HomeMy WebLinkAboutResolution 82-46RESOLUTION NO. 82-46 WHEREAS, the City of Columbia Heights, Minnesota is the owner of sanitary sewer interceptors running from the connection with City of Hilltop, Minnesota sanitary sewer pipes at (1) 45th Avenue Northeast at dackson Street Northeast and (2) at Quincy Street Northeast to intersection with Fridley, Minnesota Interceptor No. 4-FR-440 at 2nd Street and 45th Avenue Northeast; and, WHEREAS, the City of Columbia Heights, Minnesota is the owner of sanita~-y sewer interceptors running from the connections with City of Hilltop, Hinnesoca sani- tary sewer pipes at (l) 49th Avenue Northeast and dackson, (2) 47th Avef~ue North- east and Monroe Street, (3) 48th Avenue Northeast and Monroe Street and (4) at 49th Avenue Northeast east of Monroe westerly to intersection with Colurabia Heights Interceptor No. 1-C0-443 at 2½ Street and 45th Avenue Northeast; and, WHEREAS, a substantial portion of the interceptor running along Quincy Street North- east in Co!umbia Heights had deteriorated and required replacement; and, WHEREAS, the proper officials of the City of Columbia Heights requested the proper officials of the City of Hilttop to contribute to the cost of such replacement in proportion to the amount of sewage contributed by Hi]ttop to the said interceptor at the point of replacement; and, WHEREAS, the City of Hilltop refused and continues to refuse to pay its equitable share of the cost of such replacement; and, WHEREAS, on occasion in the past the above mentioned interceptors have accepted sewage and surface water run off in excess of their capacity, thereby causing sewage to back up or become discharged into the basement of houses of Columbia Heights, Minnesota residents; and, WHEREAS, the City Councit of the City of Columbia Heights, Minnesota deems it to be in ~he interest in the health, safety and welfare of the citizens of the City of Columbia Heights, Minnesota to terminate the use by the City of Hilltop of the said interceptors located in the City of Columbia Heights, Minnesota thereby lessening the amount of sewage and surface water runoff the said inter- ceptors are required to carry. NOW, THEREFORE, Be it resolved: The City Manager is directed to notify the City of Hilltop and the Netro- politan Waste Control Commission of the intention of the City of Columbia Heights not to renew its Joint Use Rental Agreement, Contract No. 145, with the Metropolitan Waste Control Commission for the rental by the Commission of sanitary sewer interceptors in the City of Columbia Heights during the year of 1983.
