The Council Meeting was called to order at 7:00 p.m. by Mayor
Murzyn.

The following items were approved on the Consent Agenda:
Minutes of Previous Meetinqs
The Council approved the minutes of the Regular Council
Meeting of June 8, 1992 as presented and there were no
corrections.
Request for Neighborhood Block Party
The Council approved the request submitted by Tom Ramsdell of
5134 Seventh Street Northeast to conduct a block party on June
27, 1992 from 6:00 p.m. until Midnight, with barricades being
placed on Sullivan Drive between Washington Street and Seventh
Street Northeast.

The Council approved the license applications as listed upon
payment of proper fees.
Payment of Bills
The Council approved the payment of the bills as listed out of
proper funds.

Public Hearinq Continuation of April 2, 1992, to Consider
the Proposed Transfer of Ownership for Cable Television
The City Manager advised that representatives of the cable
television company were not yet present at the meeting.
Motion by Nawrocki, second by Clerkin to continue the public
hearing until later in this meeting. Roll call: All ayes
Resolution No. 92-15; Beinq a Resolution in Recoqnition
of Companies and Individuals Contributinq to the Library
Re-Carpeting Project
Three members of the City Council requested their names be
removed from the resolution. Although they had volunteered
their services, the project was completed before they were
needed.
Motion by Nawrocki, second by Clerkin to waive the reading of
the resolution there being ample copies available for the
public. Roll call: All ayes
RESOLUTION NO. 92-15
BEING A RESOLUTION IN RECOGNITION OF COMPANIES AND INDIVIDUALS
CONTRIBUTING TO THE LIBRARY'S RE-CARPETING PROJECT
WHEREAS, The Columbia Heights Public Library re-carpeted the
adult reading room, main floor lobby, and interior stairwell
in June, 1992; and
WHEREAS, Said project required the moving of 25,000 books and
other materials from the shelves to a storage facility in the
parking lot; the moving of 24 ranges of steel shelving; and
the return of all of the above to the proper place in the
library building; and
WHEREAS, Said project required the coordinated efforts of many
people to come to a successful completion;
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of
the City of Columbia Heights wish to recognize the outstanding
cooperation and hard work given by the following companies and
individuals:

Second Readinq of Ordinance No. 1246, Beinq an Ordinance
Amendinq Ordinance No. 853, City Code of 1977,
Estabiishinq a City Tree Board
Motion by Ruettimann, second by Peterson to waive the reading
of the ordinance there being ample copies available for the

ORDINANCE NO. 1246
BEING AN ORDINANCE AMENDING ORDINANCE NO. 853, CITY CODE OF
1977, ESTABLISHING A CITY TREE BOARD
The City of Columbia Heights does ordain:
Section 1:
Section 3.316 of Ordinance No. 853, City Code
of 1977, passed June 21, 1977, which is
currently reserved, shall hereafter read as
follows:
3.316(1) There is hereby created and
established a City Tree Board for the City of
Columbia Heights, which shall be composed of
the members of the Park and Recreation
Commission.

3.316(2) Members of the Board shall

3.316(3) It shall be the responsibility of the
Board to study, investigate, counsel and
develop and/or update annually, and administer
a written plan for the care, preservation,
pruning, planting, replanting, removal or
disposition of public trees. Such plan will be
presented annually to the City Council and
upon their acceptance and approval shall
constitute the official comprehensive City
Tree Plan for the City of Columbia Heights,
Minnesota. The Board, when requested by the
City Council, shall consider, investigate,
make findings, reports and recommendations
upon any special matter of question coming
within the scope of its work. Notwithstanding
anything to the contrary herein, it shall be
the responsibility of the City Forester to
determine if a tree is hazardous to public
safety.
3.316(4) The Board shall choose its own
officers, make its own rules and regulations
and keep a journal of its proceedings. A
majority of the members shall be a quorum for
the transaction of business.
Section 2:
Section 3.316(5) of the City Code of 1977, as
amended, passed June 21, 1977, which is
currently reserved, shall hereafter read as
follows, to-wit:
3.316(5) The City Council shall have the right
to review the conduct, acts and decisions of
the City Tree Board. Any person may appeal
from any ruling or order of the City Tree
Board to the City Council who may hear the
matter and make final decision.
Section 3:
This ordinance shall be in full force and
effect from and after 30 days after its
passage.

Second Reading of Ordinance No. 1248, Beina an Ordinance
Amendinq Ordinance No. 853, City Code of 1977, Pertaininq
to Municipal Services~ Tree and Weed Services, Removal of
~~.ed _~Kees,~ and Spraying, Plantinq, and Routine
Removal
The City Manager reviewed all of the amendments contained in
Ordinance No. 1248. Some members of the Council had a number
of questions regarding the ordinance amendments. It was felt
that the entire ordinance should be reviewed at the time these
amendments are considered.
Motion by Nawrocki, second by Peterson to continue the public
hearing and that members of the City Council receive a copy of
the existing ordinance. Roll call: All ayes
Public Hearinq Continuation of April 2, 1992, to Consider the
Proposed Transfer of Ownership for Cable Television (cont.)
The City's cable counsel stated he had reviewed the proposed
transaction for the transfer of the cable franchise. The new
owners will be Meredith/New Heritage Corporation with
headquarters in Des Moines. He noted that reports of the
technical audit and the financial analysis are available as is
a videotape.
Representatives of the Meredith/New Heritage Corporation have
met with the Cable Commission. The Cable Commission will make
a recommendation to the Council regarding acceptance of the
transfer. The cable counsel advised that a "reasonable" basis
is needed for the City Council to deny the transfer.
Three representatives of the Meredith/New Heritage Corporation
were in attendance at the Council Meeting. They reviewed the
history of their company and gave some background regarding
their past and present ventures.

Counc]lmember Nawrocki addressed the history of the cable
franchise in Columbia Heights. He noted that subscriber rates
have increased steadily.
Motion by Clerkin, second by Nawrocki to continue the Public

First Reading of Ordinance No. 1250; Being an Ordinance
Pertaining to Conditional Uses Within a Floodway District
Motion by Nawrocki, second by Peterson to waive the reading of
Ordinance No. 1250 there being ample copies available for the
public. Roll call: All ayes

BEING AN ORDINANCE PERTAINING TO PERMITTED USES IN A FLOODWAY
DISTRICT
The City of Columbia Heights does ordain:
Section 1: Section 9.304(1) of the City Code of 1977, as
amended, passed June 21, 1977, which currently reads as
follows, to-wit:
9.304(1) Permitted uses. The following uses have a low flood
damage potential and do not obstruct flood flows. These uses
shall be permitted within the floodway district to the extent
that they are not prohibited by any other ordinance and
provided they do not require structures, fill, or storage of
materials, or equipment. In addition, no use shall adversely
affect the capacity of the channels or floodways or any
tributary to the mainstream or of any drainage ditch, or any
other drainage facility or system.

Motion by Peterson, second by Nawrocki to send a copy of
Ordinance No. 1250 to the Commissioner of Natural Resources.

OLD BUSINESS
a. Stop Sign on Tyler Street at 47th Avenue
Councilmember Ruettimann inquired of a resident from the
area of 47th and Tyler Street if he is aware of any
decreased vehicular speed since the stop sign has been
installed. The resident responded he has noticed that
traffic has slowed going both directions, north and
south. He feels the sign is effective.
b. Purchase of Police Cars
Councilmember Nawrocki had some material which addressed
the leasing of used vehicles which may be helpful for a
lease-type program for police vehicles. He felt there may
be a financial advantage available for the City.

Motion by Ruettimann, second by Nawrocki to accept the
work for Municipal Project #9101 and #9102 and to
authorize the final payment to Astech Corporation of St.
Cloud, Minnesota, in an amount of $2,282.59. Roll call:
All ayes
Request to Attend Traininq Out-Of-State Conference
Motion by Ruettimann, second by Peterson to authorize the
attendance of Chief David Mawhorter and Captain Leonard
Olson at the National Community Policing Conference in
Portland, Oregon, September 23-25, 1992; and furthermore,
to authorize related expenses from the police budget and
contributions fund. Roll call: All ayes
Establish Date for Public Improvement Hearing
Motion by Ruettimann, second by Peterson to establish a
Public Improvement Hearing for Tuesday, July 28, 1992 at
7:00 p.m. in the City Council Chambers. Roll call:

Release of Easement - 679 43rd Avenue Northeast
Motion by Peterson, second by Ruettimann to authorize the
Mayor and City Manager to sign a letter releasing the
unneeded sewer easement at 679 43rd Avenue Northeast.

Recycling Joint Powers Aqreement
Motion by Nawrocki, second by Peterson to authorize the
Mayor and City Manager to enter into a Joint Powers
Agreement with Anoka County to provide cooperation
between the City and the County to implement recycling
programs in the City of Columbia Heights and to make
available up to $59,091.12 for reimbursement of eligible
expenses for recycling activities; such agreement is
effective January - December, 1992. Roll call: Ail ayes
Hold Harmless Aqreement
The City Manager advised that the shooting site for the
Fourth of July fireworks was moved south of Huset Park
across 39th Avenue to accommodate larger shells. The
State requires a larger space around the firing zone. The
owners of the property on the south side of 39th Avenue
have requested a Hold Harmless Agreement.

Motion by Ruettimann, second by Peterson to approve the
Hold Harmless Agreement with the owners of the property
at 551 39th Avenue Northeast and to authorize the Mayor
and City Manager to sign same. Roll call: All ayes
REPORTS
Report of the City Manaqer
The City Manager's Report was submitted in written form
and the following items were discussed:
City Manager's vacation Schedule: The City Manager
distributed copies of his vacation schedule, July through
September.
Shared Ride - Additional Funding from RTB: The City will
receive an additional $29,092 from the Regional Transit
Board for the Shared Ride Program.
Water Testing Charges: The City Manager is in the process
of gathering information from the State Health Department
regarding the water testing project mandated by the
State. He advised that the Attorney General has ruled
that the statute is valid and the charges will start to
be collected in September.
Charges to Hilltop for Use of Columbia Heights Sewage
Pipes: The Metropolitan Waste Control Commission has
ceased paying for Hilltop's use of Columbia Heights'
sanitary sewage pipes. This commission indicated it
expects Columbia Heights to negotiate the rates and
manner of payment with Hilltop. The City Manager advised
that these negotiations are presently being reviewed by
the Columbia Heights City Attorney, City Engineer and the
Assistant City Engineer. He will be contacting Hilltop's
City Engineer regarding this matter.
Honeywell Project: Representatives of Honeywell have
toured or viewed all of the city buildings and parks.
Staff has prepared data and will be meeting with
Honeywell representatives on July 9th at 7:00 p.m. in City
Hall to review previous costs. The City Manager invited
all interested members of the Council to attend this
meeting. Mayor Murzyn indicated he will be attending.
Councilmember Nawrocki felt the staff should be seeking
comments and costs from alternative firms which would
provide similar services to those of Honeywell. This

would assure that the City would be receiving the most
cost effective services.
On August 18th at 7:30 p.m. Honeywell will be presenting
its proposal with the objective of having this matter on
the agenda of the August 24th Council Meeting.
Council Work Session: Monday, June 29th at 7:30 p.m. is
the date and time established for a Council work session.
Other work session dates will be selected at that work
session.
Report of the City Attorney
The City Attorney had nothing to report at this time.
