HomeMy WebLinkAboutResolution 70-42RESOLUTION %VHEREAS, the City of Columbia Heights is considering the adoption of an ordinance prohibiting the sale of certain non-returnable or disposable beverage containers; and WHEREAS, the City of Columbia Heights recognizes that action prohibiting the sale of beverages in these non-returnable containers should be passed at the State level, NOW, THEREFORE, the City of Columbia Heights resolves: That a copy of Ordinance No. 744 be given to the State Representative and State Senator for the district encompassing Columbia Heights and urges the elected officials at the State level to promulgate legislation (at the State level) prohibiting the sale of the so called non-returnable containers. Nawrocki, Mayor ORDINANCE NO. 7~ BEING AN ORDINANCE PROHIBITING TIlE SALE OF CERTAIN NON-RETURNABLE OR DISPOSAL BEVERAGE CONTAINERS. THE CITY COUNCIL OF THE CITY OF COLUMBIA HEIGHTS DOES ORDAIN= Section 1. Within the City of Columbia Heights no beverage shall be sold or offered for sale in non-returnable or disposab]e containers. Section 2. For the purposes of this ordinance, the following terms, phrases and words, and their derivations shall have the meanings given herein: (Al "Beverage" shall mean: (I) Non-alcoholic beverage; any mineral waters, soda waters or any other carbonated or uncarbonated beverage not contalni~g ~Icohol that is commonly known as a soft drink. (2) Alcohollc beverage; any beer, ale, or other malt beverage containing½ of 1 per centum or more of alcohol by volume. "Container" shall mean any device or material used for the purpose of holding or containing beve.~ages as defined herein. (c) "Npn-returnable"or disposable beverage container" shall mean any container the title to which the seller intend~ to pass with the sale of the contents, or which i~ not suitable or is not intended for reuse. (pi "Sale" shall mean a commercia) transaction by any person, firm, individual, c~rporatlon, partnership or other vendor whereby, beverages are exchanged for a consideration. Any firm, individual, corporation, partnership, or other vendor selling beverages within the City of Columbia Heights found guilty of violating any provision of this ordinance shall be punished by a fine not to exceed $300.00 or by imprisonment for a period not to exceed ninety days, or,both. Each days violation of the provisions of this ordinance shall constitute a separate offense. Section ~., This ordinance shall become effective January 1, t972. Section Should any section, subdivision, clause, or other provision of this ordinance be declared by a Court of competent jurisdiction to be invalid, such decision shall not effect the valldity of the ordinance as a whole nor any part thereof other than the part so declare~ to be invalid.
