HomeMy WebLinkAboutResolution 41-22RESOLUTION THE CITY COUNCIL OF THE CITY OF COLUNBIA HEIGHTS HEREBY RESOLVES: WHEREAS, The location of the Northern Pump Cpmpany's plant in the Town of l~ridley near to the city limits of the City of Columbia Heights has greatly increased the traffic on the streets of the City, ~d has mace it necessary for the City of Columbia Heights to provide addttiou~l streets as ways of ingress and egress to and from s~id plant; and, WHER~AS, Officials of said ~orthern Ptunp Cgmpany and of t~e United States Navy Department have expressed a desire to the City Council that add- itional and more direct approaches from Central Avenue N.E. in Columbia Heights be provided to the Northern PUmp CgmDany's plant; and, WHEREAS, Because of the topography of the land the d~velopment and improvement of 4$rd Avenue N.E., from Central Avenue west to meet the rail- road grade crossing at 4$rd Avenue N.E., in the Town of Fridle¥ is impracticab~ and, WHEP~, In the opinion of the members of the City Council of the City of ColuJ~bta Heights and of its City f~anager it is practicable and des- irable to improve 44th Avenue N.E. from Central Avenue west to Main Street in the City of Columbia Heights and to connect 4$rd Avenue N.E. in the Town of Fridley with the intersection of 44th Avenue N.E. and Main Street in Columbia Heights by menas of a gradual sweeping curve across Block Eight (8), Auditor's Subdivision ~o. Thtrty-~ine (S9), Anoka County, ~,iinnesota; and, WHEREAS, The City Manager of the City of Columbia Heights has l~e- pared an~ drafted plans ,~ specifications showing the course of said curving highwa~v and the land necessary to be occupied by the same; and, WEEPingS, The particular description of the lsnd lying and being in the County of Anoka, State of ~tnnesota, proposed to be taken for such high. way purposes is as follows~ That part of Block Eight (8) of ~Auditor's Subdivision No. ~i~ty-nine (~9), being a part of Sectic, n Thirty-four (~4), Township Thirty (30), Range Twenty-four (24) in Anoka County, State of Miunesota, described as follows, to-wit: A right-of- wa~v forty (4Of) feet on each side of the following described center line: Co~encing at a point One Thousand One Hundred Twenty-seven (ll27f) feet west of monument ~{.C.2. 1050 as shown on said Auditor's plat of Audi{;oZ's Subdivision 1~o. Thirty-nine ($9), which said point is on the center line of Forty-third Avenue N.E., as now surveyed snd laid out in the Town of Fridley, thence along a curve to the left in a north- easterly direction with a radius of Six Hundred Thirty-six and six tenths (636.6f) feet and an angle of Thirty-eight degrees, twelve minutes (L~8© 12t); thence along a tangent to said curve in a northeasterly direction for a distance of Six Hundred Ten (610f) feet; thence on a curve to the right in an easterly dir- ection, with the same radius ~ to the, westerly line of Main Street N.E., as now surveyed and laid out, excepting therefrom such portion of said right-of-way as includes lands now surveyed and laid out as Forty-third Avenue N.E., in the Town of Fridley, said described right-of-way consisting of two (2) acres more or less. WHEREAS, The City Manager has submitted to the City Council a plat of the proposed right-of-way above described, and the land to be acquired for purposes thereof: IT IS HEREBY RESOLVED: By the City Council of the City of Columbia Heights, County of Anoka, State of Minnesota, 1. That the City Council hereby declares that it is necessary and desirable to construct a highway on the right-of-way above described and according to the plans and specifications now on file in the office of the City Clerk, Coluabia Heights, County of Anoka, State of Minnesota, and, 2. That i~ is necessary to condem the land above described for the construction of such highway, and, S. The City Attorney be ~uud he hereby is authorized and directed to commence _,_~nd prosecute proper proceedings for the condemnation and ac- qusition of said above described land.
