HomeMy WebLinkAboutResolution 73-28CITY OF COLUMBIA HEIGHTS ADMINISTRATIVE OFFICES · COLUMBIA HEIGHTS, MINNESOTA 55421 RESOLUTION #73-28 REGA~NG PRIVATE PENSION PLANS FOR POLICE AND FIRE DEPARTMENTS IN THE CITY OF COLUMBIA HEIGHTS. BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights, that WHEREAS, pri'vate pension ptans were established by agreement with the Police and Ftre Departments where the City agreed to levy up to 1½ mills per year for each department with the members of these pension associations admintstering the pension program setting benefits consistent with the available funding, and WHEREAS, in 1969 a legislative session abolished this private agreement by the 1969 Guidelines Act necessitating taxpayers contributions far in excess of the 1½ mill tax ceililng pensions originally established and has caused a pension program system which has worked a hardskip on the taxpayers, and WHEREAS, during the collective bargaining process with these respective Police and Fire Departments, accord was reached ~herein the employee representatives agreed not to oppose the placement of new employees tn the Public Safety P.E.R.A. pension system and agreed upon a fixed salary base upon which pension contri'butions and computations would be calculated, and WHEREAS, the Hewttt Plan which has been proposed merely delays but does not reduce the fiscal import to the taxpayers of the City of Columbia Heights, and WHEREAS, it ts essential that the Council be fiscally responsible to the taxpayers they represent, and, in order to do so, appropriate legislation must be enacted authoriztng fair and equitable procedures in pension administration, and - 2 - NOW, THEREFORE, BE IT RESOLVED that the Ci~ty of Columbia Heights urges the Legislature to support the following legislation: Increase the insurance rebate on automobile insurance poli. cies from one (1) percent to two (2) percent to help f~nance police pensions. 2. H.F. '1468 (S.F. 1709) as amended. BE IT FURTHER RESOLVED that if the Legislature does not support item number two (2) above, that the Legislature support pr'ivate legislation for the C~ty of Columbia Heights recognizing the validity of the 1972 Charter Amendment in which newly employed Police Off~cer~ would be members of the Public Safety PERA pension system and recognizing the negotiated salary level a~ a base for ~n~[on purposes. That said private bill should set standards that would provide fiscal relief to the taxpayers of the C~ty of Columbia Heights. BE IT FURTHER RESOLVED that the City Council of the City of Columbia Heights urges the Legislature not to support the Hewitt plan. BE IT FURTHER RESOLVED that the Legislature support a Bill for An Act relating to policemens relief association in the City of Columbila Heights and membership of certain police personnel in the Public Employees Police and Fire Fund attached hereto ~ Exhi. bit A and made a part hereof. BE IT FURTHER RESOLVED that the City Manager and those which he choose~ to employ be, and they hereby are, authorized and directed to assist our Legi, slators in the implementation of the foregoing on behalf of the City of Columbia Heights. Offered by: Seconded by: Roll Call : Land Norberg All Ayes. ."'i'etary tO the Counci'l EXHIBIT A A Bill for an Act relating to the policemen's relief association in~the City of Columbia Heights, and membership of '~ertain police personnel in the public employees police and fire fund. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA Section 1. (City of Columbia Heights: New Police Officers). Notwith- standing the provisions of any general or special law to the contrary, all police officers first employed by the City of Columbia Heights on and after June 15th, 1972, and firemen first employeed after September 1st, 1973, shall be members of the public employees police and fire fund operated pursuant to Minnesota Statutes, Sections 353.63 to 353.68. All such police officers and firemen are not members of the police and fire relief associations of the City of Columbia Heights and are not subject to any law relating thereto. Section 2. (State Aid: Apportionment). State aid funds for police and fire relief ~ssociations received by the City of Columbia Heights pursuant to Minnesota Statutes, Sections 69.021 to 69.04 may be transferred to the police and fire relief association of the City of Columbia Heights in accordance with that section, or such funds may be'retained in total or in part by the City and allocated as a portion of the required employer's pension contribution for police officers who are members of the public employees police and fire fund operated pursuant to Sections 353.63 to 353.68. Section 3. The governing body of each police and firemen's relief association shall consist of a board of trustees composed of five members to be selected as follows: three shall be elected by the active members of the association or by the retired members if there are no active members, and two shall be appointed by the mayor of the City of Columbia Heights with the consent of the City Council of the City of Columbia Heights. The five members so selected shall elect from among themselves by majority vote a person to serve as chairman. Any vacancy in the board shall be filled in the manner prescribed for original appointments in this section. The affairs of each association shall be managed by the board of trustees in the manner prescribed by law or the articles of incorporation of each association. When every member of the police and fire relief associations of the City of Columbia Heights has retired from active duty, the funds of each association shall become a trust fund managed for the benefit of the recipients of such funds. Section 4. Notwithstanding the provisions of section 69.77, subdivision 2, from and after July 1, 1973, the members of each association shall pay into the retirement funds of each association a contribution of not less than seven percent of the salary used for determining pension credits, and after July 1, 1974, a contribution of not less than eight percent of salary used for determining pension credits. On or before January 1, 1984, the normal level cost of each association shall be shared. 40 percent by the members of the association and 60 percent by the City of Columbia Heights. The increase in the amount of contributions required of the members shall be spread over the ten year period and shall include eight percent of the salary for each m.ember plus the following percentage of the difference between that figure and 40 percent of the normal cost: 1975: ten percent; 1976, twenty percent; 1977, thirty percent; 1978, forty percent; 1979, fifty percent; 1980, sixty percent; 1981, seventy percent 1982, eighty percent; 1983, ninety percent. Section 5. From and after the effe:tive date of this act each associa- tion shall, upon application of any member whose employment is terminated or who for any other reason ceases to be amember of the association before qualif~'ing for a pension or disability benefits, refund to the member the total of his accumulated contributions to ~he ass0cia~ion ~.ithou~ ±n~erest, Section 6. The minimum obligation of the City of Columbia Heights to each relief association shall be determined and provided in accordance with the provisions of Minnesota Statutes, Sections 69.71 to 69.77, except that the normal cost shall be computed as a percentage of the salary paid only to members of the association. Section 7. Commencing in the year 1982, in addition to the minimum obligation required by sections 69.71 to 69.77, the City of Columbia Heights will provide additional financing to each relief association sufficient to amortize by the year 2012 the fund deficits as determined in accordance with Minnesota Statutes, Section 69.73. Section 8. Notwithstanding any other law, any other law, and state aid received by the City of Columbia Heights pursuant t<, Minnesota Statutes, Chapter 69, said state aid may be transferred to the relief ass~ciations in accordance with the provisions of Minnesota Statutes, Chapter 69, or retained in total or part and allocated as a portion of the required employ.~r's pension contributions for police- men or firemen~who are members of the public ~nployees police and fire fund operated pursuant to Minnesota Statutes, Sections 353.~3 to 353.68. Section 9. No new firemen's or pol~cemen's relief association in the City of Columbia Heights to provide benefits to paid firemen or policement shall be established except by specific enactment of tie legislature or by chartered amend- ment to the the Charter 'of the City of Co!umbia Heights. Section 10. (Effective date). Thi~ act is effective upon its approval from the governing body of the City of Columbia Heights in and upon compliance with Minnesota Statute, Section 645.021.
