CALL TO ORDER/ROLL CALL The meeting was called to order by Mayor Sturdevant at 7:00 p.rn. Present were Mayor Sturdevant and Councilmembers Szurek, Jolly, Ruettimann and Peterson. 2. PLEDGE OF ALLEGIANCE 3. ADDITIONS/DELETIONS TO THE MEETING AGENDA Added to the Other Business section of the agenda was the closing of a public hearing regarding a rental property license revocation. 4. CONSENT AGENDA (These items are considered to be routine by the City Council and will be enacted as part of the consent agenda by one motion. Items removed from consent agenda approval are taken up as the next order of business.) Motion by Sturdevant, second by Ruettimann to approve the consent agenda as follows: a) Approval of Meeting Minutes The Council approved the minutes of the December 28, 1998 Regular Council Meeting as presented. b) Re-Issue Rental Housing License After Revocation The Council approved the issue of a rental housing license to Susan Loewenthal to operate the rental property located at 1407-09 Circle Terrace in that the provisions of the Housing Maintenance Code have been complied with. c) Close Hearing - Rental License Revocation The Council approved closing the public hearing regarding the revocation or suspension of the rental license held by Thomas Ferrara regarding rental property at 1035-1037 43 ½ Avenue in that the property is in compliance with the Ho~:~sing Maintenance Code. d) Close Hearing - Rental License Revocation The Council approved closing the public hearing regarding the revocation or suspension of the rental license held by Madeline VonHeideman regarding rental property at 3718 Central Avenue in that the property is in compliance with the Housing Maintenance Code. REGI_YLAR COUNCIL MEETING DECEMBER 28, 1998 PAGE 2 e) Close Hearing - Rental License Revocation The Council approved closing of the public hearing regarding the revocation or suspension of the rental license held by Sharon Vermeer regarding the rental property at 615 40th Avenue Northeast in that the property is in compliance with the Housing Maintenance Code. f) Close Hearing - Rental License Revocation The Council approved closing of the public hearing regarding the revocation or suspension of the rental license held by Mulji Patel regarding rental property at 939-941 42 ½ Avenue in that the property is in compliance with the Housing Maintenance Code. g) Close Hearing - Rental License Revocation The Council approved closing of the public hearing regarding the revocation or suspension of the rental license held by Gordon Hines regarding rental property at 5007- 5009 Jackson Street in that the property is in compliance with the Housing Maintenance Code. h) Workers' Compensation Insurance The Council authorized the Mayor and City Manager to enter into an agreement with St. Paul Companies for workers' compensation coverage under the standard premium plan at a cost of $89,486. i) Revisions to Murzyn Hall Rental Policy The Council authorized staff to implement the revisions listed in the Council Letter dated December 2, 1998, fi:om the Recreation Director to the Murzyn Hall rental policy, including the rental rates for the year 2000 and the revised decorating roles. j) Approval of License Applications The Council approved the license applications as listed. k) Payment of the Bills The Council approved payment of the bills as listed out of proper funds. 1) Establish Hearing Dates for License Revocations of Rental Properties The Council approved the establishment of the hearing date of January 11, 1999 for revocation of a license to operate a rental property within the City of Columbia Heights against the following properties/property owners: Thomas Brownrigg at 4008-4010 Cleveland Street, Mohsen Dessouki at 4610-4612 Fillmore Street and Sandra Chu at 4456 Washington Street. REGULAR. COUNCIL MEETING DECEMBER 28, 1998 PAGE 3 Councilmember Peterson inquired as to how many claims the City had during 1998. He was referring to the item on the agenda regarding workers' compensation insurance. The Finance Director responded there have been thirty-three claims to date. PROCLAMATIONS, PRESENTATIONS, GUESTS AND INTRODUCTIONS a) Recognition of Outgoing Councilmembers Mayor-elect Peterson presented plaques to Mayor Sturdevant and Councilmember Ruettimann in recognition of their years of service. Mayor Sturdevant had served on the Council for five years and Councilmember Ruettimann served on the Council for nine years. All members of the City Council commented on their appreciation of the outgoing members' service. 6. PUBLIC HEARINGS None 7. ITEMS FOR CONSIDERATION A. Roll call: All ayes ORDINANCE NO. 1381 BEING AN ORDINANCE A_MENDING ORDINANCE 994, CITY CODE OF 1977 PARTICIPATION IN LOUD PARTIES AND GATHERINGS Currently, the ordinance reads as follows: 10.312(3) Any owner or person in charge of the building or place who has knowledge of the' disturbance and fails to immediately abate said disturbance upon order of a police officer shall be guilty ora violation of this section. ORDINANCE NO. 1382 BEING AN ORDINANCE AMENDING ORDINANCE NO. 853 CITY CODE OF 1977, PERTAINING TO BACKGROUND CHECKS WHEREAS, the City of Columbia Heights is a participant in a program known as "Crime Free Multi Housing," a major concept of this program is the screening of new tenants by the property owners for the protection of local residents, property owners, tenants, and the overall public safety of the community; WHEREAS, part of said screening consists of a Minnesota criminal h/story check through the Minnesota Bureau of Criminal Apprehension; WHEREAS, the Minnesota Bureau of Criminal Apprehension requires that a city have a city ordinance authorizing the city to nm Minnesota criminal h/story checks for the purpose of screening potential tenants of rental property; and REGULAR COUNCIL MEETING DECEMBER 28, 1998 PAGE 5 WHEREAS, this is a process that will be beneficial to the residents of Columbia Heights and its property owners; NOW THEREFORE BE IT ORDAINED by the City Council of the City of Columbia Heights that the Columbia Heights Code of 1977 be amended by adding Pa'ticle IV, Section 11, as follows: SA.411(1). That for the protection of local residents, property owners, tenants, and the overall public safety of the community, the Columbia Heights Police Department is hereby authorized to conduct Minnesota criminal history checks for the purpose of screening potential tenants of real property, su'bject to the following conditions: a request is made by the property owner/landlord in writing b) a signed consent form from the subject of the check is received by the Columbia Heights Police Department c) authorization is received from the subject of the check to release said information to the property owner/landlord the purpose and use of said information is solely for assisting in the screening of potential tenants. This ordinance shall be in full force and effect from and after thirty (30) days after its passage. Police ChiefJolmson reviewed all features of the project and gave some history of its background. RESOLUTION NO. 98-118 AUTHORIZiNG THE EXECUTION AND DELIVERY OF A JOINT POWERS AGREEMENT RELATiNG TO THE ANOKA COUNTY JOINT LAW ENFORCEMENT CENTRAL RECORDS PROJECT WHEREAS, it has been proposed that the County of Anoka, Minnesota, (the "County") issue its capital notes on behalf of itself, the Anoka Joint Law Enforcement Council (the "Council") and the various cities that are represented on the Council (the "Cities") to finance the acquisition and installation of an integrated law enforcement central records communication system, including computer hardware and software (the "System"); and WHEREAS, in order to provide for the joint financing and operation of the System by the County, the Council and the Cities, it is necessary for the County and the Cities to enter into a joint powers agreement as required by Minnesota Statutes, Section 471.59; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLUMBIA HEIGHTS, MINNESOTA (the "City"): Section 1. The City Council of the City hereby authorizes and directs the Mayor of the City and the City Manager of the City (together, the "Authorized. Officers") to execute and deliver the Joint Powers Agreement, dated as of December 29, 1998 by and between the Cities and the County (the "Joint Powers Agreement"). The Joh~t Powers Agreement shall be substantially in the form on file with the City Clerk on the date hereof, with such necessity and appropriate variations as the Authorized Officers, with the advice of the City Attorney, shall determine; provided that the execution thereof by the Authorized Officers shall be conclusive evidence of such determination. Section 2. This resolution shall be in full force and effect fi.om and after its passage. Passed this 28th day of December, 1998. Offered by: Ruettimann Seconded by: Jolly Roll call: All ayes REGULAR COUNCIL MEETING DECEMBER 28, 1998 PAGE 7 4) Resolution No. 98-119 Being a Resolution Extending the SACCC Joint Powers Agreement for a Period of Two Years and Approving Funding the the Year 1999 Southern Anoka County Community Consortium (SACCC) is requesting a two year extension of its Joint Powers Agreement with the City. It is also making a request for increased funding from all of the JPA participants to be used to fund a coordinator position for Values 1st with a portion of time dedicated to the Consortium. Chief Johnson, who has been an active participant in Values 1st, distributed an outline for Values 1st current and future activities. He also mentioned that a job description for the coordinator's position has been drafted and is being critiqued. Motion by Jolly, second by Szurek to waive the reading of the resolution there being ample copies available for the public. Roll call: All ayes RESOLUTION NO. 98-119 Contract #950154A EXTENDING THE TERM OF THE SOUTHERN ANOKA COUNTY COMMUNITY CONSORTIUM JOINT POWERS AGREEMENT WHEREAS, in June of 1995, a Joint Powers Agreement established the Southern Anoka County Community Consortium consisting of Anoka County, the cities of Columbia Heights, Fridley, and Hilltop, and Independent School Districts #13 and #14; and, WHEREAS, the general purpose of this Joint Powers Agreement is to allow each party to jointly and cooperatively coordinate the delivery of services, maximize the use of resources, avoid redundancy, encourage public, private community partnership and to develop and fund programs to promote the general community health and safety in the territory of the cities herein; and, WHEREAS, a very successful example of this joint, cooperative effort is the establishment of the community values program known as Values First, which has been recognized throughout the country as a model for promoting core values consistently across all sectors of the community so that youth and adults have a common, inclusive foundation upon which to operate. REGULAR COUNCIL MEETING DECEMBER 28, 1998 PAGE 8 NOW, THEREFORE BE IT RESOLVED, that the City of Columbia Heights supports the efforts of the Southem Anoka County Community Consortium and does hereby renew and enter into the aforesaid Southern Anoka County Community Consortium Joint Powers Agreement until December 31, 2000, unless earlier terrninated or extended under the term thereof. Unke, 4357-4359 Seventh Street Northeast The resolution was not read as staffhas advised that the last inspection found the property in compliance with the Housing Maintenance Code. Motion by Sturdevant, second by Ruettimann to close the public hearing regarding the revocation of the rental license held by Janene Unke regarding rental property at 4357-4359 Seventh Street in that the property is in compliance with the Housing Maintenance Code. Report of the Ci[y Manager 1) The cleaning up of the property on Third Street has been completed. The City Manager thanked all of the employees in the Public Works Department, Fire Department and Police Department who assisted in this job. He wished everyone a Happy New Year. As of this writing, Anoka County still does not have a confa-med amount from HUD for the 1999 funding level However, based on the 1998 funding amount, the City can expect an allocation of roughly $191,000. An additional amount of up to roughly $28,650 (15% of the total City allocation) can be utilized for public service agencies. Note that applications from public service agencies have been subrm'tted to the Community Development Department. These applications will be reviewed by the Human Services Commission during its January 13, 1999, meeting, and a recommendation will be forwarded to the City Council. This recommendation will be represented in a forthcoming application for the 1999 CDBG program. B,ackground: Note that Case g9901-03 is the same request for the property at 1105 44 ~A Avenue NE which is adjacent to the western boundary of this property. These lots have been vacant since the area was platted and developed in the early 1970's. Analysis: As listed above, the requested variance pe~in,~ to the side yard setback requirement which states that lots not served by a public alley shall provide one side yard of at least 10 feet. The intent of the two different side yard setback requirements when the property is not served by an alley is to allow room on the property for a driveway to get behind the house if a garage were built in the rear of the lot. In this case it is an attached garage, so driveway access to the back yard is not necessary. It is the opinion of the City Planner that the proposal meets the intent of the Zoning Ordinance. Note that the proposal meets all other minimum requirements of the Zoning Ordinance. Section 9.105(3)(d) states the following: "In recommending a variance, it shall be found that by reason of narrowness, shallowness, or shape of lot or where by reason of exceptional topography, soil conditions, tree number or location or water conditions the owner of such lot would have an undue hardship in using his lot in a manner customary and legally permissible within the roles of the zoning district." In order for a variance to be .granted, hardship needs to be established. The subject property has a relatively steep slope along the front of the property which creates a need for a tuck-under garage. The slope is too steep for a driveway to safely serve a garage built at grade. Considering that a rock-under (attached) garage is needed, a driveway to the back yard is not necessary, so the proposal meets the intent of the Ordinance and topography of the lot appears to create a legitimate hardship. The theater owners have stated that it will be convenient for them to live on-site as they plan to provide some dative programming as well as evening showings. Backeround: The applicants propose to utilize the second story of the building for the apartment which will be owner- occupied and will contain two bedrooms, 1 ~ bathrooms, living room, dining room, and a kitchen all on the second floor. Analysis: The proposal meets all minimum requirements established in the Zoning Ordinance. According to the City Building Official, the apartment will need to be separated from the living space by a fire wall. Note that the plan submitted with this application does indicate that there will be a fire wall separating the two uses. Parking requirements for a theater are at least one space for each eight seats. The theater has 438 seats which requires 55 spaces. The combination of on-site spaces and use of the spaces at the church through a shared parking agreement meets the minimum number of spaces required. Note that the theater owners have agreed to not have showings at the same time as church services, so there should not be a conflict in timing. Also, any overflow parking can utilize the municipal parking ramp located to the north of the subject property. The off-street parking design in this area is awkward and can be confusing to customers. Staff will recommend as a condition of approval that the owners work with staff to prepare a parking lot striping plan that clearly identifies circulation routes and parldng spaces, and the parking lot should be restriped to match the plan. The existing marquis utilizes flashing lights as part of its signage which the Zoning Ordinance prohibits. Note that this is being done by the theater owners in an attempt to renovate the building to its original style. This issue was discussed during the January 5 Planning and Zoning Commission meeting. The theater owners have stated that it will be convenient for them to live on-site as they plan to proxdde some daytime programming as well as evening showings. Daytime showings will cater to the senior population. Case Histo~_ : There are no previous Planning and Zoning Commission cases on this site. ANALYSIS Surrounding Property_: The surrounding property in all four directions is zoned CBD, Central Business District. The Case: 9901-04 Page: 2 property to the east is u~ed for United Methodist Community Church while the property on the north, south, and west is used commercially. Technical Review: Section 9.112(2) of the Zoning Ordinance allows dwelling units in the Central Business District as a Conditional Use Permit provided that: 1. The units do not occupy the first floor; and, 2. A roof intended for usable space shall be enclosed by a wall or fence not less than five feet in height. The applicants propose to utili?e the second story of the building for the apartment and do not intend to utili?e the roof. This apartment unit will be owner-occupied and will not be offered for rent. The proposal meets the two conditions established in the Zoning Ordinance. Also, section 9.112(4)(c) states that any apartment having two bedrooms shall have not less than 720 square feet of floor area. The proposed apartment will have roughly 1,300 square feet 'of floor area. The apartment will be owner-occupied and will contain two bedrooms, one and ½ bathrooms, livhag room, dining room, and a kitchen all on the second floor. The projection booth will share the second floor of the building. According to the City Building Official, this will need to be separated from the living space by a fire wall Note that the plan submitted with tkis application does indicate that there will be a fire wall separating the two uses. Another concern regarding the need to separate the two uses pertains to noise. For example, should the occupants of the apartment be using the kitchen (running water, washing dishes, etc.) the noise from this could can'y down to the theater as the kitchen is adjacent to the projection booth. If this area is directly above any seating, the owner may want to provide sound insulation. Minimum yard and density requirements are as follows: * Every lot shall have a minimum frontage of 20 feet - the existing parcel meets this requirement; · Front Yard shall be one foot - existing building meets this requirement; and, · The floor area ratio shall not exceed 6.0 - the floor area ratio is at about .9 which exceeds the minimum requirement. Parking requirements for a theater are at least one space for each eight seats. The existing parking lot has 24 parking stalls, two of which are handicap accessible spaces. Note that two of the 24 spaces will be designated as owner-occupied parking which will leave 22 spaces for the theater. Staff is making the assumption that customers of the theater also have access to the municipal parking ramp, so the minimum number of off-street parking spaces is met. Note that this ramp is relatively fun during weekdays, but most of the traffic generated by the theater will occur during the evening and on weekends, although additional daytime programming is planned. Should off-street parking become a problem, the owners may want to consider approaching the United Methodist Community Church to discuss a joint parking arrangement which is permissible Page: 3 according to zoning regulations. According to the Central Avenue median plan, this site does not have access to southbound traffic along Central_ There is a driveway to the parking lot from Central Avenue, so the existing parking lot has access from the back driveway serving the property as well as Central Avenue. The off-street parking design in this area is awkward and can be confusing to customers. Staff will recommend as a condition of approval that the owners work with staff to prepare a parking lot striping plan that clearly identifies circulation routes and parking spaces, and the parking lot should be restriped to match the plan. Staff has prepared a potemial layout which is attached to this report. This layout provides a combination of 90 degree and parallel parking which will accommodate two-way traffic. The existing layout has diagonal parking which only serves traffic coming from the rear driveway. Havig. g msited the site, staff did not see any signage prohibiting two-way traffic. Note that the layout proposed by staff only has 18 spaces marked which is six less than the exlsting parking .lot. One of these spaces is required to be a van accessible handicap space. Considering that the ske has use of the municipal ramp, minimum parking requirements will still be met. Also, the proposed layout provides a 20 foot drive aisle which is sufficient for this design, and the spaces facing the building are set back one foot from the building and a bumper curb is shown which will further separate parked vehicles from the building. Compliance with City Comprehensive Plan: The City Comprehensive Plan designates this area for future commercial development. Turning the second floor into a dwelling unit does not impact the goals and objectives of the existing Comprehensive Plan. Although, encouraging m/xed-used developmem has been discussed during the current Plan update process. This proposal is consistent with that philosophy, but noth/ng has been formally adopted to date. The positive aspects of this proposal are as follows: 1. The proposal meets the minimum requirements established in the Zoning Ordinance. 2. The proposal is consistent with the mixed-use development philosophy being discussed as part of the current Comprehensive Plan update. The negative aspects of this proposal are as follows: 1. There do not appear to be any negative aspects to this proposal. CONCLUSION Staff Recommendation: Staff recommends approval of the Conditional Use Permit to allow an owner-occupied dwelling unit on the second floor of the Heights Theater at 3951 Central Avenue NE, subject to the Case: 9901-04 Page: 4 conditions listed in thc recommended motion. Commi.~sioller Richard Dustin's term as a Commi.~sJoller on the EDA Board of Directors expires on January 8, 1999. By the authority of Minnesota Statutes Chapter 469, EDA Commissioners are appointed by the Mayor _and approved by the City Council. The statute also stipulates that ~e term for EDA Commissioners is six (6) years. The EDA has discussed the suggested appointment of the current Vice President, Robert Ruetfimann, to be appointed to the six year term vacated by the resignation of Richard Dustin. This term will expire January 8, 1999 as per Resolution 96-03 (see attached resolution a_ncJ proposed Resolution 99- O'~ ). In addition to the vacancy of Commlnsioner Dustin's term, Commi.~sioner Jolly's term should be re-approved and extended to expire on January 8, 2004. The recent election will also create a vacancy for Cornmls$ionea' Ruettimann's position which will be filled by Ccnmcilmember-elect Julienne Wyckoff. With the in~?oduction of the new 60 gallon limited service, a mid-range rate needs to be created. The current fund is financially sound and the cost of garbage disposal could be reduced or maintained at the current amount. Garbage rates are tied to actual costs incurred by the city, while recycling and yardwaste rates are subsidized by the refuse fund. This proposed resolution would maintain the current rates and add one rate for the 60 gallon service. Recycling fees have increased in cost to the city, and would be subsidized by the city and remain at a constant $1.73 per unit for single family and duplexes and $1.40 per unit for multiple dwellings, for 1999. Yardwaste fees would also be maintained at the current $1.45, with the cost to the city at $1.52. Yardwaste is collected from multiple units, but they are not billed for that service since the use is generally minimal. Also, it was determined that the costs for refuse and recycling collections for the various city buildings, would continue to be paid directly from the refuse fund . Those numbers are included here for informational purposes. Official Proceedings Columbia Heights Traffic Commission December 7, 1998 Page 2 · Request for School Zone on 49t~ Avenue (west of Central) Based on discussions with representatives of the school district, the Police Department has been, monitoring the speed and volume of traffic on 49th Avenue between Central Avenue and Monroe Street as well as between Fillmore Street and Johnson Street, both during the school day and after school. The Police Department has worked with students and staffto make them aware of the need to use extreme caution in and around this area. Motion by Goodman, second by Stumpfm recommend the City Council request Anoka County establish a school zone on 49t~ Avenue from Monroe Street to Central Avenue with reduced speed and flashing amber lights when children are present. MOTION by Ramsdell, seconded by Fowler, to approve the minutes from the meeting of December 1, 1998 as presented in writing. Voice Vote: All Ayes. NEW BUSINESS: A. Site Plan Review Case//9901-01 Mn. Petroleum Service RE: 5257 University Avenue Mr. Hollman presented a request from Minnesota Petroleum Service for site plan approval to replace an existing canopy with a new 24' x 42' (1,008 square feet) canopy at University Auto Service, 5257 University Avenue N.E. He added that the canopy being replaced is on the west side of the building and noted that there are two canopies on the site with the existing canopy on the north side of the building slated to be removed. Mr. Hollman informed the Commission that in October of 1980, Case//8010-54 was a request for a Conditional Use Permit to allow the construction of an 8' x 16' concrete block utility building for the storage of equipment in the southwest corner of the lot which was approved by the City Council on October 14, 1980. The original plan for the site was approved on October 7, 1969. He stated that the surrounding property to the south is zoned and used commercially, while the property to the east is zoned and used residentially. The property to the west across University Avenue is in the City of Fridley and is used for Multi-Family Residential, while the property across 53" Avenue to the north is also located in the City of Fridley and is used commercially. Mr. Hollman informed the Commission that Section 9.116(8)(a) of the Zoning Ordinance states that for motor fuel stations "the setback of any canopy or weather protection, free standing or projecting from the station structure shall not be less then ten (10) feet from the street right-of-way line nor less than twenty (20) feet from an abutting property line." He stated that the closest edge of the canopy to any street right-of-way line is roughly 14 feet adding that the proposed canopy meets the requirements of the Zoning Ordinance. He also stated that, according to the Fire Department, an unobstructed vertical clearance of at least 13 feet, 6 inches under the canopy for fire truck access must be provided. THE CiTY OF- COLUMBIA HEIGHTS DOES NOT DISCRIMINATE" ON THE BASIS OF DISABILITY IN EMPLOYMENT OR THE: PROVISION OF' SERVIC~'S JANUARY 5, 1999 Page :2 Mr. Hollman informed the Commission that Section 9.113(4) of the Zoning Ordinance requires the following lot dimensions in the RB District: The floor area ratio shall not exceed 1.0. He stated that the existing property has a floor area ratio of approximately .08 which exceeds this requirement; · Minimum frontage shall be 40 feet. The existing Property meets this requirement; · Lot width shall be 50 feet. The subject property meets this requirement; · Front yard shall be 15 feet. The property meets this requirement; · The Rear yard shall be 10 feet. The equipment building encroaches into this setback by roughly three feet, however, this building was approved in 1980 and is considered legally nonconforming; · There is no side yard setback requirement; · The minimum lot area is 6,000 square feet. The existing property meets this requirement. Mr. Hollman stated that Motor fuel stations are allowed as a Conditional Use in the RB District. Section 9.116(18) of the Zoning Ordinance regulates motor fuel stations. Pertinent requirements are as follows: 1. A minimum ten foot landscaped yard shall be provided along all abuttir[g public right-of-way lines, except where approved driveways occur. The existing property meets this requirement; 2. All trash, waste material and unwanted motor vehicle parts shall be stored within a separate enclosure behind the building. During a site visit, Staff observed that a dumpster was located near the back of the property that was not enclosed; 3. Wherever a motor fuel station abuts an 'R" District, a fence not less than 50% opaque nor less than six feet high shall be erected and maintained. There is currently a screening fence on tho property; 4. The outdoor lighting system shell be approved by the City. Ughting cannot exceed three (3) foot-candles at the boundary of the property. Staff will need to review and approve a lighting plan for the new canopy; 5. Access or egress curb cuts shall be not less than 50 feet from the curb line intersection of secondary thoroughfares. There are two curb cuts that do not meet this requirement, but these curb cuts were approved in 1969 and are considered legally nonconforming. PLANNING AND ZONING COMMISSION REGULAR MEETING- MINUTES JANUARY 5, 1999 Page 3 Mr. Hollman stated tho site plan indicates that there are two free-standing signs located on the property near the northwest corner and southwest corner of tho lot. Tho sign in tho southwest corner does not contain any actual signage at this time. It is standing only as a bare structure. It appears that this structure exceeds tho 30 foot high maximum for free-standing signs. Considering that only one free-stending sign is allowed on this property and that tho sign in the southwest corner of tho property is nonconforming and empty, staff will recommend as a condition of approval that this sign be removed. He noted that any signage located on tho canopy will be calculated and included as wall signage. A separate sign permit application will need to be reviewed and approved by staff. Commissioner Szurek expressed concern with tho curb opening on 53" Avenue that is the closest to University Avenue as well as the northorly curb opening along tho service road and felt they should be closed. It was her opinion that these were too close to the intersection and could contribute to the cause of accidents in tho area. She referred to personal experiences whon driving in that specific area. Community Development Director Anderson suggested that the northerly curb opening along the service road be left open in order to provide adequate traffic circulation within the site especially with the canopy and gas pumps on the north end of the building. Mr. Gary Peterson, owner of the property, stated that the gas pumps and canopy on the north end would be removed in conjunction with the alteration of the site to a Texaco operation. He agreed that the area is very busy, but that is good for any business in the area. He added that there have been some accidents in tho intersection but not in front of his business caused by any customers entering or exiting tho gas station. Mr. Peterson stated that ho would do whatever the city requires of him for the site. Commissioner Ramsdell suggested closing off both curb openings in that case as long as thore would be no need for concern for traffic circulation on tho site. He furthor suggested that both curb openings on the 53"" Avenue side of the site be closed and one opening created in tho center of the property line. Council Representative Peterson felt tho site plan should be reviewed by the Traffic Commission and City Engineering staff for thoir input and direction regarding these concerns and not by the Planning and Zoning Commission. He felt that tho site plan approval could be granted without tho recommendation of the Traffic Commission. Motion by Peterson, seconded by Ramsdell, to approve tho site plan to allow tho construction of a 1,008 square foot canopy on tho property at 5257 University Avenue NE, subject to tho following conditions: 1. A lighting plan will need to be reviewed and approved by staff; 2. Public Hearing Variance Case #9901-02 George Eckenroth RE: 1111 N.E. 44 1/~ Avenue Columbia Heights, Mn. Mr. Hollman presented the request of George Eckenroth for a variance to allow tho construction of an approximately 1,176 square foot home at 1111 N. E. 44 1/2 Avenue with two five foot side yard setbacks. He informed the Commission that Section 9.108(4) of the Columbia Heights Zoning Ordinance requires that when a lot is not served by a public alley, the property shall have one side yard not less than 10 feet and the other side yard shall be five (5) feet thereby requiring a variance of five (5) feet. Mr. Hollman stated that the surrounding property in all four directions is zoned R-2, Two Familv Residential, and is used residentially with the exception of the adjacent lot to the west which is vacant. He noted that this lot is the subject of Case #9901-03. Mr. Hollman informed the Commission that Section 9.108(4) of the Zoning Ordinance requires the following lot dimensions in the R-2 District: Minimum lot area shall be 6,500 square feet. Tho existing property is roughly 6,662 square feet which meets this requirement; Lot width sholl be 60 feet. Tho subject property is 52.5 feet wide, so it does not meet this requirement. However, Section 9.104(4) of tho Zoning Ordinance states that a lot of record which does not meet the requirements of this Ordinance as to area or width may be utilized for' single family detached dwelling purposes provided that 60% of the minimum lot area or lot width requirements are met. Tho existing lot does not meet tho 60 foot lot width requirement, but it does exceed tho 60% minimum lot area requirement, so the lot is in compliance with tho Zoning Ordinance. · Front yard shall be 25 feet. The proposed house will meet this requirement; · Rear yard shall be 30 feet. Mr. Hollman reminded the Commission of Section 9.105(3)(d) which states t~= following: ~ln recommending a variance, it shall be found that by reason of narrowness, shallowness, or shape of lot or where by reason of exceptional topography, soil conditions, tree number or location or water conditions the owner of such lot would have an undue hardship in using his lot in a manner customary and legally permissible within the rules of the zoning district." in order for a variance to be granted, hardship needs to be established. He stated that the subject property has a relatively steep slope along the front of the property which creates a need for a tuck-under garage. Tho slope is too steep for a driveway to safely serw~, a garage built at grade. Considering that a tuck-under (attached) garage is needed, a driveway to tho back yard is not necessary, so tho proposal meets the intent of tho Ordinance and topography of tho lot appears to create a legitimate hardship. Topography of the lot also creates concerns about drainage. Mr. Hoilman informed tho Commission that tho City Engineer offered tho following comments pertaining to drainage: Because the rear (north) of the property drains to the adjacent side or back yards, a site plan will need to be provided that includes Proposed drainage patterns for the finishod parcel. All new hard surface area should drain to 44 ~/2 Avenue. 3. Any addition of house gutters should also drain to the front (south). One of tho major constraints to furthoring new development in tho City is that tho community is essentially fully developed. Tho second policy in the Land Use and Redevelopment portion of the Plan states that: "Tho infilling of vacant parcels and tho rehabilitation of existing development land will be in accordance with uses specified in the Land Use Plan." He felt tho proposal is consistent with tho City Comprehensive Plan. Commissioner Ramsdell asked when tho area was originally developed. Mr. Eckenroth stated that his lots were platted in 1970. He sold his former home at 1101 and has had tho two vacant lots for sale since April of 1997. He has a builder interested to purchase both parcels if the variances are granted. Council Representative Peterson asked what the proposed price of the new homes would be. Mr. Eckenroth stated that they would be approximately $100,000 maybe slightly more. Motion by Ramsdell, seconded by Hunter, to recommend to the City Council the approval of a variance of five (5) feet from the one side yard setback requirement of ten feet to allow two five foot side-yard setbacks at 1111 N.E. 44 I/2 Avenue because topography on tho property creates a hardship. Mr. Hollman presented the request form Mr. George Eckenroth for a variance to allow the construction of an approximately 1,176 square foot home at 1105 N.E. 44 Y2 Avenue with two five foot side yard setbacks. He informed the Commission that Section 9.108(4) of tho Columbia Heights Zoning Ordinance requires that when a lot is not served by a public alley, tho property shall have one side yard not less than 10 feet and tho othor side yard sholl be five (5) feet. This will require a variance of five (5) feet. Mr. Hollman stated that tho surrounding property in all four directions is zoned R-2, Two Family Residential, and is used residentially with tho exception of tho adjacent lot to tho east which is vacant adding that this lot is the subject of Case//9901-02. Mr. Hollman informed the Commission that Section 9.108(4) of tho Zoning Ordinance requires the following lot dimensions in tho R-2 District: Minimum lot area shall be 6,500 square feet. The subject property is 52.5 feet wide, so it does not meet this requirement. Section 9.104(4) of the Zoning Ordinance states that a lot of record which does not meet the requirements of this Ordinance as to area or width may be utilized for single family detached dwelling purposes provided that 60% of the minimum lot area or lot width requirements are met. The existing lot does not meet the 60 foot lot width requirement, but it does exceed the 60% minimum fot area requirement, so the lot is in compliance with the Zoning Ordinance. Front yard shall be 25 feet. The proposed house will meet this requirement; The rear yard shall be 30 feet. Do Public Hearing Conditional Use Permit Case #9901-04 Letness/Holmgren d/b/a Heights Theater 3951 Central Avenue Mr. Hollman presented tho request of Thomas Letness and David Holmgren for a Conditional Use Permit to allow an owner/occupied dwelling unit on tho second floor of tho Heights Theater at 3951 Central Avenue. Tho theater owners have stated that it will be convenient for them to live on-site as thoy p£an to provide some daytime programming as well as evening showings. Daytime showings will cater to tho senior population. Mr. Hollman informed tho Commission that tho surrounding property in all four directions is zoned CBD, Central Business District. The property to tho east is used for United Methodist Community Church while tho property on the north, south, and west is used commercially. He stated that Section 9.112(2) of tho Zoning Ordinance allows dwelling units in tho Central Business District as a Conditional Use Permit provided that: PLANNING AtUO ZONING CQMM~ION REGULAR MEETING- MINUTES JANUARY 5, 1999 Page 9 Tho units do not occupy tho first floor; and, A roof intended for usable space shall be enclosed by a wall or fence not less then five feet in height. Mr. Hollman stated thet tho applicants propose to utilize tho second story of tho building for tho apartment and do not intend to utilize the roof. This apartment unit will be owner/occupied and will not be offered for rent. The proposal meets the two conditions establishod in the Zoning Ordinance. In addition, Section 9.112(4)(c) states that any apartment having two bedrooms shall have not less then 720 square feet of floor area. Tho proposed apartment will have roughly 1,300 square feet of floor area containing two bedrooms, one and ~/2 bathrooms, living room, dining room, and a kitchen all on the second floor. Tho projection booth will share the second floor of the building. According to the City Building Official, the projection booth will need to be separated from tho living space by a fire wall. He noted that tho plan submitted with this application does indicate that there will be a fire wall separating the two uses. Another concern regarding tho need to separate tho two uses pertains to noise. For example, should the occupants of tho apartment be using the kitchon (running water, washing dishes, etc.), the noise from this could carry down to tho theater as tho kitchen is adjacent to tho projection booth. If this area is directly above any seating, tho owner may want to provide sound insulation. Mr. Hollman stated that minimum yard and density requirements are as follows: Every lot shall have a minimum frontage of 20 feet. Tho existing parcel meets this requirement; Front Yard shall be one foot. The existing building meets this requirement; and, The floor area ratio shall not exceed 6.0. The floor area ratio is at about .9 which exceeds the minimum requirement. Mr. Hollman stated that tho parking requirements for a thoater are at least one space for each eight seats. The existing parking lot has 24 parking stalls, two of which are handicap accessible spaces and two of tho 24 spaces will be designated as owner/occupied parking which will leave 22 spaces for tho thoater. Staff is making the assumption thet customers of tho theater also hove access to the municipal parking ramp, so tho minimum number of off-street parking spaces is met. He noted that this ramp is relatively full during weekdays, but most of tho traffic generated by tho thoater will occur during tho evening and on weekends, although additional daytime programming is planned. Should off-street parking become a problem, ho suggested tho owners may want to consider approaching tho United Methodist Community Church to discuss a joint parking arrangement which is permissible according to zoning regulations. Mr. Hollman informed tho Commission that, according to the Central Avenue median plan, this site does not have access to southbound traffic along Central. There is a driveway to the parking lot from Central Avenue, so the existing parking lot has access from the back driveway serving tho property as well as Central Avenue. The off- street parking design in this area is awkward and can be confusing to customers. Staff will recommend, as a condition of approval, thet tho owners work with staff to prepare a parking lot striping plan that clearly identifies circutation routes and parking spaces, and tho parking lot should be restriped to match the plan. t~LANNtNG ANO ZONING COMMISSION REGULAR MEETING- MINUTES JANUARY 5, 1999 Page 10 Mr. Hollman referred to a potential layout prepared by Staff included in his report. This layout provides a combination of 90 degree and parallel parking which will accommodate two-way traffic. Tho existing layout has diagonal parking which only serves traffic coming from the rear driveway. Having visited the site, staff did not see any signage prohibiting two-way traffic. He noted that tho layout proposed by staff only has 18 spaces marked which is six less than the existing parking lot. One of these spaces is required 'to be a van accessible handicap space. Considering that the site has use of tho municipal ramp, minimum parking requirements will still be met. Also, tho proposed layout provides a 20 foot drive aisle which is sufficient for this design, and the spaces facing the building are set back one foot from the building and a bumper curb is shown which will further separate parked vehicles from tho building. Mr. Hollman stated that the City's Comprehensive Plan designates this area for future commercial development. Turning the second floor into a dwelling unit does not impact the goals and objectives of the existing Comprehensive Plan. Although, encouraging mixed-used development has been discussed during tho current Plan update process. He added that this proposal is consistent with that philosophy, but nothing has been formally adopted to date. Mr. Hollman informed the Commission that it was brought to his attention that tho lights on the marquee for the theater were fleshing/moving which is in violation of the Sign Ordinance. He stated that it would be necessary that the lights be steadily lit and not flashing or moving. Council Representative Peterson felt that the flashing lights fit with the old style and design of the original theater and felt that the City should try to accommodate the significance of having the lights flash as originally designed. Commissioner Ramsdell suggested that the flashers be turned off upon closing so that tho lights stay steadily lit during off hours and flash during movie showings. Mr. Hollman stated that tho flashing or moving lights are prohibited by tho current Sign Ordinance and suggested this item be proposed to the City Attorney for direction. Thomas Letness, one of tho owners, wes present. He informed the Commission and staff that tho area to be used for living area is over an old storage area, so no noise should be transferred below. He also stated that they have a verbal agreement with Community Methodist Church to share parking lots as long as movies are not shown during church services. He added that tho need to live on site is very important as ho prefers to be a "hands on" owner and give tho property tho attention it needs. He went into a description of all ~ho work that has been done as well es what is being planned for tho site. Commissioner Hunter inquired as to whether tho rooftop equipment would be screened. Planner Holman read Section 9.117(3)(g) of tho Zoning Ordinance which states 'Mechanical equipment located on tho roof of any building shall be screened with material designed to blend harmoniously with that building's facing material so that such equipment is not visible at street level or from neighboring properties". Discussion was hold on how the equipment could be screened or if painting of tho equipment would be sufficient. PLANNING AND ZONING COMMISSION REGULAR MEETING- MINUTES JANUARY 5, 1999 Page 11 Commissioner Ramsdell asked staff to relay his concerns to the Building Official regarding the provision of a fire escape from the second floor apartment, would the stairs be required to be fire rated and do the existing windows meet the egress requirement? Commissioner Fowler asked Mr. Letnass if he knew what the prior history was regarding tenants of the theater. Mr. Letness stated that the second floor was used for a variety of offices including a dentist, library, driving school. The building was built in 1927 and remodeled in the late thirties or early forti~ and again over later years.. Motion by Ramsdell, seconded by Fowler, to recommend to the City Council the approval of the Conditional Use Permit to allow an owner/occupied dwelling unit on the second floor of the Heights Theater at 3951 Central Avenue, subject to the following conditions: 1. All required state and local codes, permits, licenses and inspections will be met and in full compliance. At no time shall any space directly associated with the dwelling unit occupy the first floor of the building. This shall include, but not be limited to, kitchens, restrooms, and bedrooms. The parking lot shall be restriped in a manner that is consistent with a parking lot striping plan that has been submitted for staff review and approval by July 1, 1999. A separate Conditional Use Permit application will need to be reviewed and approved if the dwelling unit changes from owner-occupied to rental and/or if the building changes ownership. It was a consensus that the uses of the Retail Zoning Distdct would most closely relate to the tatoo shop use.
