Mayor Carlson called the meeting to order at 7:00 p.m..

in Washington, D.C. representing the City of Columbia Heights.

The Council approved the minutes of the Regular Council Meeting of February
25, 1991 as presented end there were no corrections.

RESOLUTION NO. 91-13
FLAG PROTECTION RESOLUTION
WHEREAS, although the right of free expression is part of the foundation
of the United States Constitution, very carefully drawn limits an expression
in specific instances have long been recognized as legitimate means of main-
taining public safety and decency, as well as orderliness and productive
value of public dqbate; and
WHEREAS, certain actions, although arguably related to one person's free
expression, nevertheless raise issues concerning public decency, public
peace, and the rights of expression and sacred values of others; and
WHEREAS, there are symbols of our national soul such as the Washington
Monument, the United States Capitol Building, and memorials to our greatest
leaders, which are the property of every American and are therefore worthy
of protection from descration and dishonor; and
WHEREAS, the American Flag to this day is a most honorable and worthy banner
of a nation which is thankful for its strength and committed to curing Its
faults, and remains the destination of millions of immigrants attracted by
the unlversal power of the American ideal; and
WHEREAS, the law as interpreted by the United States Supreme Court no longer
accords to the Stars and Stripes that reverence, respect, and dignity befitting
the banner of that most noble experiment of a nation-state; and
WHEREAS, it is only fitting that people everywhere should lend their
voices to a forceful call for restoration to the Stars and Stripes of
a proper station under law and decency;

NOW, THEREFORE, BE IT RESOLVED, by the City of Columbia Heights, Minnesota,
that we respectfully request our State Senator Don Frank and our State
Representative Wayne Simoneau and the Minnesota State Legislature to memo-
ralize the Congress of the United States to propose an amendment of the
United States Constitution, for ratification by the states, specifying
that Congress and the 5tares shall have the power to prohibit the physical
desecration of the flag of the United States; and,
BE IT FURTHER RESOLVED, that copies of this resolutlon be transmitted to our
State Senator, our State Representative, and the American Legion Department
of Minnesota.

Request to Seek Written Quotations for Storage Bins
The Council authorized staff to receive written quotations for three storage
bins for road materials at the Municipal Service Center.
Authorization to Seek Bids for Miscellaneous Concrete Repairs
The Council authorized staff to seek bids on miscellaneous concrete work
for l~gl.
Authorizatlon to Seek Bids for Huset Park Press Box and Electrical Work
The Council authorized staff to seek bids for the replacement of the press
box at Field No. 3, in Huset Park and the necessary rewiring of ballfield
lights on Field No. 3 in conjunction with replacing the PCB transformers
as notified by MPCA.
Approval of License Applications
The Council approved the 1991 license applications as listed upon payment
of proper fees.
Payment of Bills
The Council authorized the payment of the bills as listed out of proper funds.

March 10, i~91 was designated as Chad A. Johnson Day in Minnesota by Governor
Arne Carlson. Mayor Carlson had attended the Court of Honor held on March
lOth for Chad Johnson who was recognized for saving the lives of eight of
his classmates. Chad is a Boy Scout and credits his scout training for having
the skills to save the lives.

Certain properties are considered unbuildable because of
soil conditions;.~and
Said properties have gone tax forfeit; and
Anoka County has been unable to sell the properties because of
the special assessments against each property for public improve-
ments; and
It would be beneficial to have these lots sold to private
persons for use other than building construction;
NOW, THEREFORE, BE IT RESOLVED, that the City of Columbia Heights waives
the special assessments of $1q,048.00 on property 36-30-24-21-
0032 and $11,072.00 on property 36-30-24-21-0037 providing
there shall forever be the restriction that if any utilities
are requested there should be charged fees equal to the current
special assessments which shall be in addition to any access
fees.

b. Request by Como Northtown Credit Union to Conduct Bingo
This credit union is seeking a one-day gambling permit to play bingo following
its annual meeting which is being held at Murzyn Hall. This association does
not meet the requirements for a permit as setforth by Resolutlons 88-ql and
88-q2 but the City Council traditionally grants one exception per year.
Motion by Clerkin, second by Paterson to direct the City Manager to advise
the Minnesota Charitable Gambling Control Board that the City has no objections
to the issuance of a one-time bingo permit to be conducted by the Como
Northtown Credit Union on April 1~, !~91 at Murzyn Hall; such association to
pay a $25.00 llcense fee to the City of Columbia Heights; and furthermore,
that the sixty-day waiting period be wa:ved. Roll call: AI1 ayes
8. OLD BUSINESS
a. Interfund Transfer to the Central Garage Fund
Motion by Clerkin, second by Ruettimann to authorize an interfund transfer
to the Central Garage Fund in the amount of $125~000 with the transfer coming
from the undesignated fund balance or retained earnings in the following
benefitting funds:

b. Update of Comprehensive 'Plan and Completion of Surface Water Management Plan
The Public Works Director advised this project should take about one year.
Motion by Ruettimann, second by Peterson to approve the selection of.;and contract-
ing with BRW, Inc. of Minneapolis for the Update of the City Comprehensive
Plan with completlon of the City Surface Water Ftanagement Plan, as per their
proposal of July 27, 1990, as amended by the BRW letter of November 20, 19~0,
at a cost not to exceed $42,820 for the completion of both plans.

a. First Time Homebuyer Program
Two local financial institutions are considering participating in this program.
Motion by Ruettimann, second by Paterson to grant approval for th® Housing
and Redevelopment Authority to apply for an allocation of up to $q,O00,O00
from the Minnesota Housing Finance Agency Minnesota City Participation

allocatlon, to provide the necessary City/HRA involvement in the program.

b. Business Revolving Loan Fund
Councilmember Ruettimann observed that this program is not a grant but rather
a rollover fund for use by businesses which must be paid back.
Motion by Ruettimann, second by Clerkin to approve the ~JPian for Business
Revolvlng Loan Fund" as approved by the HRA Board of Commissioners and as
attached to the City Councll Letter in regard to this matter. Roll call:

c. Authorization to Proceed with Rebuilding Wetwell at Chatham Road Lift
Station
Motion by Clerkin, second by Peterson to authorize staff to proceed with
design and seeking bids for work to rebuild the deteriorated wetwell at
the Chatham Road Sanitary Lift Station as provided for in the budget under
line item 602-qgq99-5130. Roll call: All ayes
d. Hepatitis B Vaccinations
Motion by Ruettimann, second by Peterson to authorize the Mayor and City
Manager to enter into an agreement with the City of Bloomlngton to provide
a 3-shot hepatitis B vaccination series to City employees who are at sub-
stantial risk of exposure to the hepatitis B virus, at a cost of $140

general fund undesignated fund balance to cover the cost of 3-shot
hepatitis B vaccination series for City employees at substantlal risk

e. Recycling Joint Powers Agreement
Motion by Ruettima~n, second by Clerkin to authorize the Mayor and City
Manager to enter into a Joint Powers Agreement with Anoka County to provide
cooperation between the County and the City to implement recycling and yard
waste compostlng programs in the City of Columbia Heights, once the agre-
ement has been reviewed and approved as to form by the City Attorney. The
Joint Powers Agreement will cover the period from January 1, 1991 through
June 30, 1991. The Agreement provides for the payment to the City of Columbia
Heights in the amount of $30,226.50 for meeting the goal of ~95.5 tons
of material recycled from al1 residential units in the City, as well as
yard waste management educational material, and other waste abatement activities

Motion by Paterson, second by Clerkin to amend the 1990 Recreation/Community
Education budgets to use $7,600 in Fund 259 Adult Athletics and $8,418 in
Fund 250 Administration and General Programs to offset the 1990 budget

g. Award of Contract for Computer Hardware Maintendnce
Motion by Paterson, second by Ruett|mann to authorize the Mayor and City
flanager to sign a contract for hardware maintenance on the Police Department

k. Water Quality Study - LaBelle Pond
A recommended moti'on was distributed by the City Engineer. He advised that the
potential total for this entire project could be approximately $50,000.
Motlon by Ruettlmann, second by Paterson to authorize staff to proceed with
the preparation of an RFP and to seek proposals for engineering services to
Improve the water quality of LaBelle Pond for Phase #1, not to exceed $7,000,
to come from funds budgeted in the 1~! Sewer Fund specified for this purpose.

10. REPORTS
a. Report of the City Manager
The City Manager's report was submitted in written form and the following
items were discussed:
1. Public Improvement Hearing - March 14th: The City Manager briefly reviewed
the proposals and projects to be discussed at the Public Hearing. He gave the
per foot costs including water hook-ups and costs which did not include this
work.
2. Installation of Water Lines in Innsbruck: Staff was directed to meet with
residents of this area to discuss new locations for installation of water
lines, it was the majority opinion of the Councll that this meeting could

be held with just staff and residents and members of the Council need
not attend.
3. Hilltop Police Contract: The Mayor and City Manager met with repre-
sentatives of the City of Hilltop to discuss the police contract the
City has with Columbia Heights. The City Manager reviewed the agreed
upon points. A motion will be drafted and be brought back to the Council
for its consideration.
b. Report of the City Attorney
The City Attorney has received the documents from the Crestview Lutheran Home's
legal counsel and they need signatures.
