ROLL CALL Jolly, Nawrocki, Ruettimann, Peterson, Sturdevant - present RESOLUTION NO. 94-78; CANVASSING MUNICIPAL SPECIAL ELECTION RESULTS Motion by Ruettimann, second by Peterson to waive the reading of the resolution there being ample copies available for the public. Roll call: All ayes RESOLUTION NO. 94-78 CANVASSING MUNICIPAL SPECIAL ELECTION RETURNS WHEREAS, the City of Columbia Heights did on the 8th day of November, 1994, conduct and hold a Special Municipal Election for the purpose of determining if the City shall spend up to $350,000 towards the construction of a $700,000 multi-purpose recreation center with the balance of the construction costs to be financed through an equal amount of contributions; and WHEREAS, the City Council of the City of Columbia Heights at a meeting of said Council held on the 14th day of November, 1994, did canvass the returns and results of said Special Municipal Election; and WHEREAS, the following results were determined by said canvass of said Special Municipal Election, to wit: TOTAL BALLOTS CAST IN ELECTION: 7,660 Valid Votes Cast for the Question Yes 3,400 No 3,964 Undervotes 0 Overvotes 0 Times Blank Voted 296 SPECIAL CANVASS MEETING NOVEMBER 14, 1994 PAGE 2 NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights that the question of the City constructing a multi-purpose recreation center was defeated with a no vote of 3,964 to a yes vote of 3,400. Accept Donation of $400 from the Columbia Heights Athletic The Council accepted the donation of $400 from the Columbia Heights Athletic Boosters, Inc. Approval of License Applications The Council approved the license applications as listed upon payment of proper fees. APPROVAL OF CONSENT AGENDA Motion by Nawrocki, second by Ruettimann to approve the Consent Agenda as presented. Roll call: Ail ayes OPEN MIKE/PROCLAMATIONS/PRESENTATIONS a. Proclamation - National Home Care Week Mayor Sturdevant read the proclamation designating November 27 to December 3, 1994 as National Home Care Week. Comments Regarding Property at 675 47th Avenue Neighbors in the area of 675 47th Avenue were in attendance at the Council Meeting to express their interest and/or concerns regarding the future of this property. Mary Gilbertson, a spokesperson for the neighborhood, submitted a petition from area property owners, which addressed their support for having this property purchased and given to Habitat For Humanity for development. She advised the Council of the current poor condition of the property. She also mentioned the neighbors' opposition to having this property be sold and used for rental purposes. Discussion followed regarding possible assistance available for the purchase of the property, demolition of the house and marketing strategies. PUBLIC HEARINGS/ORDINANCES/RESOLUTIONS a. First Reading of Ordinance No. 1285 - Pertaining to Home Occupations Councilmember Nawrocki felt there have been significant changes to the ordinance being proposed and it should be discussed at a Council work session. Motion by Peterson, second by Ruettimann to waive the reading of the ordinance there being ample copies available for the public. Roll call: All ayes ORDINANCE NO. 1285 BEING AN ORDINANCE AMENDING ORDINANCE NO. 853, CITY CODE OF 1977, AND PERTAINING TO HOME OCCUPATIONS The City of Columbia Heights does ordain: Section 1: Section 9.103(31) of Ordinance No. 853, City Code of 1977, which currently reads as follows, to wit: 9.~03(31~ Home Occupations: Any gainful occupation meeting all of the following requirements: When engaged in only by persons residing in the dwelling, which does not require additional parking, when evidence of the occupation is not visible from the street, when the principal structure becomes the base of operation for that occupation, and when not involving the retail sales on the site of products produced off the site. Section 2: Section 9.107(3)(d) of Ordinance No. 853, city Code of 1977, which currently reads as follows, .to wit: 9.107(3%(d~ Home occupations, subject to an annual renewal and reapplication if it has changed in scale or character. is hereby amended to read as follows: 9.107(3~(d~ Home occupations, subject to the following ¢oDditions: 1. No outside storage of products~ materials or equipment connected with the home occupation is permitted. 2. The home occupation must be conducted within the principal building or residential garage. 1. If the home occupation is conducted in a garage, the minimum amount of required garage parking spaces sha~ be maintained for Darkinq. 3. The bom9 occupation shall meet all applicable fire and building codes as well as any other applicable City. State or Federal regulations. 4. At no time shall the home occupation generate traffic or parking that exceeds the type and level which typically ~ervice single family residences. Traffic and parking which ~ceeds the type and level typically servicing single family residences shall be deemed to constitute a nuisance and/or ~afetv hazard. 5. No use of mechanical equipment or process shall be used which generates noise, fumes, odor. smoke ~lare. vibration, ~ectrical interference, waste or puts a strain on public utilities other than is reasonable for a residential zoning district. Signage pertaining to the home occupation will be allowed on the premises not to exceed two square feet and provided it be attached tQ ~he wall of the structure and not be illuminated. 8. Any home occuDation shall be subject to a one-time registration, with the fee for such reaistration as determined by the City Council. Each registration will include, as a minimum~ the address of the home occupation, the name of the o~cupanto and the Q~¢upation or profession involved. 9. Any home occupation which does not meet these specific conditions for a permitted home occupation shall not be permitted. Section 3: Section 9.107(2)(g) of Ordinance No. 853, City Code of 1977, which currently reads as follows, to wit: 9.107(2%(~%: Home occupations subject to an annual renewal and reapplication if it has changed in scale or character. is hereby d~leted in its entirety. Section 4: This ordinance shall be in full force and effect from and after thirty (30) days after its passage. Public Hearing - License Revocation $or Rental Property at 3849 Jackson Street The Enforcement Officer advised that the property owner occupies half of this double bungalow. He noted there is some progress being made to bring the units into compliance. He recommended that the revocation be held until next summer. Resolution No. 94-75 - Public Hearing Reaarding License Revocation for Rental Property at 4539 Fillmore Street Motion by Ruettimann, second by Peterson to close the public hearing and waive the reading of the resolution there being ample copies available for the public. Roll call: All ayes RESOLUTION NO. 94-75 RESOLUTION OF THE CITY COUNCIL FOR THE CITY OF COLUMBIA HEIGHTS APPROVING REVOCATION PURSUANT TO ORDINANCE CODE SECTION 5A.408(1) OF THAT CERTAIN RESIDENTIAL RENTAL LICENSE HELD BY STUART S. MERZ (HEREAFTER "LICENSE HOLDER"). WHEREAS, license holder is the legal owner of the real property located at 4539 Fillmore Street N.E., Columbia Heights, Minnesota, and WHEREAS, pursuant to Columbia Heights Code Section 5.104(1)(A), written notice setting forth the causes and reasons for the proposed Council action contained herein was given the license holder on November 7, 1994, of a public hearing to be held on November 14, 1994. That on July 6, 1994, Enforcement officer, Matthew D. Field, for the City of Columbia Heights, inspected the real property and incidental buildings located thereon at 4539 Fillmore Street N.E. within the City of Columbia Heights, Minnesota, and owned, according to the application for rental license on file for the above-described real property by Stuart S. Merz. 2. Based upon said inspection of the Enforcement Officer, the following conditions and violations of the City's Housing Maintenance Code and Licensing Rental Units were found to exist, to wit. See Attached Compliance Order 3. That all parties, including the license holder and any occupants or tenants, have been given the appropriate notice of this hearing according to the provisions of the City Code Section 5A.306(1) and 5A.303(1)(d). CONCLUSIONS OF COUNCIL 1. That the building located at 4539 Fillmore Street N.E. is in violation of the provisions of the Columbia Heights City Code as set forth in the Compliance Order attached hereto; 2. That all relevant parties and parties in interest have been duly served notice of this hearing, and any other hearings relevant to the revocation or suspension of the license held by license holder. 3. That all applicable rights and periods of appeal as relating to the license holder, owner, occupant, or tenant, as the case may be, have expired, or such rights have been exercised and completed. Settlement Proposal Regarding Meredith Cable Rate Dispute The Cable Counsel reviewed some aspects of the Memorandum of Understanding. Motion by Ruettimann, second by Peterson to authorize the Mayor and City Manager to enter into a Memorandum of Understanding with Meredith Cable setting forth certain understandings, stipulations, and agreements between the City of Columbia Heights and Meredith Cable regarding basic service rates and related equipment charges, refunds of overcharges, provision of Universal PEG services, equipment replacement, and treatment of profits for sale or transfer of ownership of the cable system. Roll call: All ayes b. Authorization to Purchase and Install Furniture at the ~ibrar¥ Motion by Jolly, second by Ruettimann to authorize the Mayor and City Manager to enter into an agreement with P. M. Johnson's Contract Source for the purchase, delivery, and installation of Buckstaff furniture as listed above at a cost of $6,375.50 as listed in their formal written quotation, and that furthermore, the Council recognizes the purchase as a proprietary item. Authorization to Purchase Equipment for Unit #125 Motion by Jolly, second by Peterson to approve purchase of the equipment package for Unit #125 from Twin City Truck Equipment for the low quote of $4,332.85 to come from the City's Insurance Fund; and furthermore, to authorize the Mayor and City Manager to enter into an agreement for the same. Award Murzyn Hall Blinds Bid Motion by Jolly, second by Peterson to award the bid for Murzyn Hall blinds for the Main Hall to Vertical Blind Factory, based on their bid in the amount of $2,270.00 with funds to be appropriated from Fund 411-45129-5180; and furthermore to authorize the Mayor and City Manager to enter into an agreement for the same. Award Murzyn Hall Carpet and Tile Motion by Peterson, second by Jolly to award the bid for Murzyn Hall carpet and tile for the Mathaire/McKenna Rooms to Anderson's New Carpet Design based on their bid in the amount of $2,415.00 with funds to be appropriated from Fund 411- 45129-5120 and furthermore to authorize the Mayor and City Manager to enter into an agreement for the same. Motion by Nawrocki to reject the bids and get bids just to replace the seven feet of tile and the seven foot strip of carpet. Motion dies for lack of a second. Snow and Ice Control Plan Motion by Ruettimann, second byPeterson to adopt the Columbia Heights Master Plan for snowplowing, removal and ice control as submitted. Roll call: All ayes REPORTS a. Report of City Manager The City Manager's report was submitted in written form and the following items were discussed: School Board Meetina: Councilmembers Jolly and Nawrocki met with School District Superintendent Holt and Boardmembers Laine and Ostazeski regarding two issues. The first issue was about election date changes. It was noted that Fridley and Hilltop have decided to hold their elections in even years. There was some interest expressed in pursuing further information regarding the Mayor's Youth Program in Tempe, Arizona. REGULAR COUNCIL MEETING NOVEMBER 14, 1994 PAGE 15 11. A tentative date of December 7th was selected for a joint meeting of the City Council and the School Board. Use of City Water Tower for Antennas: The City Manager received a request to place an antenna on the City's water tower.
