HomeMy WebLinkAboutResolution 71-37590-40th AVENUE N,E. 788-9221 CITY OF COLUMBIA HEIGHTS ADMINISTRATIVE OFFICES ® cOLUMBIA HEIGHTS, MINNESOTA 55421 RESOLUTION AUTHORIZING AND ESTABLISHING LIHITATIONS ON BLASTING AND ROCK CRUSHING IN CONJUNCTION WITH THE BURLINGTON-NORTHERN RAILROAD CONSTRUCTION PROJECT WEST OF CALIFORNIA STREET N,E, NORTH OF 37TH AVENUE, BE l'F HERESY RESOLVED by the City Council of the City of Columbia Heights, that WHEREAS, theCity of Columbia Heights and Burlington-Northern, lnc. entered into an agreement dated February 8, ]971 anticipating exchanges of properties, relocation of certain utilities and proposals regarding procedures on construction, and WHEREAS, Burlington-Northern and their prime contractor, Park Construction,Company are now prepared to proceed with construction on The site consisting of earth moving, blasting and rock crushing. NOW, THEREFORE, SE IT RESOLVED that the city of Columbia Heights authorizes the proposed construction work to proceed with the following governing conditions: No operations to proceed before 6:00 a.m. nor after 10:00 p.m. on the site. Blastingto be done no more than once a day between 8:00 a.m. and 4:30 p.m. That all structures on Hain Street and California Street from 37th Aven'ue N.E. to 45th Avenue N.E. be inspected prior to any blasting with the cost of such inspection to be bourne by the contractor. That a mutually acceptable testing firm, know~dgeable in the testing of shock and vibration waves, be retained to test all blasts which are made and submit copies of the test r~sults to the City. ?/ - - 2 - That any streets in the City of Columbia Heights for hauling of excavated materials shall be properly maintained by the contractor including necessary surface repairs, watering or spreading chlorides for dust control and such other maintenance as deemed necessary due to the usage by the contractor. That the Performance Standards of Zoning Ordinance //462, Section ~.]2 shall be conformed to. BE IT FURTHER RESOLVED that the foregoing require~tents on construction remain in effect for the duration of the construction work on the Burlington-Northern site and that the City Manager be authorized to issue a Special Use Permit which shall include these foregoing requirements.
