AUTHORIZING THE ACQUISITION OF CERTAIN PROPERTIES
THROUGH THE POWERS OF EMINENT DOMA2N FOR PUBLIC
PURPOSES.
BE iT HEREBY RESOLVED, by the City Council of the City of
Columbia Heights, that the City Attorney, be and he is hereby
authorized to proceed with acquisition through condemnation,
of the Northerly Five-feet of Lot 1, Block 8, Hilltop.
BE IT FURTHER RESOLVED, that said Five-foot parcel be
utilized for public utilities and street purposes.

City of Columbia Heights - Village of St. Anthony
Stinson Boulevard & 37th Place
THIS AGEEEHENT~ between the Village of St. Anthony~ a municipal
corporation~ hereinafter referred to as "Vi llage~" and the City of Columbia
Heights, a municipal corporation, hereinafter referred to as i'City~" has
as its purpose the construction of a permanent street surfacing on Stlnson
Boulevard north of 37th Avenue~ which boulevard is a boundary street between
the Village and City, and the surfacing of 37th Place, which street is located
entirely within the City. The construction will consist of a 6J+-foot wide
concrete street with concrete curbs and gutters.

The Vii 1age wi 11 supervise the said construction and cause the
road to be built in accordance with Plans and Specifications for said project.
The Vitlage agrees that the supervision and direction ot: the project by it
shall be under the supervision of a registered professional engineer and the
construction of the road will be open to inspection to the City Engineer oi~
the City of Columbia Heights or his duly authorized representatives. The
estimated cost ot: the total construction is as i~ollows:

The City shall reimburse the Village for the actual cost of con-
struction of that part of Stinson Boulevard lying ~Test of the centerline of
the proposed pavement and for 100% of the actual cost of 37th Place.
Actual cost shall be determined by final constructed quantities
at unit contract prices, as reported by the engineer~ Comstock and Dav.iso
Legal~ administration, engineering, staking and inspection costs
shall be shared on the basis of the ratio of the City's share to the Village
share.
The Village shall cause the Plans and Specifications to be prepared
and copies of all engineering Plans lhall be furnished by the Village to the
City. A change in the Plan shall be made in writing sub.~ect to the approval
in writing by all the parties.
The Village shall award the contract to the lowest responsible
bidder and upon receipt of the bids for the construction contemplated herein
proaptly submit to the City Engineer of Columbia Heights a copy of the low
bid received and an abstract of al! bids received together with the Villagers
requests for concurrence by the parties in the proposed award of the construct-
ion contract. The Village she1] not make such construction contract award

The Village shall keep such records and accounts as shat1 enabte the
Village upon completion of the work to submit to the City a detailed statement
showing the amount due to the Village for the work performed hereunder. This
statement shall list the items and quantities of the work performed that are
to be paid for as provided herein, the actual cost thereof computed at contract
unit prices and the partyts share of the cost thereof. It is understood that
the Village sha~ll produce its records and accounts in connection with this
Agreement for examination if so requested by a duly authorized representative
of the City, Each month the City will process the statement submitted to it
by the Village and obtain the City's approval for payment so that within thirty
(30) days after submission to the City of a detailed statement by the Village
showing its share of the work performed 90 per cent o~= said amount will be
available to She Village for payment to the contractor as the work progresses
and the retained percentage will be paid when all work is performed and
accepted by the Village and the City.
The Village agrees to indemnify~ save and hold harmless the City and.
all its agents and employees from any end all claims~ demands~ actions and
causes of action of whatsoever nature or character arising out of or by reason
of the execution of the performance of the work provided for hereunder and
further agrees to defend at its own sole cost and expense any action or suit
commenced for She purpose of asserting any claim of whatsoever character
arising as a result of the work to be performed hereunder.
]:t is further agreed that any and all employees of the Village and
all other persons employed by the Village in the performance of any work or
services required or provided for herein shall not be considered employees
of the City and =11 cl=ims that may or might arise under the ~/orkmen~s
Compensation Act of the State of Hinnesota in behalf of said employee while
so engaged and ali claims made by any third party as the consequence of any
act or omission on the part of the said Village employees while so engaged
in any work or services provided to be rendered herein sh=11 in no way be
the obligation or responsibility of the City.

Before this Agreement sba1! be binding and effective~ it shall be
approved by Resolution of the Council of the City of Columbia Heights and the
Village of St, Anthony.
IN TESTIHONY V/HEREOF~ The parties hereunto duly executed this
Agreement by their duly authorized officers and caused their respective

RESOLUTION NO. 68-033
A RESOLUTION AUTHORIZING THE MAYOR AND THE
MANAGER TO ENTER INTO AGREEMENT WITH THE CITY
OF COLUMBIA HEIGHTS FOR THE IMPROVEMENT OF
STINSON BOULEVARD.
BE IT RESOLVED, that the Mayor and Village Manager are hereby
authorized to enter into agreement on behalf of the Village with the City of
Columbia Heights for the improvement of Stinson Boulevard, said City of
Columbia Heights to reimburse the Village for the actual cost of construct-
ion of that part of Stinson Boulevard lying West of the center line of the
proposed pavement and for 1OO% of the actual cost of 37th Place, said
costs to be determined by liana1 constructed quantities at unit contract
prices with legal, administration, engineering, staking and inspection
costs to be shared on the basis of the ratio of the city's share to the
Village share.
