HomeMy WebLinkAboutResolution 96-02CITY OF COLUMBIA HEIGHTS RESOLUTION NO. 96-02 RESOLUTION RELATING TO THE COLUMBIA HEIGHTS ECONOMIC DEVELOP~MENT AUTHORITY; TRANSFERRING CERTAIN PROJECTS AND PROGRAMS TO THAT AGENCY; APPROVING PURCHASE OF SERVICES AGREEMENT WITH THAT AGENCY; APPROVING CERTAIN ORGANIZATIONAL MATTERS BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLUMBIA HEIGHTS, MINNESOTA (CITY) AS FOLLOWS: 1. The City Council has duly adopted Resolution No. 96-02 (Enabling Resolution) providing for the creation of the Columbia Heights Economic Development Authority (EDA) pursuant to Minnesota Statutes, Chapter 469 (Act). 2. By the Enabling Resolution, the EDA is authorized to exercise all of the powers of a housing and redevelopment authority under the Act. There exists in the City a housing and redevelopment authority (HRA) created pursuant to the Act. The Act authorizes the City Council to transfer all projects and programs of the HRA to the EDA. 3. Pursuant to Section 469.094, Subdivision 2, of the Act, the control, authority and operation of all "projects*', as defined in the Act, and all other programs and projects of the HRA are transferred to the EDA. 4. The transfer described herein is conditioned upon acceptance by the EDA of such transfer and a covenant and pledge by the EDA that the EDA is obligated to perform all agreements, pledges, covenants and undertakings heretofore entered into by the HRA. 5. The City Manager is authorized and directed to transmit a certified copy of this Resolution to the Executive Director of the EDA and to other governmental officers as appropriate. 6. The Council approves the Purchase of Services Agreement between the City and the EDA in substantially the form on file in City Hall, and the Mayor and City Manager are authorized and directed to execute such agreement on behalf of the City. 7. Pursuant to Section 469.100, subd. 2 of the Act, the Council directs to the EDA to submit the EDA's budget for each fiscal year to the City at the time designated by the City Manager but no later than September 1 ot~ each year. 8. Pursuant to Section 469.100, subd. 4 of the Act, the Council directs the EDA to submit the EDA's written annual report to the City on or before the date of the EDA*s annual meeting as described in the EDA by-laws. The Council directs the City Manager to specify the form of the report. 9. The Mayor, City Manager and all other officers and employees of the City are authorizedand directed to take whatever action and to execute and deliver such documents that are necessary to give effect to this Resolution.
