Offered by: Land Seconded by: Roll Call: Jeska All Aye~~. -Se~,~r'¢(~ry t'o the Council JOINT AGREEMENT BETWEEN THE CITY OF COLUMBIA HEIGHTS AND VILLAGE OF HILLTOP CONCERNING CONTRACT FOR POLICE SERVICES THIS AGREEMENT, made and entered into by and between the City of Columbia Heights, herein~ter referred to as "City" and the Village of Hill t~, hereinafter referred to as "Village"; WITNESSETH: WHEREAS, the City presently has a police department, and, WHEREAS, the Village is considering the discontinuance of its police d~partment and contracting for police services with some other governmental subdivision through the joint powers statute as granted to municipalities by the laws of the State of Minnesota. THEREFORE, ~t is mutual 1¥ agreed: I. That the City shall furnish to the Village police protection to the same extent as is now afforded to the City by the Police Department of the City. 11. That the City shall patrol the streets and answer..all calls for police protection in the Village. I11. That the City police officers shall issue traffic and ordinance violation tickets and maintain a record of same similar to the records presently kept by the City, except that the records prepared for the Village shall be considered the property of the Village and shall be made available to Village officials at any time and upon termination of this Agreement shall be delivered to the Village. - 2 - IV. That the Village shall at th.e time of the authorization for the execution of this Agreement adopt a resolution empowering and authorizing the police officers of the City to have the power of arrest in the Village and deliver to the City a certified copy of said resolution. V. That the City shall furnish to the Clerk of the Village a monthly report in writing. Vi. That ~as and for compensation, the Village shall pay to the City the sum of Twelve thousand five hundred [$12,500) Dollars and that said sum shall be considered the base contract price for this Agreement. That said sum shall be increased each year by adding each year on the anniversary date of this Agreement an additional sum of Seven hundred f~ft¥- [$750.00) Dollars representing an increase over the base contract price of Six Percent. VII. That the contract is for a term of five [5) years ending March 31, 1977~ or sooner, if the parties so a§ree. That either party may terminate the Agreement effective the anniversary date~ namely April 1 of any year, upon f~ve months written notice. VIII. That the Village shall pay the compensation as heretofore provided in two semi-annual installments, one-half on the first day of April of each year, and one-half on or before the first day of October of each year, said payments shall be made in advance. If said payments are not made, then this Agreement by its term shall automatically expire. If payment is not received by the City, then the City shall not provide the pol ice protection as contemplated herein. - 3 - SEAL LX. That the Vii lage shall pay the cost of ~court appearances of any pot ice officer whO. ch are made as a part of his police duties for the Village. The Village shall render such payment upon receipt of a statement from the City for said court appearance cost pursuant to the pay schedule for such service in the City.
