HomeMy WebLinkAboutResolution 67-21BE IT I-1ZREBY RESOLVED by the City Council of the City of Columbia Heights, ~VI-iEREAS~ the City Council Sf the City of Columbia Heights has deemed it necessary for the preservation of the public peace, health and safety that the attached Veteran's Preference Bill relating to the City of Columbia Heights should be passed by the legislature of the State of 1Vfinnesota during t~e 19'67 session. THEREFORE, IT IS HEREBY RESOLVED, that the attached Bill for an Act relating to the City of Columbia Heights should be passed by the legislature of the 1967 session. A BILL FOR AN ACT RELATING TO THE CITY OF COLU1VIBIA HEIGHTS; DEFINING THE RIGHTS AND PRIVILEGES OF VETERANS EMPLOYED BY OR SEEKING E1VrPLOY1ViENT IN THE FIRE AND POLICE DEPART- NFENTS OF SUCH CITY. BE IT ENACTED BY. THE LEGISLATURE OF THE STATE OF MINNESOTA: Section 1. (COLU1VfB!A HEIGHTS, EMPLOYMENT OF VETERANS IN FIRE AND POLICE DEPARTIVtENTS.) In the City of Columbia Heights a veteran applying for employment in its fire and police departments shall be given the rights, privileges, and preferences herein provided for. Section 2. (APPLICATIONS ~CERTIFIED.) Any veteran applying for original employment who passes the examination for a position in the fire and police depart- ments in the City of Columbia Heights shall be employed over other applicants there- for; and if the veteran is of good moral character and can perform the duties of the position applied for and has passed the entrance examination, said veteran shall be certified and appointed to the position or place for which he has applied before any non-veteran is certified or appointed. Section S. (RATINGS OF VETERANS.) To the rating of a disabled veteran in the employ of the fire and police departments of the City of Columbia Heights who achieves a passing grade on the examination other than for original employment, there shall be added a credit of five points, and to the rating of every other veteran in the employ of the fire and police departments of such City who achieves a passing grade on the examination other than for original employment, there shall be added a credit of three points. The veteran's or disabled veteran's name shall then be placed on the list of eligibles with other eligible persons. The name of a veteran or disabled veteran, with such augmented rating~ shall be entered ahead of that of a non-veteran when their ratings are the same. -vVhen the three highest names on the list of eligibles are certified to the appointing authority,~ they may appoint any one of such three without regard to whether the appointee is or is not a veteran or disabled veteran. Section 4. (NO INQUIRY INTO APPLICANTS' STATUS} No inquiry shall be made of any applicant for examination before such examination as to whether or not he is a veteran or disabled veteran, nor shall any distinction be made in giving the examination or grading the results thereof on account of the fact that the applicant may be a veteran or disabled veteran. All applicants who pass any examination shall be informed of the right of a veteran for preference. The preference credit shall be added to the examination rating when the preference is claimed by the civil service authority of the fire and police departments of the City of Columbia Heights and the records shall show the examination rating and preference rating. Section $. (DEFINITIONS.) For the purpose of this chapter, the terms "veteran" and "disabled veteran" shall be given the definition set forth in tVtinnesota Statutes, Section 43.30; provided, however, that a disabled veteran must have a disability rating of ten percent or greater before being considered a disabled veteran for the purposes of this act. Section 6. (INCONSISTENT LAIAfS SUPERSEDED.i The provisions of Minnesota Statutes, Sections 197.45, !97.46, !97.47. and 197.48 are hereby super- seded by the provisions of this chapter insofar as they may be inconsistent. Section 7. This act takes effect when approved by the governing body of the City of Columbia Heights and upon compliance with the provisions of Minnesota Statutes, Section 645.021.
