Hansen BY: IMPROVEMENTS FOR THE 1999 ALLEY DATE: 3/26/99 DATE: IMPROVEMENT PROGRAM Background: The City Council accepted the feasibility report and ordered an Improvement Hearing for March 29~' at their meeting of March 8, 1999. The 1999 Alley Program consists of constructing 17 alley segments throughout the City. Staff held an Informational Meeting March 23ra at Murzyn Hall from 6:30 to approximately 8:30 p.m. Twenty-eight people signed the attendance sheet, although I believe the actual number of people in attendance was closer to 35. A copy of the attendance sheet, meeting agenda and summary of comments is attached. Analysis/Conclusions: A complete map set is attached for reference. The proposal includes concrete alley construction, 6 inches in thickness and typically 12 feet in width. Some alleys will be constructed to a 10 foot width where the r-o-w or easement is only 12 feet. Driveway approaches will be matched with in-kind material (concrete or bituminous) up to 3 feet for all existing hard surfaced driveways. Paving of driveways required to be hard surfaced is not proposed due to the considerable time involved by staff. As an alternative, the name of the contractor and other local contractors will be provided to any resident interested in having this type of work done privately. This would assume the City contractor would want or choose to do this type of additional work. In response to letters sent out for alley closing, 6 were in favor of closing the alley at Reservoir Blvd. And Tyler St. between 43rd Ave. and 44~ Ave. and 3 were in favor or constructing the alley. There was one with no response. In response to letters sent out for alley vacation, 2 were in favor of vacating the alley north of 40th Ave. from the north-south alley to Jefferson St. The property owner at 615 40~ Ave. is in favor of constructing the alley. This property owner feels the alley is necessary to provide off-street parking for the five unit building. I would offer the following comments from thee discussion at Tuesday's Informational Meeting: Who is Assessed? Yhe alley program is set up so that only abutting properties are proposed to be assessed. The proposed rate is at $1,200 per parcel Residential or $2,900 Commercial or Industrial use. This represents assessing approximately 40 percent of the construction cost and the City's Infrastructure fund funding approximately 60 percent for Residential uses. Credit is given to any abutting parcel that has an elevation restriction of four vertical feet or higher by a assessment reduction of approximately 20 percent. Assessment Methodology: The 1999 alley program is proposed on a "parcel" unit basis as compared to a "front foot" basis that has historically been used. There is no right or wrong method. The test that any municipality must pass as required by statute, is that the benefit to the property must be equal to or exceed the amount of the assessment. Hansen BY: IMPROVEMENTS FOR THE 1999 ALLEY DATE: 3/26/99 DATE: IMPROVEMENT PROGRAM involves rehabilitation or reconstruction of an existing segment of infrastructure, it is my opinion that the benefit is more equal amongst abutting properties which supports the parcel unit basis. Proposed Construction: General construction comments: · Alleys will be 12' in width, 6 inches thick with 3-4" of gravel. Only in those alleys with 12 foot r-o-w will the alleys narrow to a 10' width. · The alley construction will occur over about a 10-12 week period, approximately. Access will be limited at times and restricted (no access) at others to allow the concrete to cure. · Power poles will remain in their current locations. · Work will include up to 3 feet of apron construction to match existing hard surfaced driveways. · No driveway construction is proposed under the contract work being administered by the City. Why can't you assess my driveway slab in with new alley? What good is a new alley meeting old driveway? Paving our driveway slabs simultaneously makes sense. What damage will be done to alley concrete with rough gravel on both sides? Should be one project. Eliminate gravel surfaces. It has been said that other neighbors do not use the alley other than the adjoining property. If this is so, we should be able to close it as a private drive. Why should we even have a dead-end alley paved that only has two garages on. This alley came up for paving several years ago and we passed a petition against. All five residents said no to paving this alley and now you are asking us again - why? Over the 14 years we have lived here we have only paid around $100 to the City to maintain it, why spend $1,000's of dollars to pave something? Who will benefit from concrete alley if adjacent owners do not want it? There are only two garages facing alley. The rest are front driveways. I do not feel it would be beneficial for the rest of us. Leave it alone. The alley is no help to me. In favor of closing up the alley. Emergency would be taken from front and I have a 10 ft. drop-off from lot line. This was voted on in 1994 - it will be done. We will all benefit With a better look. The City chipping in is great. Why am I being assessed? I don't even use the alley. South end of alley from 44th - 45th should be done with concrete too, it if has to be done at all. , I have no problem with the proposed assessment ($1,200) and am glad to see it concrete but I do not agree with everyone paying the same, it has always been on a front foot basis. Support alley paving - it needs to be done. We could not get this done individually for $1,200. Peterson, Mayor R E S O L U T I 0 N NO. 99 -D7 BEING A RESOLUTION ORDERING IMPROVEMENT AND PREPARATION OF PLANS WHEREAS, Resolution No. 99-/~ of the Columbia Heights City Council adopted the 8th day of March, 1999, fixed a date for a council hearing on the proposed improvement of an alley, California Street to Main Street,250 feet north of 39th Avenue to 570 feet north of 39tn Avenue AND WHEREAS, ten days mailed notice and twice published notice of the hearing a week apart was given, and the hearing was held thereon the 29th day of March, 1999, at which all persons desiring to be heard were given an opportunity to be heard thereon, WHEREAS, the Council determines to proceed with this local improvement, a portion of the cost being defrayed by special assessments under Charter provisions. NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF COLUMBIA HEIGHTS, MINNESOTA: 1. That the extent of such improvements is as follows: Bituminous alley construction. Work includes required utility work, new granular sub-base, new aggregate base, new bituminous surfacing, required concrete or bituminous driveway, service walk replacement and sod and miscellaneous associated construction items. The proposed alley width is 12 feet. 2 o Such improvement is necessary, cost-effective, and feasible as detailed in the feasibility report. 3 o Such improvement is hereby ordered as proposed in the Council Resolution adopted 8th day of March, 1999. These improvements shall also be known as P.I.R. 986 - Project #9902. Kevin Hansen is hereby designated as the engineer for this improvement. As you may recall, the Council advertised that they would be accepting applications for the Council vacancy over a five week period ending February 25, 1999 at 4:45 p.m. At the March 22, 1999 City Council Meeting, the resolution was approved which identified Thomas Ramsdell as the person selected to fill the vacancy. Mr. Ramsdell notified the Council on March 23, 1999 he was unable to accept the appointment. The City Attorney advised there was no need to re-open the interview process. He recommended that the Council schedule a meeting as soon as possible to again make an appointment. The form of government established by this charter shall be known as the "Council-Manager Plan." Section 7. ELECTIVE OFFICES. The council shall be composed of a mayor and four council members who shall be qualified electors, and who shall be elected at large in the manner hereinafter provided. Ordinance No. 1086, passed June 11, 1984) Section 9. VACANCIES IN THE COUNCIL. A vacancy in the council shall be deemed to exist in case of the failure of any person elected thereto to qualify on or before the date of the second regular meeting of the new council, or by reason of the death, resignation, removal from office, cessation as a resident of the city, continuous absence from the city for more than three months, conviction of a felony of any such person whether before or after qualification, the failure of any council member without good cause to perform any of the duties of membership in the council for a period of three months or for any other cause as may be provided for in Minnesota Statutes, as amended. In each such case, at the next regular meeting following receipt of notice by the council of one of the foregoing conditions, the council shall by resolution declare such vacancy to exist unless further investigation is required. Notice of said vacancy shall be posted at city hall for a period of two (2) weeks from the date of the adoption of the resolution declaring said vacancy. Notice shall also be published in a designated city newspaper for a period of two (2) weeks as soon as possible after the date of the adoption of said resolution, with the publication being completed no later than thirty (30) days from said date. Applications shall be sought and accepted from individuals interested in filling the vacancy, which applications shall be submitted to city hall, to the attention of the City Clerk, within 45 days from the date of said resolution. It is the position of the League that repealing sales tax on local government purchases is good tax policy and means savings to local residents. COUNCIL ACTION: RESOLUTION NO. 99-42 BEING A RESOLUTION SUPPORTING REPEAL OF THE STATE SALES TAX FOR LOCAL GOVERNMENT PURCHASES WHEREAS, the Legislature imposed the sales tax on local governments in 1992 when facing a significant state budget deficit; and WHEREAS, the state government has collected hundreds of millions of dollars in sales tax since 1992 on local government purchases of items such as road maintenance equipment, wastewater treatment facilities, and building materials; and WHEREAS, the sales tax on local government purchases is passed on to residents in the form of higher property taxes and fees; and WHEREAS, the state's financial picture has improved dramatically and the need for the sales tax no longer exists; and WHEREAS, Minnesota is one of only seven states which impose sales tax on local government purchases; and WHEREAS, imposing the sales tax on local government purchases is an inefficient way to raise state revenues, especially where sales tax is paid for bonding projects with accompanying interest costs; NOW, THEREFORE, BE IT RESOLVED, that the Columbia Heights City Council encourages its state legislators to support the repeal of the sales tax on local governments. This year a record number of bills have been introduced to repeal the tax and committees in both the House and Senate have held hearings on the topic. Although we have raised awareness and have gained support, legislators need to hear from you and other city officials about how important these bills are for your community. While most legislators agree that taxing local government purchases doesn't make sense, the repeal would permanently reduce annual state sales tax revenues by an estimated $80 million. Given the new February budget forecast that includes an additional $730 million in surplus state revenues through the end of the next biennium, the state can certainly afford to eliminate the sales tax on local purchases. Legislators need to know that repealing the sales tax on local government purchases is good tax policy and means savings to your residents. Please contact your representative or senator to encourage them to support the repeal of the sales tax on local government purchases. The sales tax on local government purchases was extended by the legislature in 1992 at a time when the state was experiencing a severe budget shortfall. With recent budget forecasts that indicate a substantial state budget surplus in the foreseeable future, the state can afford to eliminate the sales tax on local purchases. Exempting local government purchases would save cities, counties and townships an estimated $80 million per year that ultimately results in higher property taxes and user fees. Jif your city has the actual or estimate of the sales tax paid laxt year, you should include that figure in the letter].
