HomeMy WebLinkAboutResolution 86-19A RESOLUTION NO, 86-.t9 A RESOLUTION AUTHORIZING DISPATCH AND USE OF CITY EQUIPMENT AND SERVICES BY CITY MANAGER IN EMERGENCY SITUATIONS WHEREAS, the City Council finds that instances have occurred in the past and can be anticipated in the future wherein there is a danger by fire, hazard, casualty or other similar occurrences taking place or occurring outside the ter- ritorial limits of the City of Columbia Heights~ and by the suddeness thereof it would be impossi'ble or impractical for the City Council to meet and authorize the dispatch and use of City equipment and personnel to combat such fire, hazard, casualty or other si'milar occurrence; therefore, BE'IT RESOLVED by the Columbia Heights City Council as follows: The Council finds it desirable and necessary to authorize the City Manager or his designee to exercise discretion, considering at all times and in each case the internal needs of the City of Columbia Heights and its inhabitants, to dispatch City equipment and personnel as deemed necessary to combat such occurrence whether it takes place within or without the City limits, BE 1T FURTHER RESOLVED that such di'spatch and use as directed by the City Manager or his designee shall be fully authori'zed as an act of the City of Columbia Heights and all provisions for compensati~on of personnel, rental of equipment, liability insurance coverage, workmanls compensation insurance and all other safeguards and matters pertaining to the City, its equipment and personnel, shall apply in each case as if specifi~catly authorized and directed by this Ci'ty Council at such time, whether or not the governing body or authority of the place in which the fire, hazard, casualty or other similar occurrence exists, has previously requested and provi~ded for assistance and the use of the equipment and personnel under a mutual protection agreement or other type protection agreement with the City of Columbia Heights, FURTHER, the City Manager or his designee shall reca11, order and terminate the use of such equipment and personnel when the need for their use no longer exists, or earli'er, when at his discreti'on i't appears in the best interest of the City of Columbia Heights, Adopted by the City Council on March 13, 1986, Offered by: Peterson Seconded by: Paulson Ro11 call: All ayes Willia. mLE'lr~ite, Ci ty c]er~ . ~//~;~-"--~l~wF~e~t/~r ~_inist~'atio.n/ Robe~rt Bocwins~i, City Manager Ma~uce G, Nawrock~ R~n~[d/Kal ina, City Attorney
