A RESOLUTION IN FAVOR OF MUNICIPAL ZONING AUTHORITY IN THE
MATTER OF THE LOCATION OF LICENSED RESIDENTIAL PROGRAMS (GROUP HOMES)
UNDER MINNESOTA STATUTES 1987 SUPPLEMENT, SECTION 245A.11, SUBdiVISION 3,
AND tN OPPOSITION TO CHANGES PROPOSED BY S.F. NO. 1626 AND H.F. NO. 2154
WHEREAS, the State of Minnesota is a leader in the area of community based
treatment for individuals through licensed residential programs (Group Homes);
and,
WHEREAS, a licensed residential program has the greatest chance of success if
there is a cooperative effort among the agency directing the program, local
residents in the neighborhood, and municipal government officials; and,
WHEREAS, local government zoning authority through the process of a special use
permit or a conditional use permit has heretofore been recognized in the law as
a means of assuring proper maintenance and operation of a licensed residential
program; and,
WHEREAS, the use of local zoning authority through the process of a special use
permit hearing or a conditional use permit hearing provides a conduit for
community information and comment and ultimately contributes to the under-
standing of licensed residential programs; and,
WHEREAS, S.F. No. 1626 and H.F. No. 2154 would eliminate the requirement of a
special use permit or a conditional use permit in multi-family residential
areas for a licensed residential program with a licensed capacity of seven (7)
to sixteen (16) adults;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLUMBIA
HEIGHTS that the City Council expresses its opposition to the changes proposed
in S.F. No. 1626 and H.F. No. 2154; and, furthermore, declares its support to
continue and maintain the zoning authority as currently provided in Minnesota
Statutes 1987 Supplement, Section 245A.11, Subdivision 3.
