y A BILL FOR ~2J ACT Relating to Public Safety Personnel in the City of Columbia Heights; BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: Section 1. Notwithstanding any general law, special law, or charter provision to the contrary, the City Council of the City of Columbia ~eights shall have the authority to establish a Department of Public Safety which shall include the police and fire departments of the City. Segtion 2. The Mayor, subject to approval by 4/5 of the governing body, shall have the absolute control and supervision over the appointment, employment, promotion, discharge, and suspension of any or all persons filling the positions of public safety director, fire chief, police chief, and all other persons within the Department of Public Safety. That the public safety director may serve'as either Section 3. police or fire chief. Section 4. That the said positions of fire chief, police chief and public safety director of the City of Columbia Heights shall be and herein are exempt from civil service regulation and are exempt from the provisions of Minnesota Statutes Chapters 419 and 420, as amended. Section 5. Any persons filling the positions of fire chief, police chief, or public safety director of the City of Columbia Heights firs~ hired by the City of Columbia Heights after the effective date of this chapter shall become members of the Public Employees Retirement Association Public Safety Division and shall not be members of any local relief association. Section 6. This act shall become effective only after its approval by a majority vote of the governing body of the City of Columbia Heights and upon compliance with the provisions of Minnesota Statutes 645.021.
