VACATING A CONSTRUCTION EASEMENT ON THE SOUTH
FIFTEEN (]5) FEET MORE ORLESS OF LOT SlX (6) IN
BLOCK TWO (2) REARRANGEMENT OF BLOCK ~'D'~ COLUMBIA
HEIGHTS ANNEX.
BE IT HEREBY RESOLVED by the City Council of the City of
Columbia Heights that,
WHEREAS, there is on record an easement document No. t02265 on
file dated May 29, ]941 from Arthur S. Porter and Julia A. Porter,
his wife executed Tn favor of the City of Columbia Heights, and
WHEREAS, said easement was granted for the purpose of maintaining
fill thereon during the construction of 40th Avenue N.E. which
purpose has now been satisfactorily fulfilled.
NOW THEREFORE, it is determined by the City of Columbia Heights
that said easement is no longer necessary or of benefit to said
City and the Mayor and City Manager are hereby authorized to execute
a release of said easement.

is in the nature of an easement granted to the City of Columbia Heights
for purposes of maintaining a fill thereon mud in consideration of said
