HomeMy WebLinkAboutAugust 5, 1991OFFICIAL PROCEEDINGS COLUMBIA HEIGHTS CITY COUNCIL PUBLIC IMPROVEMENT HEARING AUGUST 5, 1991 The Public Improvement Hearing was called to order by Mayor Carlson at 8:00 p.m.. 1. ROLL CALL Nawrocki, Clerkin, Ruettimann, Peterson, Carlson - present 2. PURPOSE OF THE MEETING The purpose of the Public Improvement Hearing was to discuss the proposed construction projects for the following alleys: Third Street to Trunk Highway 47, between 44th and 45t' Avenues Sixth Street to Seventh Street, between 41st and 42nd Avenues Taylor Street to Fillmore Street, between 45t' and 46t' Avenues Linda Magee, Assistant to the City Manager, advised that the publication requirements for this hearing had been met and that notifications of the hearing had been sent to all affected property owners. 3. PRESENTATION OF INFORMATION BY STAFF a. Improvements for Alley Construction of Third Street to Trunk Highway 47, between 44th and 45th Avenues; PIR 874 Using an overhead, the Public Works Director reviewed the project and the costs. He noted that the costs are only estimates and are not firm figures. He advised that this alley construction will be done by City crews with a new piece of paving equipment recently purchased. It was felt that the costs of the project would be about 16% less being done by City crews rather than if it were to be done by a private contractor. It was noted that there is housing on only one side of this alley as it is bordered on the east by Trunk Highway 47. Since this is a State Highway, it was understood that the State does not pay any assessments on local projects such as this. The resident at 4445 Third Street inquired if the City would be amenable to paying half of the costs of this project as the State will not. He recalled that the PUBLIC IMPROVEMENT HEARING AUGUST 5, 1991 PAGE 2 last time this project was considered in 1987 the City Council had indicated a willingness to pay half of the project costs. He advised that he has seven signatures of affected property owners on a petition who will support the project if the City is willing to pay half of the costs. Motion by Clerkin, second by Ruettimann to accept the petition and place on file. Roll Call: All ayes The resident at 4453 Third Street stated she had circulated a petition against the project the last time it was being considered. She inquired why only blacktop is being considered rather than concrete. She was advised that the costs for concrete could easily be forty percent or higher as it must be done by a private contractor. The resident at 4433 Third Street inquired if the alley would be maintained better than it has been. He noted that he regularly cleans the catch basin behind his property and removed grass and debris so the basin does not plug up. He is ver inconvenienced with the alley the condition it presently is in and is very supportive of the project. Motion by Nawrocki, second by Ruettimann that conditioned upon the City's picking up one half of the assessable costs of the project, that the City Manager be authorized to proceed with Project 9106, Pir 874. Roll Call: All ayes b. Improvements for Alley Construction of 6th Street to 7th Street, between 41st and 42nd Avenues, PIR 875 The Public Works Director reviewed the project with the aid of an overhead and the cost estimates were discussed. The resident at 4142 Seventh Street advised he has some "soft spots" at the rear of his property adjacent to the alley. He inquired if any soil testing is planned for this area. The Public Works Director responded that he is aware of these spots and they will have to be excavated out before the work is done on the alley. A work sheet with costs for the alternative of concrete for this alley was distributed to the Council. The estimates for concrete were $35.96 per foot with the entire project estimated to cost about $43,000.00. Engineering and administrative costs were explained. He noted that cars do drag because of the rise in the middle of the alley. Councilmember Nawrocki felt the rise in the middle was a genuine concern. In response to the suggestion that sealcoating served just cosmetic purposes, he explained that it really extends the life of the alley. He felt if the damaged parts of the alley were removed and a sealcoat was done this would serve the purpose for a few years but that eventually a major reconstruction would need to be done. Motion by Nawrocki, second by Ruettimann that the City Manager be authorized to proceed with the Project #9107, PIR 875. Roll Call: All ayes c. Improvements for Alley Construction of Taylor Street to Fillmore Street, between 45th and 46th Avenues, PIR 876 The Public Works Director reviewed the project and the estimated costs. Mayor Carlson recalled that a few years ago the apron on the south end of the alley had some work done on it and inquired if this apron would be removed with this project. The Public Works Director explained that it would. The resident at 4550 Fillmore Street felt the work done on the alley a few years ago is still in fair condition. The property owner at 1133 45th Avenue agreed and noted he never uses the alley as his garage faces 45th Avenue. He did not think he should be assessed for the improvement. The owner of some multiple dwellings on the alley stated his tenants cannot use the alley. He presented photos of his property showing the location of his parking areas and a retaining wall. All of his tenants enter the property from the front. The Public Works Director advised that the base of the alley is falling apart and the north end of the alley is in poor condition. Another owner of multiple dwellings felt the alley project is too expensive and he PUBLIC IMPROVEMENT HEARING AUGUST 5, 1991 PAGE 4 is opposed to it. He referred to a newspaper article which labeled the area a "ghetto" and felt the area has been targeted by stricter enforcement of the Housing Maintenance Code than other areas in the City. Councilmember Nawrocki denied this area has been targeted and that the Housing Maintenance Code has been appropriately enforced. He noted that the Code is not intended to impact on the value of properties. He also observed that recent changes in the federal tax code has also changed some of the profit margin for rental properties so landlords can no longer buy a building, do little maintenance or upkeep and then sell at a profit or use as a tax write-off. Motion by Clerkin, second by Nawrocki to authorize the City Manager to proceed with Project #9108, Pir 876. Roll Call: All ayes 4. CONSIDERATION OF RESOLUTIONS AUTHORIZING PROJECTS a. Resolution No. 91-43; Being a Resolution Ordering Improvements for Alley Construction of Third Street to Trunk Highway 47, Between 44th and 45th Avenues NE; PIR 874, Project 9106 Motion by Ruettimann, second by Clerkin to waive the reading of the resolution there being ample copies available for the public. Roll call: All ayes RESOLUTION NO. 91 -43 BEING A RESOLUTION ORDER IMPROVEMENTS BE IT HEREBY RESOLVED by the City of Columbia Heights on the 10th day of June, 1991 ordered notice of a hearing to be given to property owners; and WHEREAS, pursuant to a notice of hearing certain residents appeared at a Council meeting on the 5th day of August, 1991; and WHEREAS, the Council determines to proceed with this local improvement, a portion of the cost being defrayed by special assessments under charter provisions. NOW, THEREFORE, IT IS HEREBY RESOLVED; 1. That the location and extent of such improvements is as follows: Alley construction from 3rd Street NE to Trunk Highway 47 sewer installation, PUBLIC IMPROVEMENT HEARING AUGUST 5, 1991 PAGE 5 new aggregate base, new bituminous alley surfacing, concrete alley replacement, required concrete or bituminous driveway replacement, resodding, and miscellaneous associated construction items. 2. That the materials to be used are as follows: Aggregate base, bituminous surfacing, concrete alley aprons, concrete driveway, sod, reinforced concrete storm sewer pipe, concrete catch basins and various appurtenances. That a careful estimate of the cost of the improvements has been made by the City Manager and the several lots and parcels of land fronting upon and adjacent to such proposed improvements, which be deemed benefitted thereby, were properly notified of said hearings. That the City Manager shall also list the names and owners of the several parcels so improved as nearly as can be ascertained. That the City Manager shall proceed with taking of bids for the improvements, or portions of the improvements as stated herein. 6. These improvements shall also be known as P.I.R. #874 - Project 9106. The City of Columbia Heights shall pay 50% of the assessable costs of the project. Passed this 5th day of August, 1991. That the City Manager shall proceed with taking of bids for the improvements, or portions of the improvements as stated herein. That a careful estimate of the cost of the improvements has been made by the City Manager and the several lots and parcels of land fronting upon and adjacent to such proposed improvements, which be deemed benefitted thereby, were properly notified of said hearings, and That the City Manager shall also list the names and owners of the several parcels so improved as nearly as can be ascertained. That the City Manager shall proceed with taking of bids for the improvements, or portions of the improvements as stated herein. 6. Roll call: All ayes Councilmember Nawrocki commented on the need to review how the engineering costs for projects are developed. He felt the Council should consider how the costs are calculated, noting that the engineering costs on the projects discussed at this hearing are approximately 20 %. Various dates were discussed for Council work sessions to discuss the budget with City depart- ments.
