BE IT RESOLVED that the City of Columbla Heights enter into
an agreement with the State of Minnesota, Depart~ment of Highways
for the followin~ purposes, to-w~t:

THIS AGREEMENT made and entered into by and between the State of
~-fimnesota, Department of Highways, hereinafter referred to as the "State",
and the City of Columbia Heights, hereinafter referred to as the "City",
WITNESSETH:
~fHE~S, it is considered desirable to provide a new traffic con-
trol signal ~th street Zights at the Intersection of Trunk Highway No. 65
(Central Avenue) and ~7th Avenue Northeast; and
YHEREAS, the City will provide for the installation of said
signal with street lights at no cost or expense to the State; and
~'~qF~REAS, the City and State will participate in the maintenance
and operation of said signal with street lights as hereinafter set forth;
NOW, THEREFORE, tT IS AGREED AS FOLD0~S:
1. The State shall prepare the necessary plans, specifications
and proposals and shall perform the engineering and inspection required to
complete the items of work hereinafter set forth. The City shall be billed
by the State for the cost of this work under Technical Assistance Agreement
No. T-~i~.
2. The City shall install or cause the installation of an actuated
signal with mast-arm indications and. street lights at the intersection of
Trunk Highway No. 65 (Central Avenue) and 27th Avenue Northeast with said
plans, specifications and proposals at the sole cost and expense o£ the
City.
3. The City shall install or cause the installation of an ade-
quate electrical power supply to the service pole including any necessary
extensions of power lines and, upon completion o£ said signal with street
lights installation, shall provide necessary electrical power for its opera-
tion at the cost and expense of the City.

A. ~on completion of the work contemplatedin paragraph 2 hereof,
the State shall maintain and keep in repair the traffic signal, except for
re!amping, cleaning and painting at its cost and expense; and the City shall
relamp, clean and paint the signal and maintain the street lights at its
cost and e~pense.
5. The City shall submit to the Stmte Traffic Engineer the low
bidder's list of manufacturers for the control equipment to be used and a~rd
of the contract shall not be made until the State advises the City in writing
of its concurrence.
6. The City further agrees to construct a connecting street between
ATth Avenue Northeast and >h Avenue Northeast west of the school district
property and east of Central Avenue as development of the area occurs.
7. tn the event access to 49th Avenue Northeast is reconsidered for
any reason, any action shall be preceded by a traffic study and public hearing.
8. The City to the extent that it is permitted by la~ to do so,
indemnifies, saves, and holds harmless the State and all of its agents and
employees of and from any and all claims, demands, actions or causes of
action of whatsoever nature or character arising out of, or by reason of,
the performance of any work by the City provided for hereby, and further
agrees to defend, without cost or expense to the 8tare, its agents or
e~ployees, any action or proceeding commenced for the purpose of asserting
any claim of whatsoever character arising in connection with or by virtue of
the work to be performed by the C~ty.

9. Any and all persons engaged in the aforesaid maintenance work
to be performed by the State shall not be considered employees of the City
and any and all claims that may or might arise under the Workmen's Compen-
sation Act of this State on behalf of said employees while so engaged, and
any and all claims made by any third party as a consequence of any act or
omission on the part of said employees while so engaged on any of the main-
tenance work contemplated herein shall not be the obligation and responsibi-
lity of the City. The State shall not be responsible under the Workmen's
Compensation Act for any employees of the City.
10. Ail timing of all traffic control signals provided for herein
shall be determined by the State, through its Commissioner of Highways~ and
no changes shall be made therein except with the approval of the State.

BE IT RESOLVED that the City-~enter into an agreement ~%h the
State of Minnesota, Department of Highways for the following p'mrposes,
wit:
To install a traffic control signal on Trunk Highway
No. 65 (Central Avenue) at 47th Avenue Northeast in
accordance with the terms and conditions set forth and
contained in Agreement No. 57165M, a copy of which was
before the Council.
BE IT FURTHER RESOLVED that the Mayor and City Manager are
hereby authorized to execute such agreement, and thereby assume for and
on behalf of the City all of the contractual obligations contained therein.
