DIRECTING THE CITY ENGINEER TO PROCEED WITH THE SUBMITTAL
OF A VARIANCE REQUEST TO THE COMMISSIONER OF TRANSPORTATION
FOR 39TH AVE. N.E. FROM STATION 36 + 50 TO 38 + 00 AND
FROM STATION 39 + 50 TO 40 + 21
WHEREAS, the City wishes to overlay 39th Avenue N.E. from 5th Street to T.H. 65
and whereas, the existing sag and crest vertical curves, respectively, do not meet
the minimum required length for 30 MPH; and
WHEREAS, the Minnesota Department of Transportation Rule 8820.9945 requires that
State Aid Streets have a minimum design speed of 30 MPH based on stopping sight
distance; and
WHEREAS, State Aid Rules provide that a political subdivision may request a
variance from these rules;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Columbia
Heights:
That the City Engineer be directed to submit to the Commissioner of Transportation
a formal request for variance from adopted Rule 8820.9945 to permit the overlay
of 39th Ave. N.E. from 5th St. to T.H. 65 with less than the minimum required
vertical curve length for 30 MPH from Station 36 + 50 to 38 + 00 and 39 + 50 to
--0 + 21.
