Sherri Macko, 3952 Polk Street, stated the access to the alley behind her
property is ]ocated in the park and she inquired who paid the assessment
for this access area. She was advised the City owns the property and is
assessed.
Dave Dvorak, 3935 Van Buren Street, questioned the administrative costs
associated with this project. The City Manager explained the costs. Mr.
Dvorak felt guarantees should be required of the contractor who does
the sealcoating.
Motion by Nawrocki, second by Ruettimann to receive the petition received
from residents on 52nd to 53rd Avenues, 4th to Sth Streets, and place on
file. Roll call: All ayes
Motion by Nawrocki, second by Ruettimann to authorize the City Manager to
proceed with Project #gl01, sea]coating of all bituminous al]eys in the
City with the exception of the a]]ey between 52nd and $3rd Avenues, 4th
Street to 5th Street, and the a)ley between 37th and 38th Avenues, Madison
P)ace to 5th Street, and that the hearing on these two alleys be continued
until the Ragu)ar City Council meeting of March 25th; and that the City
Manager be directed to bring back to the Counci] additiona] information
that would respond to the concerns that have been raised on these two
a]leys at this hearing. Counci]member Nawrocki stated a hope that the
additional information for the al]ey 4th to 5th Streets, 52nd to 53rd
Avenues wou]d inc)ude what can be done to a)]eviate some of the water
prob)ems and what the costs might be according]y and that the Council
would consider that additiona) work at the continued hearing. Roll call:

Mrs. Kuppe, who owns property at 4020 Central Avenue, advised the Council
that her alley is included in the sealcoat project although it is fairly
new. She told the Council that a pipe which appears to contain some
wiring had been installed on her property adjacent to the alley. She
felt this was done at the request of a HRA staff person relative to some
portion of the Downtown Development project. She noted it is located on
her property but was not done with her permission. She felt this should
be looked at before the alley is sealcoated and expressed a concern for
safety as it comes up out of the ground. Councilmember Nawrock| requested
someone from the Engineering Department investigate and respond to Mrs.
Kuppe.
Councilmember Nawrocki requested staff investigate what is being planned
for the alley on Gould Avenue and respond to the concerns of Rodney Seifert,
1020 Gould Avenue, in writing.
b. Project #8721, Construction of 38th Avenue From 323' East of Fifth Street
to Madison Place
Using graphs and charts, the City Manager reviewed all facets of the proposed
project. The proposed road is 37' from back of curb to back of curb. Work
wou]d include watermain and storm sewer replacement, new concrete curb and
gutter including driveway aprons, required driveway replacement, concrete
service walk replacement, new aggregate base, new bituminous surfacing,
resodd|ng, and miscellaneous associated construction items.
The placement of a cul-de-sac near the west end of the street was explained.

The owner of the property at the westerly-most end of 38th Avenue at
Fifth Street inquired if any street improvements are planned for past
the cul-de-sac. He was advised there were none at this time.
This project had been delayed pending discussions regarding development
of the area to be completed. At a Council work session it had been
suggested that the City pay a portion of the costs of the project because
of the de]ay,
Motion by Ruettimann, second by Peterson that the City Council authorizes
the project with the provision that the City pay twenty-five percent of
the project minus the water stub outs. Roll call: All ayes
The timetable for the project will be presented to residents of the area
after the project has been awarded. It was noted that the costs given
at this hearing were estimates. It is Council policy if all of the bids
received come in ten percent higher than the estimates that the hearing
would be reopened.
4. CONSIDERATION OF RESOLUTIONS AUTHORIZING PROJECTS
Motion by Nawrocki, second by Clerkin to recess the i~earing to allow the
City Attorney to adjust the resolutions to reflect the action of the
Council. Roll call: All ayes
RECESS: 8:35 p.m.
RECONVENE: 8:50 p.m.
After reconvening the hearing, it was the consensus of the Council that the
resolutions should be considered at the next regular Council meeting and that
the hearing be recessed at this time.
Motion by Ruettimaon, second by Peterson to continue this Public Improvement
Hearing until March 25, 1991. Roll call: All ayes

PUBLIC IMPROVEMENT HEARING

The Public Improvement Hearing was called to order by Mayor Carlson at 7:00
p.m..
1. ROLL CALL
Nawrocki, Clerkin, Ruettimann, Peterson, Carlson - present
2. PURPOSE OF MEETING
To conduct a Public Improvement Hearing regarding various projects which, if
undertaken, will result in special assessments. Proposed projects deal with
construction of 38th Avenue from 323' east of Fifth Street to Madison Place
and sealcoating of all bituminous alleys in the City (with a few exceptions
as listed in the attached Notice of Public Hearing).
3. PRESENTATION OF INFORMATION BY STAFF
Stuart Anderson, City Manager, introduced City staff in attendance at the
Hearing.
a. Project #9101; Sealcoating of all bituminous in the City with the following
exceptions:
1) 3rd Street and TH47; 44th to 45th Avenues
2) 6th Street and 7th Street; 41st to 42nd Avenues
3) Peters Place and Gould Avenue Peters Place east to north-south alley
4) Reservoir Blvd. and Tyler Street 37th to 39th Avenues
5) 46th and 47th Avenues TH 65 to Tyler Street
6) Tyler Street and Polk Street 45th to 46th Avenues
7) Tyler Street and Polk Street 46th to 47th Avenues
8) Taylor Street,and Fillmore Street 45th to 46th Avenues
The work will include bituminous surface patching and sealcoating of the alleys.
Dave Pallies, 5253 4th Street, presented a petition on opposition to the seal-
coating of the alley. He stated that the alley is filled with water most of
the time and has large holes. He and his neighbors felt it would not be
prudent to sealcoat an alley in this condition. Me stated his willingness
to pay to have the alley repaired.
The Public Works Director felt this alley would need reconstruction. Costs
associated with alley reconstruction are about fifteen to twenty dollars
per foot. The City Manager advised if enough property owners on the alley
agreed to reconstruction the project wo{Jld be done. A petition requesting
the project must be ~eceived by the Council from 51% of the affected pro-
perty owners.
Rodney Seifert, 1020 Gould Avenue, advised the Council his alley is an
exception to the sealcoating and inquired why. The Public Works Director
stated that the alley cannot be sealcoated as a portion of it has only
gravel on its surface. He noted it is slated for a reconstruction hearing
in the future.
