PUBLIC IMPROVEMENT HEARING
JANUARY 27, 1998
1. ROLL CALL

Mayor Pro-Tem Peterson called the Public Improvement Hearing
to order at 7:00 p.m. Present were Mayor Pro-Tem Peterson and
Councilmembers Szurek, Jolly and Ruettimann. The Public Works
Director and the Assessment Clerk were introduced.
PUBLIC IMPROVEMENT HEARING: 1998 STREET REHABILITATION PROGRAM
The Public Works Director made general comments regarding the
proposed street rehabilitation program. He stated there were
fifty-five property owners who attended the informational
meeting on January 8th regarding Zone 3. He has received no
negative comments about the proposed projects.
People were reminded that this is an improvement hearing and
not an assessment hearing. The assessment hearing for these
projects will be held in the Fall. Also, another informational
meeting will be held for residents to meet the contractors and
the field representatives for the various contracts. All
affected property owners will be notified of this meeting.
The Public Works Director reviewed the boundaries of Zone 3.
He also reviewed how the streets are "rated" by the
Engineering Department staff. Each street in the project area
is viewed by engineering staff and/or a consulting testing
company. Recommendations for work are made based on this
rating.
A. Street Reconstruction Projects
1) Presentation of Information on Street Reconstruction
Projects
The Public Works Director advised there are three areas in the
street reconstruction projects. He identified the boundaries
of the project areas. The affected streets are Forest Drive,
Highland Place and East Upland Crest. There appears to be no
significant changes in associated costs since the
informational meeting.
Councilmember Jolly felt the Council should be advised of the
status of the utilities in the project area. The Public Works
Director stated he has a supplemental report for this.
Councilmember Ruettimann suggested this is an opportune time
for property owners to replace their water services and
connections. It's timeliness could be cost-effective.

2) Questions and Comments on Street Reconstruction Projects
There were no questions nor comments.
B. Recycled Base with New Bituminous Surface Project
1) Presentation of Information on Recycled Base
The Public Works Director reviewed this project noting that it
could be viewed as a "partial" reconstruction.
2) Questions and Comments on Recycled Base
The resident at 1255 Polk Place felt the project was not
justified and that a sealcoat would be sufficient. He also
questioned the legitimacy of the Infrastructure Fund. His
other concern was with the interest rate being proposed which
was 9 1/2%. He referred to information he had regarding recent
bond issues with their associated interest rates. He noted
they were all below 5%. He calculated the 9 1/2 % rate over a
period of ten years and 5% over a period of ten years. He felt
if bonds were issued for these projects the rate of interest
should be below 5%.
The City Manager reminded property owners that the interest
rate is not going to be set at this hearing. He also mentioned
the limit is set by statute.
The resident at 1295 Polk Place stated he had received two
statements for both sides of his home which is on Polk Place
but adjacent to Pierce Terrace. He noticed that each statement
had different per foot costs. Polk Place is being partially
reconstructed whereas Pierce Terrace will be receiving the
mill and overlay. This property owner's observation is that
both streets are in the same condition.
The resident at 1145 Polk Place also received two statments,
one for the property where her home is located and one for a
vacant lot next to her home. She stated as a someone who
frequently walks the streets with her children her observation
is the streets are in fairly good condition. She suggested
that a sealcoat may be sufficient. She also stated her
interest in seeing the Braun Intertec report on the streets in
this project area.
C. Mill and 2" Overlay Project
The Public Works Director reviewed the mill and 2" overlay
project.

The property owner at 1401 Lincoln Terrace felt doing the
project was long overdue. She also felt the assessment formula
used an antiquated method and questioned the 9 1/2 % interest.
She suggested a per unit basis would be a more appropriate
formula for assessing property.
It was explained that in Zone 1 and Zone 2 the grid system was
used whereas in Zone 3 a different method was used for
determining assessments. The streets in Zone 3 are contour.
D. Close the Public Hearing
The Public Hearing on the 1998 Street Rehabilitation Projects,
PIR #958, 959, 960, 954, 955, 957, 972, 973, 971, 953, 956,
967, 968, 969, 970, 974, 975 and 976 was closed.
E. Consideration of Resolutions
Motion by Jolly, second by Szurek to waive the reading of all
of the following resolutions there being ample copies

sidewalk/step replacement, resodding and miscellaneous
associated construction items. The proposed street width is
33' from back of curb to back of curb.
2. Such improvement is necessary, cost-effective, and feasible
as detailed in the feasibility report.
3. Such improvement is hereby ordered as proposed in the
Council Resolution adopted 22nd day of December, 1997.
4. These improvements shall also be known as P.I.R. #958 -
Project 9708.
5. Kevin Hansen is hereby designated as the engineer for this
improvement. The engineer shall prepare plans and
specifications for the making of such improvement.
