Be it further resolved that special assessments of record in the office of the
City of Columbia Heights as of this day, against the above described property,
in the amount of $ -0- be divided. Paid.
Any pending or future assessments will be levied according to the new split as
approved this day.
Any lot split given approval shall become invalid if the reso]ution, motion or
other Council action approving the said lot split is not filed with the County
Auditor within one (l) year of the date of the Councl) action.

I. That part of Rearrangement of Block E, Columbia Heights Annex, Anoka County,
Minnesota, described as follows:

1. The South Half of Lot 2 in said Rearrangement of Block E, lying easterly
of the east line of University Avenue
2. All of Lots 3 and 4 in said Rearrangement of Block E, lying easterly of
the east line of University Avenue
3. That part of Lots 5,6, and 9 in said Rearrangement of Block E lying easterly
of the east line of University Avenue N.E. and lying northerly and westerly
of the following described line:
Commencing at the northeast corner of said Lot 5, in said Rearrangement of
Block E, Columbia Heights Annex; thence South 30 degrees 20 minutes 16 seconds
East on an assigned bearing along the easterly line of Lots 1 through 8 in said
Rearrangement of Block E, a distance of 32.33 feet to a 1/2" inside diameter iron

Beginning at the Southeast corner of Block "E"; thence North with the
West line of Fifth Street N.E. 171.6 feet; thence Northwesterly with the
Southwesterly line of Lookout Place 182 feet; thence Southwesterly to a point
in the Northeasterly line of alley and in the Northwesterly radial boundary
line of the above described part of said Block 70, said radial boundary line
being produced to the Northeasterly line of said alley; thence with the said
Northeasterly line of alley Southeasterly to the North line of Thirty-eighth
Avenue N.E.; thence East with the North line of Thirty-eighth Avenue N.E. to
the point of beginning.
6. Vacated Edgemoor Place lying easterly of the easterly line of University
Avenue N.E. and northerly of the north line of 38th Avenue N.E.
7. That alley vacated by Ordinance No.59 and Ordinance No.38 lying easterly of

This shall be effective upon completion of all four of the following
conditions:
Certification by the Columbia Heights City Engineer that he finds
the City has all necessary easements for storm water drainage on
said parcels.
Certification by the Columbia Heights City Engineer or City
Attorney that he finds that the applicant has title to the
parcels sufficient to make the application for the lot split·

Certification by the Columbia Heights City Attorney that he finds
that adequate assurances by means of covenants running with the
land have been executed by the owner of the parcels and properly
filed to prevent the owner of the parcels from further
subdivising without Council approval the parcels created by this
resolution in order to assure maintenance of current parking
facilities.
Certification by the Columbia Heights City Engineer that the
applicant has completed the items contained in the letter of
December 14, 1987, from A.M. Fulton, Plant Manager, Minneapolis
Electric Steel Castings, to the City.
